AN ORDINANCE authorizing the Executive Director and
the Secretary-Treasurer of The Metropolitan St. Louis Sewer
District to purchase from the owner thereof certain real property
in St. Louis County, Missouri, to be used as a site for ash
storage basins for the Water Pollution Abatement Program, part of
Contract P.A. 13, prescribing terms, and containing an emergency
clause.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and the Secretary-
Treasurer of the District are authorized to purchase from the
owner thereof, the following real property in St. Louis County,
Missouri, to be used as a site for ash storage basins for the
Water Pollution Abatement Program, part of Contract P.A. 13 at a
price not to exceed One Hundred Twenty-Five Thousand Dollars
($125,000.00) said property to be free of all encumbrances, said
property described as follows:
A tract of land in U.S. Survey 904, Township 44 North, Range 7
East, St. Louis County, Missouri; said tract being more
particularly described as follows:
Beginning at the point of intersection of the eastern line of the
Missouri Pacific Railroad Company, Right of Way, 80 feet
wide, with the southern line of U.S. Survey 904, being also
the northern line of the Jefferson Barracks Reservation;
thence northwardly 791.91 feet, along the eastern line of
said Missouri Pacific Railroad Company, Right of Way, along a
curve to the right having a radius of 5689.65 feet to a point
of tangency, the chord of which bears North 2 degrees 10-1/4
minutes East, 791.30 feet; thence North 6 degrees 09-1/2
minutes East, 423.17 feet along the eastern line of said
Missouri Pacific Railroad Company, Right of Way, to a point
of curve; thence northwardly 192.25 feet along the eastern
line of said Missouri Pacific Railroad Company, Right of Way,
along a curve to the left having a radius of 2904.93 feet,
the chord of which bears North 4 degrees 15-3/4 minutes East,
192.20 feet, to a point in the western prolongation of the
southern line of Lot 1 in Block 2 of JOHN C.IVORY'S
SUBDIVISION OF THE SOUTH CARONDELET SUBURB; thence East
112.19 feet, along said prolongation and along said southern
line of Lot 1, being also the northern line of property
described in deed to the School Sisters of Notre Dame,
recorded in Book 2435, Page 93, St. Louis County Recorder's
Office, to an angle point therein; thence South 67 degrees 49
minutes East, 800 feet, more or less, along the northeastern
line of said School Sisters of Notre Dame property to the
Mississippi River; thence southwestwardly along the
Mississippi River to the southern line of said U.S. Survey
904; thence North 89 degrees 01 minute West, 565 feet, more
or less, along the southern line of said U.S. Survey 904, to
the eastern line of said Missouri Pacific Railroad Company,
Right of Way and point of beginning.

Section Two. Upon the execution and delivery to them
by the said owner of a Warranty Deed in proper form, being free
from liens and encumbrances, conveying title to the said land to
The Metropolitan St. Louis Sewer District, the Executive Director
and the Secretary-Treasurer shall be and are hereby authorized and
directed to pay to said owner, for the said land, the total sum of
One Hundred Twenty-Five Thousand Dollars ($125,000.00).
Section Three. An emergency exists within the meaning
of the Plan, since the realty in needed for the protection of the
public health and the purchase must be arranged for without delay.
Accordingly, this ordinance shall take effect immediately upon
its enactment. The foregoing Ordinance was adopted June 13, 1968.
