HomeMy Public PortalAbout01776REPEALED BY ORDINANCE NO. 7644 - 12/28/88 O R D I N A N C E NO. 1776 AN ORDINANCE, establishing building lines or floodway reservation lines along and adjacent to the East Fork of Black Creek and the Hampton Branch of such East Fork of Black Creek, controlling the use of private lands within such lines, providing for the policing of the lands within such lines, and providing penalties for violations. WHEREAS, a substantial area within the District is drained by the East Fork of Black Creek and the Hampton Branch of the East Fork of Black Creek, which run in or through the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In the Board's judgment, building lines or floodway reservation lines along and adjacent to the East Fork of Black Creek and the Hampton Branch thereof are required for the public health and convenience, for the adequate drainage of the District, and for the protection of property from the encroachment of flood waters. Section Two. Building lines or floodway reservation lines as described below are hereby established along the center lines, and adjacent thereto on each side at varying distances, of the East Fork of Black Creek and the Hampton Branch of the East Fork of Black Creek. (The term "right of way" is used below only to specify the distance from the center line of the watercourse to the particular building line or floodway reservation line hereby established.) East Fork - Black Creek Commencing at a point on the centerline of Manchester Road distant S 50Ε 31' 45" W 135 feet plus or minus along said centerline from its intersection with the prolongation of the centerline of Hanley Road; thence N 7Ε 28' 15" W 50' plus or minus to a curve to the left having a radius of 400 feet; thence along said curve 32 feet plus or minus to the point of beginning of the centerline of the East Fork of Black Creek having Right-of-Way width of 52.5 feet each side of said centerline; thence along a curve to the right having a radius of 120 feet 196 feet plus or minus to a curve to the left having a radius of 120 feet; last curve crossing the most westerly line of Hanley Road 115 feet plus or minus northerly along the most westerly line of Hanley Road from its intersection with the most northerly line of Manchester Road; thence along said curve 59 feet plus or minus to its point of tangency; thence N 54Ε 26' 45" E 475 feet plus or minus to a curve to the left having a radius of 200 feet; thence along said curve 139 feet plus or minus to its point of tangency; thence N 14Ε 26' 45" E 347 feet plus or minus to a curve to the right having a radius of 300 feet, being the end of 52.5 feet Right-of-Way each side of centerline and the beginning of 50 feet Right-of-Way each side of centerline, last course crossing the most easterly line of the St. Louis Belt and Terminal Railroad Right-of-Way 550 feet plus or minus northerly along the most easterly line of the St. Louis Belt and Terminal Railroad Right-of- Way form its intersection with the most northerly line of Manchester Road; thence along said curve 136 feet plus or minus to its point of tangency; thence N 40Ε 26' 45" E 647 feet plus or minus to a curve to the left having a radius of 300 feet; thence along said curve 194 feet plus or minus to its point of tangency; thence N 3Ε 26' 45" E 192 feet plus or minus to a curve to the right having a radius of 120 feet; thence along said curve 109 feet plus or minus to its point of tangency, last curve crossing the most westerly line of Laclede Station Road 125 feet southerly along the most westerly line of Laclede Station Road from its intersection with the most southerly line of Weaver Avenue; thence N 55Ε 26' 45" E 50 feet plus or minus to a curve to the left having a radius of 215 feet; thence along said curve 114 feet plus or minus to its point of tangency; last curve crossing the most southerly line of Weaver Avenue 60 feet plus or minus easterly along the most southerly line of Weaver Avenue from its intersection with the most easterly line of Laclede Station Road; thence N 24Ε 56' 45" E 29 feet plus or minus to a curve to the right having a radius of 200 feet; thence along said curve 68 feet plus or minus to its point of tangency; thence N 44Ε 26' 45" E 198 feet plus or minus to a curve to the left having a radius of 300 feet; thence continuing N 29Ε 56' 45" E 503 feet plus or minus to the end of 47.5 feet Right-of-Way each side of centerline and the beginning of 40 feet Right-of-Way each side of centerline; thence continuing N 29Ε 56' 45" E 410 feet plus or minus to a curve to the left having a radius of 200 feet; thence along said curve 94 feet plus or minus to its point of tangency; thence N 2Ε 56' 45" E 90 feet plus or minus to a curve to the right having a radius of 200 feet; last course crossing the most southerly line of West Bruno Avenue 213 feet plus or minus westerly along the most southerly line of West Bruno Avenue from its intersection with the most westerly line of Bredell Avenue; thence along said curve 79 feet plus or minus to its point of tangency; thence N 25Ε 26' 45" E 205 feet plus or minus to a curve to the right having a radius of 170 feet; thence along said curve; 177 feet plus or minus to its point of tangency; thence N 85Ε 26' 45" E 62 feet plus or minus to a curve to the left having a radius of 140 feet; last course crossing the centerline of Bredell Avenue 330 feet plus or minus northerly along the centerline of Bredell Avenue from its intersection with the prolongation of the most northerly line of West Bruno Avenue, which is the end of 40 feet Right-of-Way each side of centerline and the beginning of 37.5 feet Right-of-Way each side of centerline; thence along said curve 89 feet plus or minus to its point of tangency; thence N 48Ε 56' 45" E 503 feet plus or minus to a curve to the left having a radius of 370 feet; thence along said curve 261 feet plus or minus to its point of tangency; thence N 8Ε 26' 45" E 710 feet plus or minus to the most southerly line of Dale Avenue which is the end of Right-of-Way of East Fork Branch of Black Creek. Section Three. Such building lines are the limits of 5 floodway reservations. No buildings or part of a building or appurtenance thereof or any structure shall be set up or erected within such reservations. Section Four. Except by permission of the Board pursuant to ordinance, no fill shall be made within such reservations which may diminish the area of flow or otherwise obstruct in any way the free flow of flood waters in such reservations nor without such permission shall any dams, walls, or other watertight or practically watertight structures be constructed or placed within such reservations. Section Five. District maintenance and supervisory personnel and other authorized agents of the Board shall have the right to enter upon the lands hereby reserved and to clean, police, and otherwise maintain the channel and banks of the streams or watercourses described herein, so that the natural and healthful flow of the stream may be maintained at all times. Section Six. It shall be unlawful for any person to deposit, dump, or otherwise dispose of, within the building lines hereby established, any sewage, garbage, rubbish, industrial wastes, loose material, oils, or other soluble or insoluble solid or liquid matter, which may pollute the streams or subsequently be washed away or carried downstream or which may leave unhealthful or unsightly traces either in the bed of the stream or on the banks thereof. The Executive Director may by written order require any 6 person who shall have violated any of the provisions of this section to remove any or all material such person may have deposited or otherwise disposed of within such lines. In case of the failure of the owner of any land within such lines to remove any such material upon such order, the Executive Director shall order such material removed at the expense of such owner and, if the owner shall fail to pay the cost of such work, the District may file a lien for the amount thereof against the property with the Recorder of Deeds of either the City of St. Louis or of St. Louis County, as the case may be. Section Seven. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than One Hundred Dollars ($100.00) nor more than One Thousand Dollars ($1,000.00) or be imprisoned in the city workhouse or the county jail, as the case may be, not less than ten (10) days nor more than One Hundred Eighty (180) days, or by both such fine and imprisonment for each violation. Each day in which any such violation shall continue shall be deemed a separate offense. 7 The foregoing Ordinance was adopted August 29, 1968.
