Vigoren 324.23 $12,565.08 111 MEDINA CITY COUNCIL MEETING MINUTES OF JULY 18, 1995 The City Council of Medina, Minnesota met in regular session on July 18, 1995 at 7:30 p.m. in the City Hall Council Chambers. Mayor Anne Theis presided. Members Present: John Ferris, James Johnson, Ann Thies, and Mayor Theis. Members Absent: Philip Zietlow. Also Present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City Engineer Shawn Gustafson, Zoning Administrator Loren Kohnen, City Attorney Ron Batty, and Clerk -Treasurer Jeff Karlson. 1. Adoption of the Agenda MOVED BY THIES, SECONDED BY MAYOR THEIS, TO ADOPT THE AGENDA WITH THE FOLLOWING ADDITIONS: • Gambling License for NRA Foundation • Discussion of Pioneer Trail as a County Road • Review Draft of Conditional Use Permit for Woodridge Church MOTION PASSED UNANIMOUSLY. 2. Hamel Lions Club -- Contribution to Hamel Memorial Park Bill Conger, president of the Hamel Lions Club, presented a check to Mayor Theis in the amount of $50,000 for the new Hamel Memorial Park. The contribution will be used for a park improvement designated by the Lions Club. Mayor Theis thanked the Lions Club for their generous contribution. 112 5. Park Commission Report Park Commission Chair Tom Gregor presented a list of park improvements that the Park Commission recommended for approval. The improvements included $500 for Ag lime infield at Maple Park and approximately $500 to repair the roofs of three structures at Independence Beach and Medina Morningside, and another building at Hunter Park which was vandalized. MOVED BY FERRIS, SECONDED BY THIES, TO APPROVE EXPENDITURES IN THE AMOUNT OF $1,000 FOR AG LIME INFIELD AT MAPLE PARK AND REPAIRS TO PARK STRUCTURES AT INDEPENDENCE BEACH, MEDINA MORNINGSIDE, AND HUNTER PARK. MOTION PASSED UNANIMOUSLY. Gregor said the Park Commission discussed what the new name should be for the former Hamel Legion Field. The Commission agreed that the park should be renamed Hamel Legion Park. Gregor said the Park Commission did not want to change the proposed Northwest Integrated Park Trail System created by the Northwest Hennepin League of Municipalities, the Suburban Hennepin Regional Park District and the Hennepin County Public Works Department. Gregor said the conceptual trail plan designated County Roads 19 and 24 as primary trail routes. Tom and Vickey Debrowski -- Preliminary Plat Approval MOVED BY FERRIS, SECONDED BY MAYOR THEIS, TO ADOPT RESOLUTION NO. 95-24, "RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR THOMAS A. DEBROWSKI AND VICKEY R. DEBROWSKI." AYES: FERRIS, JOHNSON, THIES, AND MAYOR THEIS. NAYS: NONE. RESOLUTION NO. 95-24 ADOPTED ON A 4-AYE AND 0-NAY VOTE. 8. Vacation of 60 Foot Street and Utility Easement MOVED BY THIES, SECONDED BY MAYOR THEIS, TO ADOPT RESOLUTION NO. 95-25, "RESOLUTION AFFIRMING VACATION OF 60 FOOT WIDE STREET AND UTILITY EASEMENT." AYES: FERRIS, JOHNSON, THIES, AND MAYOR THEIS. NAYS: NONE. RESOLUTION NO. 95-25 ADOPTED ON A 4-AYE AND 0-NAY VOTE. 9. Hennepin County -- EAW Hearing for Public Works Facility Loren Kohnen said the county asked the city to hold a public hearing in connection with the Environmental Assessment Worksheet (EAW) for their proposed public works 113 facility. Kohnen recommended that the hearing be held the second council meeting in August. MOVED BY MAYOR THEIS, SECONDED BY THIES, TO ESTABLISH AUGUST 15, 1995, AS THE DATE FOR A PUBLIC HEARING TO HEAR COMMENTS ON THE EAW FOR THE PROPOSED HENNEPIN COUNTY PUBLIC WORKS FACILITY. MOTION PASSED UNANIMOUSLY. 10. Petition to Control Speed on Tamarack Drive Dr. Paul Buscemi, 2310 Tamarack Drive, submitted a petition signed by several residents along Tamarack Drive requesting that the speed on Tamarack be controlled to a greater extent. John Ferris noted that he rode horses on Tamarack and the observation in the petition was correct. Ferris said the issue was enforcing the speed limit. Rick Rabenort agreed that the speed limit needed to be enforced. Rabenort said he had submitted an application to the Minnesota State Highway Patrol for a radar device which sits along side the road and shows motorists how fast they are going. Buscemi pointed out that Tamarack was becoming a thoroughfare to County Road 24, to Hunter Drive, and to Highway 55. Buscemi said he observed motorists daily going up to 65 miles per hour, mostly young people. He said the city could post 30 mph speed limit signs. Ferris said the city would not be able to enforce a 30 mph speed limit south of Medina Road. He said the reason Tamarack was posted at 30 mph north of Medina Road was because it was not a through street. Mayor Theis directed Rabenort to do everything necessary to crack down on speeders. 11. MCWD -- Long Lake Cleanup Project Shawn Gustafson said regardless of the city's concerns, it was quite possible that the Minnehaha Creek Watershed District would move ahead with their plan to put a wet detention pond on Jack Wahlfors' property. Gustafson said the 30 day comment period for the Environmental Assessment Worksheet ended today. John Ferris said at the July 6, 1995 meeting with the MCWD, the understanding was to reach some kind of agreement as to whether this project was cost -justified. However, Wenck did not provide Bonestroo with any new data to back up their assertions that the proposed project was necessary. Instead, the city received a letter from Wenck that was defensive and confrontational. Ferris pointed out that the cost per pound of phosphorus removed could be more than $3,500 with no guarantee that the result would be four inches of additional water clarity. 114 Ann Thies asked if the city had received any feedback from Senator Gen Olson. Ferris said he had spoken to her and was appreciative of her attentiveness to this project. Ferris said he would give her another call. Gustafson said the city had three disputes with the MCWD: (1) There was not an adequate cost/benefit analysis; (2) The MCWD was claiming that the improvement project would increase water clarity by four inches based on the concentration of phosphorus at 962 parts per billion. Gustafson said their data showed a third of that value. He noted that everything in the study was based on that number; (3) Gustafson said Bonestroo looked at the data taken in 1991 The value from April through June, the wettest time of the year, was 200 to 400 ppb. July was 3,000 ppb. Gustafson said it is difficult to take accurate measurements when flows are low. He said tests taken from April to June are more important than in July. Gustafson said a flow weighted average should have been used. Ferris said the MCWD had applied for a land alteration permit, but Jack Wahlfors also needed to be part of the application process. Ferris said the council should approve or deny the application based on cost -justification. Ann Thies asked if Orono or Long Lake had asked for a cost/benefit analysis of the project. Gustafson said Orono had some legitimate concerns about the project. He said it had to go before the Orono Planning Commission. Gustafson added that Orono had not signed the cooperative agreement. 12. County Road 116 Sewer Piling Improvement Project Shawn Gustafson said LaMetti & Sons uncovered the sanitary sewer line where the six inch sag was found. They were unable to determine exactly why the pipe was moving. Gustafson said either the pilings were damaged or were not secure. LaMetti plans to drive two new steel pipes along side the existing wooden piles, attach a new cap and reattach the pipe in this area. Gustafson said this work would be done next week. The steel piles can be driven with a smaller backhoe which would have less distrubance to the areas than a crane. LaMetti agreed athat this work would not result in additonal cost to the city. 13. Gambling License for NRA Foundation In connection with their application for a gambling permit, the city received a letter from NRA Field Representative Marilyn Bergum explaining the purpose of their November 29, 1995 fund raising event at the Medina Entertainment Center. Bergum noted that fifty percent of the net proceeds would be spent within the state for educational gun programs for elementary age children and basic firearms instruction courses for youth. The other 50 percent would be spent on similar programs on a national level. 115 MOVED BY FERRIS, SECONDED BY THIES, TO APPROVE A GAMBLING LICENSE FOR THE NRA FOUNDATION FOR THEIR FUND RAISING EVENT AT THE MEDINA ENTERTAINMENT CENTER ON NOVEMBER 29, 1995. MOTION PASSED UNANIMOUSLY. 14. Discussion of Pioneer Trail as a County Road Shawn Gustafson said the biggest issues to be resolved with Hennepin County in connection with their proposed public works facility were traffic -related. Gustafson said the county was willing to grant all of the city's requests except for one: the county would not agree to designate Pioneer Trail as a county road. Gustafson said the county pointed out that Pioneer Trail did not fit within the typical description or spacing of county roads. John Ferris asked if this solved the issue of paving the roads. Gustafson said he asked Jim Grube of Hennepin County how the paving would work. Grube said the city could request that the county pave the road and they would add it to their capital improvement budget. Gustafson said if the county designated Arrowhead Drive and Hamel Road as county roads, the city would not be able to restrict truck traffic on those roads. Gustafson said Grube mentioned the issue of the city blackmailing the county by demanding paved roads as a condition for approving the project and the legal ramifications that could result. Gustafson said the position of staff was that a traffic light at the intersection of Highway 55 and Arrowhead Drive would constrict traffic on Highway 55 which was a legitimate concern and justified Medina's demand for a paved bypass road. Mayor Theis said if the city could get the county to pave Pioneer Trail, there would be no need to hook up Hamel Road with County Road 11. Loren Kohnen said the county would not receive any state aid funds for Pioneer Trail, but would for County Road 11. Gustafson said the county indicated that Pioneer Trail was already a dust and maintenance problem and the city should fix the problem and not wait for the county to do it. Jim Dillman said to build Pioneer Trail the same way Medina Road was built would cost around one million dollars. John Ferris said the solution might be for the city to take care of Pioneer Trail as it did with Tamarack Drive. Ann Thies said the city would then be able to control county truck traffic. Dillman asked if there was a problem with County Road 24. 116 Ferris said there was nothing wrong with County Road 24, but he did not see why the city would need another road like Co. Rd. 24. Ferris said the issue was whether the city wanted another highway in Medina with no way to control the traffic. He said the ultimate concern would be to find the money to pave Hamel Road. Dillman said the cost of paving Hamel Road from Parkview Drive to Arrowhead would be approximately one and half million dollars. Gustafson said the county had threatened to pull the plug on the project and sue the city for their illegal demands. Kohnen pointed out that the county was concerned that the safety issue would be brought out in court and a judge would rule against the county. 15. Woodridge Church -- Conditional Use Permit Ron Batty provided a draft of the resolution which granted a conditional use permit to Woodridge Church. Batty asked the council to review the conditions in the resolution before the next meeting. Loren Kohnen said he was still waiting for a completed site plan which showed the placement of the driveway. 16. Payment of Bills MOVED BY THIES, SECONDED BY JOHNSON, TO APPROVE PAYMENT OF ORDER CHECK NUMBERS 14800-14846 IN THE AMOUNT OF $105,738.64 AND PAYROLL CHECK NUMBERS 14432-14445 FOR $12,565.08.
