HomeMy Public PortalAbout01790REPEALED BY ORDINANCE NO. 7644 - 12/28/88 O R D I N A N C E NO. 1790 AN ORDINANCE, establishing building lines or floodway reservation lines along and adjacent to the Watkins Creek Main Channel, and the Bellefontaine Church Road Lateral and the Northgate Lateral Channels thereof, controlling the use of private lands within such lines, providing for the policing of the lands within such lines, and providing penalties for violations. WHEREAS, a substantial area within the District is drained by the Watkins Creek Main Channel and the Bellefontaine Church Lateral and the Northgate Lateral Channels thereof, which run in or through the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In the Board's judgment, building lines or floodway reservation lines along and adjacent to the Watkins Creek Main Channel and the Bellefontaine Church Road Lateral and the Northgate Lateral Channels thereof are required for the public health and convenience, for the adequate drainage of the District, and for the protection of property from the encroachment of flood waters. Section Two. Building lines or floodway reservation lines as described below are hereby established along the center lines, and adjacent thereto on each side at varying distances, of the Watkins Creek Main Channel and the Bellefontaine Church Road Lateral and the Northgate Lateral Channels thereof. 2 (The term "right of way" if and where used below is intended only to specify the distance from the center line of the watercourse to the particular building line or floodway reservation line hereby established.) WATKINS CREEK MAIN CHANNEL Downstream from Riverview Drive to Mississippi River. A strip of land 125 feet wide, the centerline thereof being more particularly described as follows: The centerline of a 125 foot wide strip of land described as beginning at a point in the center line of Riverview Drive, 60 feet wide, distant North 1 degree 00 minutes West 237.15 feet from its intersection with the City Limits line of the City of St. Louis, Missouri; thence eastwardly 161.52 feet along a curve to the right having a radius of 1000 feet to a point of tangency, the chord of which bears South 86 degrees 34-1/2 minutes East 161.34 feet; thence South 81 degrees 57 minutes East 1402.51 feet to a point of curve; thence southeastwardly 374.37 feet along a curve to the right having a radius of 300 feet to a point of tangency; thence South 10 degrees 27 minutes East to the Mississippi River. Upstream from Riverview Drive to termination. BELLEFONTAINE CHURCH ROAD LATERAL CHANNEL A strip of land of varying width, the centerline thereof being more particularly described as follows: The centerline of a 125 foot wide strip of land described as beginning at a point in the centerline of the Watkins Creek Main Channel, known as Station 90+17.62 said point also being a point of reverse curve; thence northeastwardly 228.64 feet along a curve to the right having a radius of 200 feet to a point of tangency; thence North 12 degrees 37-1/2 minutes East 421.36 feet along the centerline of a symmetrical transition from a 125 foot width to a width of 80 feet; thence continuing North 12 degrees 37-1/2 minutes East 59.14 feet to a point of curve; thence northwestwardly 395.10 feet along a curve to the left having a radius of 500 feet to a point of tangency; thence North 32 degrees 39 minutes West 770.56 feet to a point of curve; thence northwestwardly 87.74 feet along a curve to the right having a radius of 250 feet to a point; thence northwardly 146 feet, more or less, to the centerline of an existing culvert under U.S. Highway I-270, the point of termination of the herein described strip of land. NORTHGATE LATERAL CHANNEL A strip of land varying width the centerline thereof being more particularly described as follows: The center line of a 110 foot wide strip of land described as beginning at a point in the centerline of Watkins Creek Main Channel, known as Station 171+84.92 said point also being a point of curve; thence northwestwardly 219.91 feet along a curve to the right having a radius of 300 feet to a point of tangency; thence North 10 degrees 16-3/4 minutes West 180.09 feet along the centerline of a symmetrical transition from a 110 foot width to a 6 width of 100 feet; thence continuing North 10 degrees 16-3/4 minutes West 459.54 feet along the centerline of said 100 foot wide strip of land to a point of curve; thence northeastwardly 659.73 feet along a curve to the right having a radius of 2000 feet to a point of tangency; thence northwardly 255.95 feet to a point in the northern line of Claudine Drive, said point being the centerline of an existing culvert; thence continuing northwardly thru the existing Right-of-Way as established in Northgate Estates No. 6, recorded in Plat Book 95, page 45, St. Louis County Recorder's office, to termination. Section Three. Such building lines are the limits of floodway reservations. No buildings or part of a building or appurtenance thereof or any structure shall be set up or erected within such reservations. Section Four. Except by permission of the Board pursuant to ordinance, no fill shall be made within such reservations which may diminish the area of flow or otherwise obstruct in any way the free flow of flood waters in such reservations nor without such permission shall any dams, walls, or other watertight or practically watertight structures be constructed or placed within such reservations. Section Five. District maintenance and supervisory personnel and other authorized agents of the Board shall have the right to enter upon the lands hereby reserved and to clean, police, and otherwise maintain the channel and banks of the streams or watercourse described herein, so that the natural and healthful flow of the stream may be maintained at all times. Section Six. It shall be unlawful for any person to deposit, dump, or otherwise dispose of, within the building lines hereby established, any sewage, garbage, rubbish, industrial wastes, loose material, oils, or other soluble or insoluble solid 7 or liquid matter, which may pollute the streams or subsequently be washed away or carried downstream or which may leave unhealthful or unsightly traces either in the bed of the stream or on the banks thereof. The Executive Director may by written order require any person who shall have violated any of the provisions of this section to remove any or all material such person may have deposited or otherwise disposed of within such lines. In case of the failure of the owner of any land within such lines to remove any such material upon such order, the Executive Director shall order such material removed at the expense of such owner, and, if the owner shall fail to pay the cost of such work, the District may file a lien for the amount thereof against the property with the Recorder of Deeds of either the City of St. Louis or of St. Louis County, as the case may be. Section Seven. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than One Hundred Dollars ($100.00) nor more than One Thousand Dollars ($1,000.00) or be imprisoned in the city workhouse or the county jail, as the case may be, not less than ten (10) days nor more than One Hundred Eighty (180) days, or by both such fine and imprisonment for each violation. Each day in which any such violation shall continue shall be deemed a separate offense. 8 The foregoing Ordinance was adopted September 26, 1968.
