HomeMy Public PortalAbout01732SUPERSEDED AND REPEALED BY ORDINANCE NO. 1787 - 9/12/68 O R D I N A N C E NO. 1732 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer and drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, now known as Route AC (Halls Ferry Road), and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described Rights of Way according to plans approved by District's 2 Engineering Department and as hereinafter set forth, subject however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. Those portions of Rights of Way which are involved in this grant are those portions thereof described with reference to the centerline of State Highway Route AC (Halls Ferry Road), as recorded in the office of the Recorder of Deeds of St. Louis County, Missouri and are set forth as follows: PARCEL NO. 1: That portion of District's easements situated in Lot 46, in Capital Hill, Subdivision Number 4, St. Louis County, Missouri, more particularly described as: Beginning at a point on the existing western right-of-way line of Route AC (Halls Ferry Road) opposite Station 346+67, thence South 89 degrees 02 minutes 05 seconds West along the North line of said Lot 46, to a point 50 feet as measured at right angle to the hereinafter described centerline of said Route AC, thence Southeasterly and parallel to said centerline, to a point 50 feet perpendicular distance Southwesterly of Station 347+00, thence Northeasterly to a point on the existing western right-of-way line opposite said Station 347+00, thence Northwesterly along said right-of-way line to the place of beginning. PARCEL NO. 2: That portion of District's easement situated in Lot 59 in Capital Hill, Subdivision Number 4, St. Louis County, Missouri, more particularly described as beginning at a point on the existing western right-of-way line of Route AC (Halls Ferry Road) opposite Station 348+75 said point being 35 feet 3 perpendicular distance Westerly of the hereinafter described centerline of Route AC; thence South 89 degrees 21 minutes 05 seconds West to a point 45 feet perpendicular distance Southwesterly of Station 348+71.23; thence South 15 degrees 32 minutes 27 seconds East and parallel to said centerline, to a point 45 feet perpendicular distance Southwesterly of Station 349+00; thence North 74 degrees 27 minutes 33 seconds East to a point on the said existing right-of-way line opposite said Station 349+00; thence Northwesterly along said right-of-way line to the place of beginning. The centerline of State Highway AC for Parcels Number 1 and 2 is described as follows: Commencing at Station 353+10.16 on the centerline of State Route AC, at its intersection with the prolongated South line of Capital Hill, Subdivision Number 4, and distant North 89 degrees 01 minutes 33 seconds East 36.12 feet from a stone at the Southeast corner of said Capital Hill, Number 4, thence North 15 degrees 32 minutes 27 seconds West along said centerline, 366.89 feet to P. T. and Equation Station 349+43.27 Ahead equals Station 349+37.62 Back; thence Northwesterly along the arc of a curve to the left having a radius of 2865 feet, a distance of 270.62 feet to Station 346+67, the place of ending. PARCEL NO. 3: That portion of District's easement situated in Henry W. Kiel Park in Castle Point, Unit Number 3 of St. Louis County, Missouri, more particularly described as beginning at a point on the existing Northeastern right-of-way line of Route AC (Halls Ferry Road) being 40 feet perpendicular distance Northeasterly of the hereinafter described centerline of Route AC at Station 384+41; thence Northeasterly to a point 70 feet perpendicular distance Northeast of said Station 384+41; thence North 15 degrees 13 minutes 57 seconds West and parallel to said centerline, to a point that bears North 88 degrees 31 minutes 03 seconds East of Station 383+39.17; thence South 88 degrees 31 minutes 03 seconds West to a point on the existing Northeast right-of-way line of said Route AC, said point being 40 feet perpendicular distance Northeasterly of said centerline, thence South 15 degrees 13 minutes 57 seconds East along said existing right-of-way line to a point of beginning. PARCEL NO. 4: That portion of District's easement in U. S. Survey 110, Township 46 North, Range 7 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing western right-of-way line of Route AC (Halls Ferry Road) 30 feet perpendicular distance westerly of the hereinafter described centerline of Route AC at Station 383+58; thence Southwesterly to a point 70 feet perpendicular distance Westerly of said Station 383+58; thence South 15 degrees 13 minutes 57 seconds East and parallel to said centerline, to a point 70 feet perpendicular distance Westerly of Station 384+18; thence Easterly to a point on 4 said existing right-of-way line, 30 feet perpendicular distance Westerly of said Station 384+18; thence North 15 degrees 13 minutes 57 seconds West on said right of way line, to the place of beginning. The centerline of State Highway AC for Parcels Number 3 and 4 is described as follows: Beginning at Station 383+39.17 on the centerline of Route AC, said Station being distant South 88 degrees 31 minutes 03 seconds West, 30.94 feet from an iron pin at the Northwest corner of said Castle Point, Unit Number 3; thence South 15 degrees 13 minutes 57 seconds East, along said centerline, 101.83 feet to Station 384+41, the place of ending. PARCEL NO. 5: That portion of District's easement situated in U. S. Survey 110, Township 46 North, Range 7 East, St. Louis County Missouri, more particularly described as beginning at the point of intersection of the existing South right-of-way line of Chambers Road with the existing East right-of-way line of State Route AC (Halls Ferry Road) said point being 30 feet perpendicular distance Easterly of the hereinafter described centerline of Route AC at Station 397+92 and 20 feet perpendicular distance Southwesterly of the hereinafter described centerline of Chambers Road at Station 273+60; thence extending Northeasterly along the existing South right-of-way line of Chambers Road to a point opposite centerline Station 279+17.14; thence Southeasterly to a point 40 feet perpendicular distance Southeasterly of said Station 279+17.14; thence Southwesterly and parallel to said centerline of Chambers Road, to a point 40 feet radial distance Southeasterly of Station 277+25; thence Southeasterly to a point 45 feet radial distance Southeasterly of said Station 277+25; thence Southwesterly and parallel to said centerline, to a point 45 feet perpendicular distance Southwesterly of Station 274+00.42; thence Southwesterly to a point 50 feet perpendicular distance Northeasterly of Station 398+36.62 on the centerline of Route AC, thence Southwesterly to a point on the existing East right-of-way line of Route AC opposite said Station 398+36.32; thence North 15 degrees 08 minutes 12 seconds West and parallel to the centerline of Route AC to the place of beginning. PARCEL NO. 6: That portion of District's easement situated in U. S. Survey 110, Township 46 North, Range 7 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Western right-of-way line of Route AC (Halls Ferry Road) said point being 30 feet perpendicular distance Westerly of the hereinafter centerline of Route AC at Station 398+10; thence extending South 88 degrees 36 minutes 48 seconds West along the Southern existing right-of-way line of Chambers Road to a point 50 feet perpendicular distance westerly of the centerline of Route AC, thence South 5 15 degrees 08 minutes 12 seconds East and parallel to said centerline, to a point 50 feet perpendicular distance Westerly of Station 398+40; thence Easterly to a point on the existing West right-of-way line of Route AC, said point being 40 feet perpendicular distance Westerly of said Station 398+40; thence North 15 degrees 08 minutes 12 seconds West along the said existing right-of-way line to the point of beginning. The centerline of Route AC and Chambers Road for Parcels Number 5 and 6 is described as follows: Commencing at Station 397+31.07 on the centerline of Route AC, distant South 76 degrees 15 minutes 03 seconds West, 40.09 feet from an iron pin at the Southwest corner of Lot Number 1 of Block 75, Castle Point Unit Number 3 as per plat of same in Plat Book 29, Page 11, of said County Records; thence South 15 degrees 13 minutes 57 seconds East, along said centerline, 39.74 feet, intersecting the centerline of Chambers Road at Station 397+70.81, the point of beginning; thence South 15 degrees 08 minutes 12 seconds East on said centerline, 69.19 feet to Station 398+40; also beginning at Station 397+70.81 on the centerline of Route AC, being also Station 273+29.63 on the centerline of Chambers Road; thence North 75 degrees 46 minutes 48 seconds East along the centerline of Chambers Road, 220.53 feet to P. C. Station 275+50.22; thence Northeasterly along the arc of a curve to the left having a radius of 1322.53 feet a distance of 366.92 feet to P. T. Station 279+17.14, the place of ending. PARCEL NO. 7: That portion of District's easement situated in U. S. Survey 110, Township 46 North, Range 7 East, St. Louis County, Missouri described as beginning at a point on the existing Western right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Westerly of the hereinafter described centerline of Route AC at Station 401+00; thence extending Southwesterly to a point 50 feet perpendicular distance Southwesterly of Station 401+00; thence Southeasterly and parallel to said centerline, to a point 50 feet perpendicular distance Southwesterly of Station 401+25; thence Northeasterly to a point on the existing Western right-of-way line of Route AC, said point being 30 feet perpendicular distance Southwesterly of Station 401+25; thence North 15 degrees 08 minutes 12 seconds West and parallel to said centerline, to the place of beginning. The centerline of Route AC for Parcel Number 7 is described as follows: Commencing at Station 403+93.90 on the centerline of Route AC, distant South 74 degrees 51 minutes seconds West, 30.34' from an iron pin at the Southwest corner of St. Ferdinand Township Farmer Club as per deed in Book 132, Page 590 of Records of St. Louis County, Missouri; thence North 15 degrees 08 minutes 12 seconds West along said centerline, 293.90 feet to Station 401+00. 6 PARCEL NO. 8: That portion of District's easement situated in Lot 5 of Geiss Subdivision as per plat of same in Plat Book 49, Page 99, and in Northwest fractional quarter of Section 8, Township 46 North, Range 7 East, St. Louis County Missouri, more particularly described as beginning at a point on the existing Western right-of-way line of Route AC (Halls Ferry Road) said point being 30 feet perpendicular distance Southwesterly of the hereinafter described centerline of Route AC at Station 416+60; thence extending Southwesterly to a point 45 feet perpendicular distance Southwesterly of said Station 416+60; thence South 15 degrees 08 minutes 12 seconds East and parallel to said centerline, to a point 45 feet perpendicular distance Southwesterly of Station 417+00; thence Northeasterly to a point on the existing West right-of-way line of Route AC, being 30 feet perpendicular distance Southwesterly of said Station 417+00; thence North 15 degrees 08 minutes 12 seconds West and parallel to said centerline, to the point of beginning. PARCEL NO. 9: A portion of District's easement situated in Section 8, Township 46 North, Range 7 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Easterly of the hereinafter described centerline of Route AC at Station 420+75; thence extending Northeasterly to a point 45 feet perpendicular distance Easterly of said Station 420+75; thence South 15 degrees 08 minutes 12 seconds East and parallel to said centerline, to a point 45 feet perpendicular distance Easterly of Station 421+00; thence Southwesterly to a point on the existing Eastern right-of-way line of Route AC, 30 feet perpendicular distance Easterly of said Station 421+00; thence North 15 degrees 08 minutes 12 seconds West and parallel to said centerline, to the place of beginning. The centerline of Route AC for Parcels Number 8 and 9 is described as follows: Commencing at Station 419+92 on the centerline of Route AC, said Station being distant North 74 degrees 56 minutes 48 seconds East 29.96 feet of an iron pin at the Northeast corner of Lot 2 of Geiss Subdivision as per plat of same in Plat Book 49, Page 99, records of said county; thence North 15 degrees 08 minutes 12 seconds West along said centerline, 332 feet to Station 416+60. Also beginning at said Station 419+92; thence South 15 degrees 08 minutes 12 seconds East, along said centerline, 108 feet to Station 421.00. PARCEL NO. 10: That portion of District's easement situated in Section 8, Township 46 North, Range 7 East, St. Louis County, Missouri, described as beginning at a point on the existing Eastern right-of-way line of Route AC said point being 25 7 feet radial distance Northeasterly of the hereinafter described centerline of Route AC at Station 430+60; thence Northeasterly to a point 45 feet radial distance Northeast of said Station 430+60; thence Southeasterly and parallel to said centerline, to a point 45 feet radial distance Northeast of said Station 430+90; thence Southwesterly to a point on the existing Northeast right-of-way line of Route AC, being 26 feet radial distance Northeasterly of said Station 430+90; thence Northwesterly and parallel to said centerline, to the place of beginning. PARCEL NO. 11: That portion of District's easement situated in Section 8, Township 46 North, Range 7 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Western right-of-way line of Route AC, being 36 feet radial distance Westerly of the hereinafter described centerline of Route AC (Halls Ferry Road) at Station 430+60; thence Southwesterly to a point 45 feet radial distance Southwesterly of said Station 430+60; thence Southeasterly and parallel to said centerline, to a point 45 feet radial distance Southwesterly of Station 430+90; thence Northeasterly to a point on the existing Southwestern right-of-way line of Route AC, being 35 feet radial distance Southwesterly of said Station 430+90; thence Northwesterly and parallel to said centerline, to the place of beginning. PARCEL NO. 12: That portion of District's easement situated in Section 8, Township 46 North, Range 7 East, St. Louis County, Missouri, described as beginning at a point on the existing Northeastern right-of-way line of Route AC (Halls Ferry Road), being 30 feet radial distance Northeasterly of the hereinafter described centerline of Route AC at Station 432+45; thence extending Northeasterly to a point 55 feet radial distance Northeasterly of said Station 432+45; thence Southeasterly and parallel to said centerline, to a point 55 feet radial distance Northeasterly of Station 433+36; thence Southwesterly to a point on the existing Northeast right-of-way line of Route AC, being 31 feet perpendicular distance Northeasterly of said Station 433+36; thence Northwesterly and parallel to said centerline, to the place of beginning. The centerline of Route AC to Parcels 10, 11, and 12 is as follows: Commencing at Station 441+33.03 on the centerline of Route AC, distant North 61 degrees 01 minute 38 seconds East, 30.85 feet from a stone at the Northeast corner of Kraft Place Subdivision as per plat of same in Plat Book 13, Page 45, of the St. Louis County Records; thence North 28 degrees 48 minutes 22 seconds West 138.51 feet to P. I. Station 439+94.53; thence North 28 degrees 15 minutes 02 seconds West, 416.88 feet to P. T. and Equation Station 435+77.65 Ahead equals Station 435+75.83 Back; thence Northwesterly on the arc of a curve to the right having a radius of 5730 feet, a distance of 515.83 feet to Station 8 430+60. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted March 28, 1968.
