AN ORDINANCE declaring the necessity for the
acquisition of certain existing private sewers and appurtenances
belonging to the Spanish Lake Service, Inc. within The
Metropolitan St. Louis Sewer District, for the purpose of
providing an adequate system of sanitary sewers to serve the needs
of residents of the Watkins Creek Trunk Subdistrict of The
Metropolitan St. Louis Sewer District, and authorizing the
institution of condemnation proceedings in connection therewith,
with an emergency clause.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area in the City of St. Louis and in St. Louis
County, Missouri, known as the Watkins Creek Trunk Subdistrict of
The Metropolitan St. Louis Sewer District in which there work and
live numerous people; and
WHEREAS, the most economical and feasible method of
providing an adequate sanitary sewer system for the residents of
the Watkins Creek Trunk Subdistrict is to acquire the private
sanitary sewers owned by Spanish Lake Service, Inc., and make it
a part of the public sewer system now under construction within
the Watkins Creek Trunk Subdistrict, so as to adequately protect
the public health and welfare of the residents within The
Metropolitan St. Louis Sewer District, and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by providing an adequate sanitary sewer system for the Watkins
Creek Trunk Subdistrict;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
provide an adequate sanitary sewer system for the residents of the
Watkins Creek Trunk Subdistrict, it is necessary to appropriate
and acquire by the exercise of eminent domain or otherwise, the
private sanitary sewers and appurtenances owned by Spanish Lake
Service, Inc. within the Watkins Creek area, and those just
adjacent to the Watkins Creek Trunk Subdistrict which are
necessary to serve the residents within the Watkins Creek Trunk
Subdistrict.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to acquire by purchase,
if possible, subject to approval of the Board of Trustees, or to
institute and prosecute an action in condemnation, as authorized
by law, if necessary, to appropriate and acquire the aforesaid
private property.
Section Three. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
Section Four. Acquisition of said property as an
essential part of a sewage system to serve the local area named is
urgently required for protection of the public health.
Accordingly, an emergency exists within the meaning of the Plan -2-
and this ordinance shall therefore take effect immediately upon
its enactment. The foregoing Ordinance was adopted July 25, 1968. -3-
