AN ORDINANCE, specifying terms and directing the
Executive Director to convey by quit-claim deed the fee title to
part of a parcel of land at 9928 Gravois Road, St. Louis County,
Missouri, to the State of Missouri for the use of the State
Highway Commission of Missouri, together with the right to use a
certain part of the remainder of said parcel only during highway
construction for extension of slopes of highway excavation or
embankment and for turning and working space for men and
equipment.
WHEREAS, the State Highway Commission requires part of
a parcel of land owned by the District for the widening of Gravois
Road and needs to use certain space adjacent thereto during such
highway construction and has offered a fair price, and
WHEREAS, the needs of the District Maintenance
Department will be adequately served if the State Highway
Department is accommodated,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. For and in consideration of the sum of
Two Thousand Fifty Dollars ($2,050.00) the District does hereby
Remise, Release, and forever Quit-Claim to the State of Missouri
for the use of the State Highway Commission of Missouri all of its
right, title or interest in or to part of a parcel of land in St.
Louis County, Missouri, known as 9928 Gravois Road, such part
being described as follows:
A parcel of land in part of Lot 6 of Detjen Subdivision (according
to the plat thereof recorded in Plat Book 22, page 88 of the
St. Louis County Records) and in Lots 11, 12 and 13 of Affton
Terrace (according to the plat thereof recorded in Plat Book
31, page 20) and being described as follows:
Bounded on the west by Grantor's west property line, being an east
line of a tract of land heretofore conveyed to Frank Schwartz
and his wife, by deeds recorded in Book 2682, page 349 and
Book 4665, page 593, on the north by the existing south
right-of-way line of Gravois Road (80 feet wide), on the east
by the east line of said Lot 11 and on the south by a line
beginning at a point on Grantor's said west property line,
being 45 feet distance south of the hereinafter described
centerline of Gravois Road and extending northeast and
parallel to said centerline to the said east line of Lot 11,
containing 0.02 of an acre, more or less.
The centerline of Gravois Road is described as follows: Beginning
at Station 108 + 46.05 on the centerline of Gravois Road,
being distant 190.35 feet North 1 degree 08 minutes 35
seconds East of the southwest corner of said Lot 6 as
measured along the west line of said Lot 6 and its northerly
prolongation; thence along said centerline North 89 degrees
38 minutes 45 seconds East 85.80 feet to the north
prolongation of Grantor's west property line intersecting
said centerline at Station 107 + 60.25; thence continuing
North 89 degrees 38 minutes 45 seconds East 49.08 feet to P.
T. Station 107 + 11.22; thence northeast on the arc of a
curve to the left having a radius of 1637.28 feet, a distance
of 155.22 feet to the north prolongation of the said east
line of Lot 11 intersecting said centerline at Station 105 +
56.
TOGETHER WITH the right to use the following described adjacent
strip or parcel of land during the widening of Gravois Road as
presently proposed, and not thereafter, PROVIDED such strip is
restored to its present condition in the course of such highway
construction, for the purposes of extension of slopes of highway
excavation or embankment and for turning and working space for men
and equipment, to wit:
A parcel of Grantor's land on the south side of and adjoining the
south line of the above described right-of-way having the
uniform width of 10 feet and extending from Grantor's west
property line to opposite centerline Station 107 + 11.22;
thence narrowing to the uniform width of 5 feet and extending
northeast to the east line of Lot 11, containing 0.03 of an
acre, more or less, except for that part of the above
described strips encroached by 1 story concrete building.
Section Two. The Executive Director is directed to
execute a quit-claim deed giving effect to Section One hereof and
to deliver it to the grantee either directly or to the grantee's
escrow agent in exchange for the stated consideration. The foregoing Ordinance was adopted November 22, 1967.
