HomeMy Public PortalAbout01691 O R D I N A N C E NO. 1691 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer and drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of way and sewers of this District with a highway; and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject, however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances, herein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. Those portions of Rights of Way which are involved in this grant are those portions thereof described with reference to the centerline of State Highway Route M (140), as recorded in the office of the Recorder of Deeds of St. Louis County, Missouri, and are set forth as follows: PARCEL NO. 1: A parcel of land lying Northwest of and adjoining the Northwest line of State Highway Route M (140), (60 feet wide) having a width of 20 feet at a point opposite centerline Station 241+94 and increasing uniformly to a width of 21.47 feet at a point opposite centerline Station 241+54. PARCEL NO. 2: A parcel of land 20 feet wide lying Southeast of and adjoining the Southeast line of State Highway Route M (140), (60 feet wide) and extending from a point opposite centerline Station 241+54 to a point opposite centerline Station 241+94. PARCEL NO. 3: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Candle Lane to the -2- Southwest line of Elm Grove Lane. Also a triangular parcel extending 10 feet along the Northeast line of Candle Lane and 10 feet along the Northwest line of the above described 15 foot wide parcel. Also a triangular parcel extending 14 feet along the southwest line of Elm Grove Lane and 20 feet along the Northwest line of the above described 15 foot wide parcel. PARCEL NO. 4: A parcel of land 20 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Elm Grove Lane to a point opposite centerline Station 38+17; thence increasing from a width of 20 feet at a point opposite centerline Station 39+17 to a width of 29.76 feet at the Southwest line of White Birch Way. Also a triangular parcel of land extending 10 feet along the Northeast line of Elm Grove Lane and 10 feet along the Northwest line of the above described 20 foot wide parcel. PARCEL NO. 5: A parcel of land lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) having a width of 29.64 feet at the Northeast line of White Birch Way and decreasing uniformly to a width of 15 feet at a point opposite centerline Station 40+00; thence having a width of 15 feet from a point opposite centerline Station 40+00 to a point opposite centerline Station 42+75. PARCEL NO. 6: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Queen Ann Drive to the Northeast line of Hazel Woods Plat #2. Also a triangular parcel of land extending 7 feet along the Northeast line of Queen Ann Drive and 10 feet along the Northwest line of the above described 15 foot wide parcel. PARCEL NO. 7: A parcel of land 15 feet wide lying Southeast of and adjoining the existing Southeast right-of-way line of State Highway Route M (140) and extending from the Southwest line of Chez Paree Drive to a point opposite centerline Station 48+85. PARCEL NO. 8: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Southwell Drive to the Southwest line of Logola Drive. -3- PARCEL NO. 9: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Southwest line of Florland Plat #1 to the Southwest line of Florland Drive. PARCEL NO. 10: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Florland Plat #1 to a point opposite centerline Station 84+00. PARCEL NO. 11: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from a point opposite centerline Station 85+00 to a point opposite centerline Station 85+70. PARCEL NO.12: A parcel of land 15 feet wide lying Southeast of and adjoining the existing Southeast right-of-way line of Sate Highway Route M (140) and extending from a point opposite centerline Station 84+70 to a point opposite centerline Station 84+80. PARCEL NO. 13: A parcel of land 30 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from the Northeast line of Charbonier Road to a point opposite centerline Station 95+00. PARCEL NO. 14: A parcel of land lying Northeast of and adjoining the Northeast line of Washington Street being 15 feet wide from the existing Southeast right-of-way line of State Highway Route M (140) to a point 150 feet Southeast of said existing Southeast right-of-way line of State Highway Route M (140) to a point 257 feet Southeast of said existing Southeast right-of-way line of State Highway Route M (140). PARCEL NO. 15: A parcel of land bounded on the South by the existing North right-of-way line of State Highway Route M (140) and on the East, North and West by the following described lines: Beginning at a point 30 feet perpendicular distance North of centerline Station 120+00; thence Northerly to a point 70 feet perpendicular distance North of centerline Station 120+00; thence Westerly to a point 70 feet radial distance North of centerline Station 117+00; thence Westerly to a point 80 feet radial distance North of centerline Station 115+30; thence Southerly to a point 30 feet radial distance North of centerline Station 115+30. -4- PARCEL NO. 16: A parcel of land bounded on the North by the existing South right-of-way line of State Highway Route M (140) and on the West, South and East by the following described lines: Beginning at a point 30 feet radial distance South of centerline Station 115+57.6; thence Southerly to a point 50 feet radial distance South of centerline Station 115+57.65; thence Southerly to a point 76.5 feet radial distance South of centerline Station 115+63.27; thence Easterly to a point 70 feet radial distance South of centerline Station 116+00; thence Easterly to a point 65 feet perpendicular distance South of centerline S. T. Station 117+72.67; thence Easterly to a point 65 feet perpendicular distance South of centerline Station 120+00; thence Northerly to a point 30 feet perpendicular distance South of centerline Station 120+00. PARCEL NO. 17: A parcel of land bounded West, North and East by the West, North and East lines of Lot 18 of Brightwell Court and South and Southeast by the following described lines: Beginning at a point 70 feet radial distance South of centerline Station 153+38.7; thence Easterly to a point 70 feet radial distance South of centerline Station 153+65; thence Northeasterly to a point 50 feet radial distance South of centerline Station 154+00; thence Easterly to a point 50 feet radial distance South of centerline Station 154+70. PARCEL NO. 18: A parcel of land bounded West by the West line of Lot 1 of Brightwell Court; Northwest by the existing Southeast right-of-way line of State Highway Route M (140) and on the Southeast and Northeast by the following described lines: Beginning at a point 50 feet radial distance Southeasterly of centerline Station 155+30.35; thence Northeasterly to a point 50 feet radial distance Southeasterly of centerline Station 156+26; thence Southeasterly to a point 60 feet radial distance Southeasterly of centerline Station 156+26; thence Northeasterly to a point 80 feet radial distance Southeasterly of centerline Station 156+80; thence Northwesterly to a point 45 feet radial distance Southeasterly of centerline Station 156+80; thence Northeasterly to a point 45 feet perpendicular distance Southeasterly of centerline Station 160+70; thence Northwesterly to a point 30 feet perpendicular distance Southeasterly of centerline Station 160+70. PARCEL NO. 19: A parcel of land lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) having a width of 15 feet -5- from the East line of Woodridge Lane to a point opposite centerline Station 162+14; thence increasing uniformly from a width of 15 feet at a point opposite centerline Station 162+14 to a width of 22 feet at a point opposite centerline Station 163+60. PARCEL NO. 20: A parcel of land lying Southeast of and adjoining the existing Southeast right-of-way line of State Highway Route M (140) having a width of 15 feet at a point opposite centerline Station 208+70 and increasing uniformly to a width of 20 feet at a point opposite centerline Station 209+20; thence increasing uniformly from a width of 20 feet at a point opposite centerline Station 209+20 to a width of 30 feet at a point opposite centerline Station 211+75; thence decreasing uniformly from a width of 30 feet at a point opposite centerline Station 211+75 to a width of 15 feet at a point opposite centerline Station 212+00; thence having a uniform width of 15 feet from a point opposite centerline Station 212+00 to the east line of Block 21 of St. Ferdinand Commons. PARCEL NO. 21: A parcel of land 15 feet wide lying Northwest of and adjoining the existing Northwest right-of-way line of State Highway Route M (140) and extending from a point opposite centerline Station 209+15 to a point opposite centerline Station 209+45. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof.
