HomeMy Public PortalAbout01764 O R D I N A N C E NO. 1764 AN ORDINANCE authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, now known as Route F(21) between Lin Ferry Road and Gravois Road, and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described 2 Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission, excepting, however, that portion of District's facilities located from approximately 140 feet right of centerline Station 59+70 to 110 feet left of centerline Station 60+29, said facilities cross the centerline of highway at Station 60+03, which shall be 83.9% reimbursable. Those portions of Rights of Way which are involved in this grant are set forth as follows: Parcel No. 1 - That portion of District's easement situated in Lot 25 of St. Simon Court, according to plat thereof recorded in Plat Book 96, Page 17 of the St. Louis County Records, in U.S. Survey 2994, Township 44 North, Range 6 East and in Lot 2 and Lots 13 through 17 of Oak Forest, according to the plat thereof recorded in Plat Book 91, Page 40 of the St. Louis County Records and being more particularly described as follows: Beginning at a point on the existing Northwest right-of-way line of Tesson Ferry Road at a point 30 feet perpendicular distance Northwest of Station 31+92 on the hereinafter described centerline of State Highway F(21); thence Northeasterly along said existing Northwest line to a point 52.78 feet radial distance Northwest of centerline Station 39+71.22; thence Westerly to a point 71 feet radial distance 3 Northwest of centerline Station 39+38.16; thence Southwesterly to a point 74 feet radial distance Northwest of centerline Station 38+91.22; thence Southwesterly to a point 45 feet radial distance Northwest of centerline Station 38+60.37; thence Southwesterly along a line 45 feet Northwest of and parallel with the said centerline of Route F(21) to a point opposite centerline Station 31+92; thence Southeasterly a distance of 15 feet to the point of beginning. Parcel No. 2 - That portion of District's easement situated in Lots 94 and 95 of Sunset View Plat #3, according to the plat thereof recorded in Plat Book 62, Page 31 of the St. Louis County Records and being more particularly described as follows: Beginning at the most Northern corner of Sunset View Plat #3; thence along the Northwest line of said Sunset View South 69 degrees 56 minutes West, 121.48 feet; thence North 77 degrees 04 minutes East, 65.25 feet; thence South 10 degrees 36 minutes East, 31 feet; thence South 76 degrees 24 minutes East, 30.86 feet; thence North 71 degrees 07 minutes East, 16.93 feet; thence North 81 degrees 25 minutes East, 45.49 feet to a point in the Northeast line of said Lot 95; thence along said Northeast line of Lot 95 North 41 degrees 16 minutes West, 69.70 feet to the point of beginning. Parcel No. 3 - That portion of District's easements described in Case Nos. 192805 and 208060 of the St. Louis County Circuit Court, recorded in Book 4727, Page 252 and in easement described in Book 4851, Page 361 and in U.S. Survey 2995, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point 120 feet perpendicular distance Northwest of Station 61+00 on the hereinafter described centerline of State Highway F(21); thence Southeast to a point 130 feet perpendicular distance Southeast of said centerline Station 61+00; thence Southwesterly to a point 118.5 feet perpendicular distance Southeast of centerline Station 59+50; thence Northwesterly to a point on the existing West right-of-way line of Old Tesson Ferry Road at a point 105 feet perpendicular distance Northwest of said centerline Station 59+50; thence Northeasterly along said West line of Old Tesson Ferry Road to a point 102 feet perpendicular distance Northwest of centerline Station 60+20; thence Northerly to a point 120 feet perpendicular distance Northwest of centerline Station 60+40; thence Northeast and parallel to said centerline to the point of beginning. Parcel No. 4 - That portion of District's easement situated in Lots 2 and 3 of Lakeshire Second Addition, according to the plat thereof recorded in Plat Book 62, Page 8 of the St. Louis County Records and being more particularly described as follows: Beginning at a point on the existing Northwest right-of-way line of Tesson Ferry Road being 40 feet perpendicular distance Northwest of centerline Station 79+31.74; on the hereinafter described centerline of State Highway F(21); thence Southwesterly along said existing Northwest line to a point 40 feet 4 perpendicular distance Northwest of centerline Station 77+09.20; thence Northwesterly along the Southwest line of said Lot 2 to a point 45 feet perpendicular distance Northwest of centerline Station 77+09.20; thence Northeasterly and parallel to said centerline to a point 45 feet perpendicular distance Northwest of centerline Station 79+31.74; thence Southeast to the point of beginning. Parcel No. 5 - That portion of District's easement situated in Section 22, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point on the existing Southeast right-of-way line of Tesson Ferry Road at a point 30 feet perpendicular distance Southeast of Station 77+31 on the hereinafter described centerline of State Highway F(21); thence Northeasterly along said existing Southeast line of Route F(21) to a point 30 feet perpendicular distance Southeast of centerline Station 86+48.75; thence South-east to a point 45 feet perpendicular distance Southeast of said centerline Station 86+48.75; thence Southwesterly and parallel to said centerline to a point 45 feet perpendicular distance Southeast of centerline Station 77+31; thence Northwesterly to the point of beginning. Parcel No. 6 - That portion of District's easement situated in Lots 1 through 4 of Lakeshire #2, according to the plat thereof recorded in Plat Book 36, Page 66 of the St. Louis County Records and in the Northwest fractional quarter of Section 22, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point on the existing West right-of-way line of Tesson Ferry Road being 30 feet perpendicular distance West of Station 96+67.45 on the hereinafter described centerline of State Highway F(21); thence Northerly along said existing West right-of-way line to a point 30 feet perpendicular distance West of centerline Station 100+97.77; thence Westerly to a point 45 feet perpendicular distance West of said centerline Station 100+97.77; thence Southerly and parallel to said centerline to a point 45 feet perpendicular distance West of centerline Station 96+67.45; thence East to the point of beginning. Parcel No. 7 - That portion of District's easement situated in Lot 1 in Block 2 of Tesson Ferry Court Amended Plat, according to the plat thereof recorded in Plat Book 34, Page 16 of the St. Louis County Records and being more particularly described as follows: Beginning at a point being 13.43 feet North along the existing West right-of-way line of Tesson Ferry Road from the Southeast corner thereof; thence North along said existing West right-of-way line of Tesson Ferry Road 36.59 feet to the Northeast corner of said Lot 1; thence West along the South line of North Marlene Drive to a point 91.73 feet East along the said South line of North Marlene Drive from the Northwest corner of said Lot 1; thence Southeast to a point 20 feet perpendicular distance West of 5 the point of beginning; thence East 20 feet to the point of beginning. Parcel No. 8 - That portion of District's easement situated in the Southwest fractional quarter of Section 15, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point 55.20 feet perpendicular distance West of Station 125+03.95 on the hereinafter described centerline of State Highway F(21); thence Northerly to a point 60 feet perpendicular distance West of centerline Station 126+00; thence Northerly to a point 60 feet perpendicular distance West of centerline Station 126+29.52; thence Easterly to a point 30 feet perpendicular distance West of centerline Station 126+26.23 being a point of the existing West right-of-way line of Tesson Ferry Road; thence Southerly along said existing West right-of-way line to a point 30 feet perpendicular distance West of centerline Station 125+01.23; thence Westerly to the point of beginning. Parcel No. 9 - That portion of District's easement situated in part of Lot 5 or the Subdivision of Block 80 of the Mackenzie Tract in U.S. Survey 1953, Township 44 North, Range 6 East, St. Louis County, Missouri and being more particularly described as follows: Beginning at a point on the existing West right-of-way line of Tesson Ferry Road being 30 feet perpendicular distance West of Station 129+09.02 on the hereinafter described centerline of State Highway F(21); thence Southerly along said existing West right-of-way line to a point 30 feet perpendicular distance West of centerline Station 127+39.92; thence Westerly to a point 60 feet perpendicular distance West of centerline Station 127+37.95; thence North and parallel to said centerline to a point 60 feet perpendicular distance West of centerline Station 129+09.02; thence Easterly to the point of beginning. The centerline of State Highway F(21) is described as follows: Beginning at the most Southern corner of Lot 1 of said St. Simon Court; thence South 55 degrees 30 minutes East, 30.12 feet to Station 30+33.03 on the centerline of State Highway F(21); thence along said centerline North 44 degrees 45 minutes 30 seconds East, 677.98 feet to Equation Station 37+11.01 back equals Station 37+10.37 ahead; thence continuing along said centerline North 44 degrees 45 minutes 30 seconds East, 50 feet to P.C. Station 37+60.37; thence Northeast on the arc of a curve to the right having a radius of 1091.67 feet a distance of 100 feet to P.C. Station 38+60.37; thence Northeast on the arc of a curve to the right having a radius of 819.02 feet a distance of 200 feet to the centerline Station 40+60.37. Also beginning at a concrete monument set at the intersection of the Northwest line of Old Tesson Ferry Road with the South line of the Mo-Pac Railroad right-of-way; thence along the said Northwest line of Old Tesson Ferry Road South 30 degrees 20 minutes 08 seconds West, 199.88 feet to an old stone set at the most Southern corner of a tract of land heretofore conveyed by deed recorded in Book 3478, Page 492; 6 thence South 61 degrees 54 minutes 45 seconds East, 98.35 feet to Station 61+05.37 on the centerline of State Highway F(21); thence along said centerline South 28 degrees 05 minutes 15 seconds West, 155.37 feet to centerline Station 59+50. Also beginning at the most Western corner of said Lakeshire Second Addition; thence South 57 degrees 47 minutes 15 seconds East, 163.87 feet to a point on the tangent to the centerline of State Highway F(21); thence along said tangent North 46 degrees 39 minutes 15 seconds East, 89.83 feet to S.T. and Equation Station 78+95.24 back equals Station 77+07.50; thence along the centerline of Route F(21) North 46 degrees 39 minutes 15 seconds East, 941.25 feet to P.C. Station 86+48.75. Also beginning at the Southeast corner of said Lakeshire #2; thence South 89 degrees 39 minutes 55 seconds East, 29.80 feet to Station 97+67.53 on the centerline of State Highway F(21); thence along the centerline of Route F(21) South 1 degree 10 minutes 45 seconds West, 100.08 feet to centerline Station 96+67.45, also from said centerline Station 97+67.53 and along said centerline of Route F(21) North 1 degree 10 minutes 45 seconds East, 330.24 feet to centerline Station 100+97.77. Also beginning at the Northwest corner of Lot 2 of Block 1 of said Tesson Ferry Court Amended Plat; thence along the North line of said subdivision South 86 degrees 37 minutes 45 seconds East, 168.25 feet to Station 111+30.65 on the hereinafter described centerline of State Highway F(21); thence along the centerline of Route F(21) North 2 degrees 07 minutes 35 seconds East, 531.53 feet to P.C. Station 116+62.18; thence along said centerline on the arc of a curve to the left having a radius of 22,918.33 feet a distance of 157.78 feet to P.T. Station 118+19.96; thence along said centerline North 1 degree 43 minutes 55 seconds East, 875.43 feet to P.I. Station 126+95.39; thence along said centerline North 1 degree 34 minutes 45 seconds East, 213.63 feet to centerline Station 129+09.02. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. 7 The foregoing Ordinance was adopted July 25, 1968.
