CITY OF TIFFIN ORDINANCE NO. 2013-327
AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, FOR CERTAIN PROPERTY KNOWN AS WALKER
TRACTS, TIFFIN, JOHNSON COUNTY, IOWA, AND AS LEGALLY
DESCRIBED HEREIN.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, concerning property locally
described as Walker Tracts, Tiffin, Johnson County, Iowa, attached hereto
and incorporated herein.
Section 2. Amendment. The following legally described
property (36 acres):
Part of the Southeast Quarter of the Northeast Quarter of Section 29,Township 80 North,Range
7 West of the 5th P.M.,Johnson County,Iowa,being more particularly described as follows:
Commencing,as a point of reference, at the East Quarter Corner of Section 29,Township 80 North,
Range 7 West of the 5th Principal Meridian; Thence S00°00'00"W,an assumed bearing for the purpose of
this legal description, 359.05 feet to the Centerline of U.S. Highway No. 6 , at Centerline Station No.
136+37.8;Thence N 83°04'19"W, 578.95 feet along said Centerline to the Point-of-Tangency(Centerline
Station 130+58.8)of a 71,132.4 foot radius curve; Thence Northwesterly along said Centerline on said
71,132.4 foot radius curve, concave Southwesterly,
whose 600.0 foot chord bears N83°13'49"W,to the Point-of-Curvature of said 71,132.4 foot
radius curve: Thence N6°26'41"E,70.00 feet to a point on the Northeasterly Right-of-Way line of said
U.S. Highway No. 6; Thence Southeasterly 230.68 feet along said Right-of-Way line on a 71,202.4 foot
radius curve,concave Southwesterly,whose 230.68 foot chord bears S83°27'45"E;
Thence N00°29'24"E 316.5 feet to the POINT OF BEGINNING of the tract of land hereinafter
described:
Thence continuing N00°29'24"E 112.9 feet, more or less;
Thence S89°18'45"W, 392.58 feet to a point on the West line of the East Half of the Northeast
Quarter of said Section 29;
Thence Northerly 1070 feet,more or less,along the West line of the East Half of the Northeast
Quarter of said Section 29 to the Northwest corner of the Southeast Quarter of the Northeast
Quarter of said Section 29;
Thence Easterly 1320 feet,more or less, along the north line of the Southeast Quarter of the
Northeast Quarter of said Section 29 to the Northeast corner of the Southeast Quarter of the:y
Northeast Quarter of said Section 29;
Thence Southerly 1293 feet,more or less, along the East line of the Southeast Quarter of the

Northeast Quarter of said Section 29;
Thence N83°48'30"W, 936.8 feet,more or less,to the point of beginning.
Containing 36 acres,more or less.
shall be changed from zoning classification R-1A to R-1 C, Low-Density
Single-Family Residential District and further, that the official zoning
map of the City be amended to reflect the change described herein.
Section 3. Amendment. The following legally described
property (6.8 acres):
Part of the Southeast Quarter of the Northeast Quarter of Section 29,Township 80 North,Range
7 West of the 5th P.M.,Johnson County,Iowa,being more particularly described as follows:

BEGINNING of the tract of land hereinafter described:
Thence N00°29'24"E 316.5 feet
Thence S83°48'30"E 936.8'feet,more or less,to the East line of the Northeast Quarter of said Section 29;
Thence Southerly 33 feet,more or less, along the East line of the Northeast Quarter of said
Section 29 to the East Quarter Corner of said Section 29;
Thence Southerly 285 feet,more or less, along the East line of the Southeast Quarter of said
Section 29 to a point on said Northeasterly Right-of-Way line;
Thence Northwesterly 945 feet,more or less, along said Northeasterly Right-of-Way line to
the point of beginning.
Containing 6.8 acres,more or less.
shall be changed from zoning classification R-1A to C-2B, Community
Business Commercial District and further, that the official zoning map of
the City be amended to reflect the change described herein. The north
line of this tract is parallel to Highway 6.

Section 4. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 5. Severability. If any section, provision, or part of this
ordinance shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 6. Effective Date. This ordinance shall be in effect after
its final passage,.approval, and posting as provided by law.
On the 27th day of March 2013, at a regular/special meeting of the Tiffin City
Council,Tiffin, Iowa, Councilperson Kahler introduced Ordinance No. 2013-
237, and moved that it be given its first reading. The motion was seconded by
Councilperson Bartels.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2013-327, was
read the first time, discussed, and placed on record.
On the 10th day of April 2013, at a regular/special meeting of the Tiffin City
Council, Tiffin, Iowa, Councilperson Bartels introduced Ordinance No. 2013-
327, and moved that it be given its second reading. The motion was seconded
by Councilperson Kahler.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2013-327,was
read the second time and discussed and placed on record.
On the 24th day of April 2013, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Kahler introduced Ordinance No. 2013-327, and
moved that it be given its third and last reading. The motion was seconded by
Councilperson Ryan.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and the ordinance was passed and
adopted.

Whereupon the Mayor declared that Ordinance No. 2013-327 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the
Council on the 24th day of April 2013 and approved by the Mayor on the 25th
day of April 2013.

April 2013, and signed by the Mayor on the 25th day of April 2013, and
published on the 6th day of May 2013, by posting copies thereof in three public
places within the limits of the City of Tiffin, Iowa. That I posted copies of
