HomeMy Public PortalAbout01788 O R D I N A N C E NO. 1788 AN ORDINANCE superseding Ordinance No. 1722 on the same subject, and repealing all provisions thereof inconsistent herewith, authorizing and directing the Executive Director to grant to the State of Missouri, for the use of the State Highway Commission of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer and drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, the State Highway Commission of the State of Missouri wishes to cross certain Rights of Way and sewers of this District with a highway, now known as Route AC (Halls Ferry Road), and WHEREAS, the State Highway Commission of the State of Missouri has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Ordinance No. 1722, adopted by the Board of Trustees of The Metropolitan St. Louis Sewer District, is 2 hereby superseded, and all provisions thereof inconsistent with this ordinance are hereby repealed. Section Two. The Metropolitan St. Louis Sewer District does hereby grant to the State of Missouri, for the use of the State Highway Commission, the right to construct, reconstruct, repair and maintain a highway across the following described Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the full access to and use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain and reconstruct the new and existing sewers and appurtenances therein. Those portions of Rights of Way which are involved in this grant are those portions thereof described with reference to the centerline of State Highway Route AC (Halls Ferry Road), as recorded in the office of the Recorder of Deeds of St. Louis County, Missouri, and are set forth as follows: Parcel No. 1 - That portion of District's easement situated in Lot 23 of St. Ferdinand Commons in St. Louis County, Missouri, more particularly described as beginning at a point on the existing Northeast right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet Northeasterly as measured at right angles to the hereinafter described centerline of said Route AC and bears North 52 degrees 52 minutes 30 seconds East 30.47 feet of Station 140+82.32; thence extending North 52 degrees 52 minutes 30 seconds East to a point 60 feet perpendicular distance Northeasterly of said centerline, thence South 29 degrees 09 minutes 30 seconds East and parallel to said centerline to a point 60 feet perpen-dicular distance Northeasterly of said centerline, said point bears North 87 degrees 39 minutes 30 seconds East of Station 3 142+99.80; thence South 87 degrees 39 minutes 30 seconds West to a point on the existing Northeast right-of-way line of said Route AC, said point being 30 feet perpendicular distance Northeast of said centerline; thence North 29 degrees 09 minutes 30 seconds West and parallel to said centerline to the point of beginning. Parcel No. 2 - That portion of District's easement situated in Block 23, Township #7 North, Range 6 East, St. Louis County, Missouri, more particularly described as beginning at a point on the Southwest right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Southwesterly of the hereinafter described centerline of said Route AC at Station 142+00; thence South 29 degrees 09 minutes 30 seconds East along said right-of-way line to a point 30 feet perpendicular distance Southwesterly of Station 143+00; thence Southwesterly to a point 70 feet perpendicular distance Southwesterly of said Station 143+00; thence North 29 degrees 09 minutes 30 seconds West and parallel to said centerline to a point 70 feet perpendicular distance Southwesterly of Station 142+00; thence Northeasterly to the place of beginning. The centerline of Route AC for Parcels Nos. 1 and 2 is described as follows: Beginning at Station 142+99.80 on the centerline of Route AC (Halls Ferry Road), said Station being distant North 87 degrees 39 minutes 30 seconds East 319.12 feet from a stone at the Southeast corner of the North half of Block 23 of St. Ferdinand Commons; thence North 29 degrees 09 minutes 30 seconds West along said centerline 317.48 feet to Station 140+82.32. Parcel No. 3 - Those portions of District's easements situated in Blocks Nos. 23, 25 and 30 in St. Ferdinand Common in Township 47 North, Range 6 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), being 30 feet Easterly as measured at right angles to the hereinafter described centerline of said Route AC, said point bears North 87 degrees 47 minutes 30 seconds East from Station 148+09.55; thence extending South 29 degrees 09 minutes 30 seconds East along said right-of-way line to a point 30 feet perpendicular distance Northeasterly of Station 151+50; thence Northeastwardly to a point 45 feet perpendicular distance Northeasterly of said Station 151+50; thence North 29 degrees 09 minutes 30 seconds West and parallel to said centerline to a point 45 feet perpendicular distance Northeasterly of Station 148+32.43; thence South 87 degrees 47 minutes 30 seconds West to the point of beginning. The centerline of Route AC is described as follows: Commencing at Station 142+99.80 on the centerline of Route AC (Halls Ferry Road), said Station being distant South 87 degrees 39 minutes 30 seconds West 319.12 feet from a stone at the Southeast corner of the North half of Block 23, St. Ferdinand Commons; thence South 29 degrees 09 minutes 30 seconds East along said centerline 850.20 4 feet to Station 151+50. Parcel No. 4 - Those portions of District's easements situated in Lot 1209 and 1210 in Paddock Hills Subdivision No. 15, in St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Northeasterly of the hereinafter described centerline of said Route AC at Station 166+00; thence extending South 29 degrees 09 minutes 30 seconds East along said right-of-way line to a point 30 feet perpendicular distance Northeasterly of Station 167+46.49; thence Northeastwardly to a point 45 feet perpendicular distance Northeasterly of said Station 167+46.49; thence North 29 degrees 09 minutes 30 seconds West and parallel to said centerline to a point 45 feet perpendicular distance Northeasterly of Station 166+00; thence Southwestwardly to the place of beginning. The centerline of Route AC is described as commencing at Station 165+10.31 on the centerline of Route AC, said Station being distant North 87 degrees 56 minutes West 33.47 feet from a stone at the Northwest corner of the Paddock Hills Subdivision No. 15; thence South 29 degrees 09 minutes 30 seconds East along said centerline 236.18 feet to Station 167+46.49. Parcel No. 5 - Those portions of District's easements situated in Lot Nos. 1201 through 1208 inclusive, in Paddock Hills Subdivision No. 15, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Northeasterly of the hereinafter described centerline of said Route AC at Station 167+96.49; thence South 29 degrees 09 minutes 30 seconds East along said right-of-way line to a point 30 feet perpendicular distance Northeasterly of Station 174+13.30; thence Northeastwardly to a point 45 feet perpendicular distance Northeasterly of said Station 174+13.30; thence North 29 degrees 09 minutes 30 seconds West and parallel to said centerline to a point 45 feet perpendicular distance Northeasterly of Station 167+96.49; thence Southwestwardly to the place of beginning. Parcel No. 6 - Those portions of District's easements situated in Lots 1196 through 1200 inclusive, in Paddock Hills Subdivision No. 15 in St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Northeasterly of the hereinafter described centerline of said Route AC at Station 174+63.30; thence South 29 degrees 09 minutes 30 seconds East along said right-of-way line to a point 30 feet perpendicular distance Northeasterly of said centerline, said point bears North 87 degrees 45 minutes 30 seconds East 33.63 feet from Station 178+48.28; thence North 87 degrees 45 minutes 30 seconds East to a point 45 feet perpendicular distance Northeasterly of said centerline; thence North 29 degrees 09 minutes 30 seconds West and parallel to said 5 centerline to Station 174+63.30; thence Southwestwardly to the place of beginning. Parcel No. 7 - That portion of District's easement situated in Block 47, Township 47 North, Range 6 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road) said point being 30 feet radial distance Northeasterly of the hereinafter described centerline of said Route AC at Station 180+25; thence Southeastwardly and parallel to said centerline to a point 30 feet radial distance Northeasterly of Station 180+40; thence North 87 degrees 52 minutes 30 seconds East to a point 55 feet radial distance Northeasterly of Station 180+53; thence Northwestwardly and parallel to said centerline to a point 55 feet radial distance Northeasterly of Station 180+37; thence South 88 degrees 13 minutes 30 seconds West to the point of beginning. The centerline of Route AC for Parcels Nos. 5, 6 and 7 is described as follows: Beginning at Station 178+48.28 on the centerline of Route AC, said Station being distant South 87 degrees 45 minutes 30 seconds West 33.63 feet of a concrete monument at the Southwest corner of Lot 1196 of Paddock Hills Plat No. 15 in St. Louis county Missouri; thence North 29 degrees 09 minutes 30 seconds West along said centerline 1051.79 feet to Station 167+96.49, the place of ending for Parcels No. 5 and 6. Also commencing at Station 178+48.28 on said centerline; thence South 29 degrees 09 minutes 30 seconds East 71.06 feet to P.C. Station 179+19.34; thence Southeasterly along the arc of a curve to the left having a radius of 34,380 feet, a distance of 133.66 feet to Station 180+53, the place of ending for Parcel No. 7. Parcel No. 8 - That portion of District's easement situated in Lot 3 in Marietta Hills Subdivision Plat No. 3, St. Louis County, Missouri, more particularly described as beginning at a point at the intersection of the existing Southeast right-of-way line of Marietta Drive with the existing Northeast right-of-way line of Route AC (Halls Ferry Road); thence extending Southeastwardly along the said right-of-way line of Route AC, a distance of 60 feet to a point; thence Northeastwardly at a right angle to said right-of-way line 15 feet to a point; thence Northwestwardly and parallel to said existing right-of-way line of Route AC, 62.21 feet to a point on the existing Southeast right-of-way line of Marietta Drive; thence South 47 degrees 35 minutes 30 seconds West 15.16 feet along said Marietta Drive to the place of beginning. Parcel No. 9 - That portion of District's easement situated in Lot 24 of St. Ferdinand Commons in St. Louis County, Missouri, more particularly described as beginning at a point on the existing Northeast right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet radial distance Northeasterly of the hereinafter described centerline of Route AC at Station 189+50; thence extending Southeastwardly along said right-of-way line to a point opposite Station 189+85; thence Northeastwardly to a point 6 45 feet radial distance Northeasterly of said Station 189+85; thence Northwardly and parallel to said centerline to a point 45 feet radial distance Northeasterly of Station 189+50; thence Southwestwardly to the place of beginning. The centerline of Route AC is described as follows: Commencing at Station 184+21.34 on the centerline of Route AC, said Station being distant North 87 degrees 47 minutes 30 seconds West 31.44 feet from an iron pin at the Northwest corner of Lot A of Marietta Plat No. 3, St. Louis County, Missouri; thence South 29 degrees 30 minutes 30 seconds East along said centerline 87.68 feet to P.C. Station 185+09.02; thence Southeastwardly along the arc of a curve to the left having a radius of 3820 feet, a distance of 475.98 feet to Station 189+85. Parcel No. 10 - Those portions of District's easement situated in Lot 3 of Subdivision of Reuben Musick's Estate, in Lot 2 of Subdivision of William Hyatt Farm, in fractional Section 25, Township 47 North, Range 6 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Northeasterly of the hereinafter described centerline of said route AC at Station 219+65, thence extending South 42 degrees 05 minutes 10 seconds East along said right-of-way line to a point 30 feet perpendicular distance Northeasterly of Station 223+49.60; thence Northeastwardly to a point 82.56 feet perpendicular distance Northeasterly of said Station 223+49.60; thence Southwestwardly to a point 60 feet perpendicular distance Northeasterly of Station 223+10; thence North 42 degrees 05 minutes 10 seconds West and parallel to said centerline to a point 60 feet perpendicular distance Northeasterly of Station 221+26.79; thence North 88 degrees 35 minutes 50 seconds East to a point 65 feet perpendicular distance Northeasterly of Station 221+31.09; thence North 42 degrees 05 minutes 10 seconds West and parallel to said centerline to a point 65 feet perpendicular distance Northeasterly of Station 219+65; thence Southwestwardly to the place of beginning. Parcel No. 11 - That portion of District's easement situated in the North half of fractional Section 25, Township 47 North, Range 6 East St. Louis County, Missouri, more particularly described as beginning at a point on the existing Western right-of-way line of Route AC (Halls Ferry Road), said point being 30 feet perpendicular distance Southwesterly of the hereinafter described centerline of said Route AC at Station 219+65; thence south 42 degrees 05 minutes 10 seconds East along said right-of-way line to a point 30 feet perpendicular distance Southwesterly of Station 219+95; thence Southwestwardly to a point 60 feet perpendicular distance Southwesterly of said Station 219+95; thence North 42 degrees 05 minutes 10 seconds West and parallel to said centerline to a point 60 feet perpendicular distance Southwesterly of Station 219+65; thence Northeastwardly to the place of beginning. 7 The centerline of Route AC for Parcels No. 10 and 11 is described as follows: Commencing at Station 237+20.85 on the centerline of Route AC, said Station being distant South 88 degrees 12 minutes 50 seconds West 388.62 feet from the stone at the East quarter corner of said Section 25; thence North 42 degrees 05 minutes 10 seconds West along said centerline 1755.85 feet to Station 219+65. Parcel No. 12 - That portion of District's easement situated in Seven Hills Plat No. 1 in fractional Section 25, Township 47 North, Range 6 East, St. Louis County, Missouri, more particularly described as beginning at a point on the existing Eastern right-of-way line of Route AC (Halls Ferry Road), said point being Northeasterly of the hereinafter described centerline of Route AC opposite Station 265+38.04; thence extending South 37 degrees 32 minutes 30 seconds East along said right-of-way line to a point opposite Station 272+44.27; thence Northeastwardly to a point 60 feet perpendicular distance Northeasterly of said Station 272+44.27; thence North 37 degrees 32 minutes 30 seconds West and parallel to said centerline to a point 60 feet perpendicular distance Northeasterly of Station 265+38.04; thence Southwestwardly to the place of beginning. Parcel No. 14 - That portion of District's easements situated in U>S. The centerline of Route AC for Parcel Nos. 14 and 15 is described as follows: Commencing at Station 268+11.93 on the centerline of Route AC distant North 89 degrees 57 minutes 30 seconds East 77.34 feet from a stone at the Southeast corner of Section 25, Township 47 North Range 7 East; thence South 37 degrees 32 minutes 30 seconds East along said centerline 987.99 feet to P.I. Station 277+99.92; thence South 45 degrees 41 minutes 27 seconds East 406.73 feet to Equation and P.T. Station 282+06.65 back equals Station 282+07.83 ahead; thence South 45 degrees 41 minutes 27 seconds East 1454.88 feet to P.C. Station 296+62.71; thence Southeasterly along the arc of a curve to the left having a radius of 11460.0 feet, a distance of 137.29 feet to Station 298+00. Section Three. The State Highway Commission will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate or repair because of such highway use, such work will be done at the cost of the State Highway Commission, on those portions of District's facilities located previously on private right-of-way belonging to the District and located on highway right-of-way, within the following limits: Location No. 1 - That portion of its facilities lying approximately 57 feet left of centerline Station 140+75 to approximately 57 feet left of centerline Station 143+20 to approximately 53 feet left of centerline Station 143+26. Location No. 2 - That portion of its facilities lying approximately 70 feet right of centerline Station 142+48 to approximately 39 feet right of centerline Station 142+49 to approximately 30 feet right of centerline Station 142+59. 9 Location No. 3 - That portion of its facilities lying approximately 43 feet left of centerline Station 148+32 to approximately 44 feet left of centerline Station 151+20. Location No. 4 - That portion of its facilities lying approximately 37 feet left of centerline Station 166+29 to approximately 36 feet left of centerline Station 167+46.49. Location No. 5 - That portion of its facilities lying approximately 36 feet left of centerline Station 167+96.49 to approximately 37 feet left of centerline Station 174+13.30. Location No. 6 - That portion of its facilities lying approximately 37 feet left of centerline Station 174+63.3 to approximately 36 feet left of centerline Station 178+30 to 30 feet left of centerline Station 178+33. Location No. 7 - That portion of its facilities lying approximately 30 feet left of centerline Station 180+39 to approximately 35 feet left of centerline Station 180+39 to approximately 55 feet left of centerline Station 180+48. Location No. 8 - That portion of its facilities lying approximately 45 feet left of centerline Station 188+02 to approximately 30 feet left of centerline Station 188+09. Location No. 9 - That portion of its facilities lying approximately 30 feet left of centerline Station 189+67 to approximately 45 feet left of centerline Station 189+65. Location No. 10 - That portion of its facilities lying approximately 30 feet right of centerline Station 218+80 to approximately 60 feet right of centerline Station 219+80. Location No. 11 - That portion of its facilities lying approximately 30 feet left of centerline Station 219+80 to approximately 65 feet left of centerline Station 219+80 to approximately 57 feet left of centerline Station 223+02 to approximately 60 feet left of centerline Station 223+05. Location No. 12 - That portion of its facilities lying approximately 60 feet left of centerline Station 265+69 to approximately 57 feet left of centerline Station 265+69 to approximately 59 feet left of centerline Station 272+44.27. Location No. 13 - That portion of its facilities lying approximately 58 feet left of centerline Station 273+84.30 to approximately 58 feet left of centerline Station 274+69 to approximately 3 feet right of centerline Station 274+69. Also that portion of its facilities lying approximately from 58 feet to 60 feet left of Station 274+69. 10 Location No. 14- That portion of its facilities lying approximately 36 feet right of centerline Station 297+63 to approximately 30 feet right of centerline Station 297+68. Location No. 15 - That portion of its facilities lying approximately 30 feet left of centerline Station 298+13 to approximately 60 feet left of centerline Station 298+35. Section Four. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section Two and Three hereof. The foregoing Ordinance was adopted September 12, 1968.
