HomeMy Public PortalAbout01746 O R D I N A N C E NO. 1746 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, now known as Route 140 (Lindbergh Boulevard), and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described 2 Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission. Those portions of Rights of Way which are involved in this grant are set forth as follows: Parcel #1 - The portion of District's easement situated in part of North Tealbrook Drive as shown on the plat of Tealbrook Estates, thereof recorded in Plat Book 58, Page 8 of the St. Louis County Records and being more particularly described as follows: Beginning at the intersection of the North line of North Tealbrook Drive and the East line of Lindbergh Boulevard; thence East along said North line a distance of 190 feet; thence South 50 feet to a point in the South line of said North Tealbrook Drive; thence West along said South line a distance of 190 feet to a point in the said East line of Lindbergh Boulevard; thence North 50 feet to the point of beginning. Parcel #2 - That portion of District's easement situated in part of Quailways Drive as relocated by instrument recorded in Book 4696, Page 251 of the St. Louis County Records and being more particularly described as follows: Beginning at the intersection of the North line of Quailways Drive and the West line of Lindbergh Boulevard; thence West along said North line a distance of 220 feet; thence South 55 feet to the South line of said Quailways Drive; thence East along said South line a distance of 220 feet to a point in the said West line of Lindbergh Boulevard; 3 thence North 55 feet to the point of beginning. Parcel #3 - That portion of District's easement situated in Lot 10 of the Scheidt Estate in the Northeast quarter of Section 12, Township 45 North, Range 5 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at the intersection of the East line of Lindbergh Boulevard with the South line of North Tealbrook Drive according to plat recorded in Plat Book 58, page 8; thence South along said East line a distance of 460 feet; thence Northeast to a point 10 feet perpendicular distance East of said East line of Lindbergh Boulevard; thence North along a line parallel to and 10 feet East of said East line a distance of 420 feet to the South line of North Tealbrook Drive; thence West 10 feet along said South line to the point of beginning. Parcel #4 - That portion of District's easement situated in the East half of the Northwest quarter of Section 12, Township 45 North, Range 5 East, St. Louis, County, Missouri and being more particularly described as follows: Beginning at the intersection of the North line of Ladue Road with the original West line of Lindbergh Boulevard, (100 feet wide); thence North along said original West line a distance of 295.48 feet to a point; thence at right angles to said original West line a distance of 2 feet; thence South and parallel to said original West line a distance of 95.45 feet to a point on the North line of a 20 foot strip of land acquired by the State of Missouri (for highway purposes), as recited in Cause Number 210923 of the Circuit Court of St. Louis County; thence West at right angles to said West line of Lindbergh Boulevard a distance of 18 feet to the Northwest corner of said 20 foot strip; thence South along the West line of said 20 foot strip 144.97 feet to a point; thence Southwest a distance of 50.50 feet to a point distant 12 feet North of the said North line of Ladue Road and 49.14 feet West of the said original West line of Lindbergh Boulevard; thence South 12 feet to a point on the said North line of Ladue Road; thence East along the said North line of Ladue Road a distance of 49.14 feet to the place of beginning. Parcel #5 - That portion of District's easement situated in Lot 1 of the A.W. Dauster Estate Partition in the Southwest quarter of Section 12, Township 45 North, Range 5 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at the intersection of the West line of Lindbergh Boulevard with the South line of Ladue Road; thence West along said South line a distance of 50 feet; thence South at right angles to the South line of Ladue Road a distance of 20 feet; thence Southeast to a point on the said West line of Lindbergh Boulevard; thence North along said West line a distance of 82.6 feet to the point of beginning. Parcel #6 - Those portions of District's easements situated in Lots 38 and 40 of Clermont Park, according to the plat thereof recorded in Plat Book 23, Page 25 of the St. Louis County Records, 4 in Lots 1 and 2 of Clermont Court, according to the plat thereof recorded in Plat Book 65, Page 26, in Lots 49 and 73 of Clermont Estates, according to the plat thereof recorded in Plat Book 29, Page 16 and in Lot 1 of Henry Blaksley Estate the Southeast quarter of Section 12, Township 45 North, Range 5 East and being more particularly described as follows: Beginning at a point on the East line of Lindbergh Boulevard, being distant 143.31 feet South along said East line from a Southwest corner of said Clermont Estates; thence along said East line of Lindbergh Boulevard North, 1055 feet to a point; thence Southeast 275.41 feet to a point 15 feet perpendicular distance East of the said East line of Lindbergh Boulevard; thence South and parallel to said East line a distance of 590 feet; thence East at right angles to the said East line of Lindbergh Boulevard a distance of 5 feet; thence South and parallel to said East line a distance of 190 feet to a point; thence West at right angles to the said East line of Lindbergh Boulevard a distance of 20 feet to the point of beginning. Parcel #7 - Those portions of District's easements situated in Section 13, Township 45 North, Range 5 East and in Lot 5 of Lylewood, according to the plat thereof recorded in Plat Book 85, Page 12 of the St. Louis County Records and being more particularly described as follows: Beginning at the Southwest corner of said Lot 5; thence North along the East line of Lindbergh Boulevard a distance of 500.10 feet; thence East at right angles to said East line of Lindbergh Boulevard a distance of 10 feet; thence South and parallel to said East line a distance of 319.5 feet; thence East at right angles to said East line 20 feet; thence South and parallel to said East line 90 feet; thence West at right angles to said East line 20 feet; thence South and parallel to said East line 90.60 feet; thence West at right angles to said East line of Lindbergh Boulevard a distance of 10 feet to the point of beginning. Parcel #8 - That portion of District's easement situated in Lot 26 of Lylewood, according to the plat thereof recorded in Plat Book 85, Page 12 of the St. Louis County Records and in Lot 82 of Briarwood Plat 7, according to the plat thereof recorded in Plat Book 80, Page 44 of the St. Louis County Records and being more particularly described as follows: Beginning at the common corner of said Lots 26 and 82 on the East line of Lindbergh Boulevard; thence North along said East line a distance of 15 feet; thence East at right angles to said East line a distance of 10 feet; thence South and parallel to said East line a distance of 30 feet; thence West at right angles to said East line a distance of 10 feet to a point on said East line of Lindbergh Boulevard; thence North along said East line a distance of 15 feet to the point of beginning. Section Two. The Executive Director is hereby 5 authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted May 2, 1968.
