HomeMy Public PortalAbout01846 O R D I N A N C E NO. 1846 AN ORDINANCE authorizing and directing the Executive Director to grant to St. Louis County, Missouri, a political subdivision of the State of Missouri, the right to cross certain sewer Rights of Way in St. Louis County, Missouri, as hereinafter described, with a limited access highway, and to execute an instrument giving effect thereto upon the conditions hereinafter set out. WHEREAS, pursuant to the Plan of The Metropolitan St. Louis Sewer District and by Resolution No. 6 of the District, adopted July 1, 1954 and recorded in Book 3286, page 90 of the St. Louis County Records, the District took title for its use and possession to all public easements for sewer and drainage purposes within its area, including those in the County of St. Louis; and WHEREAS, St. Louis County wishes to cross certain Rights of Way and sewers of this District with a highway, now known as the Innerbelt Expressway between Eager Road and Page Avenue, and WHEREAS, St. Louis County has requested the District grant the right to so use such Rights of Way, and the District is willing so to do; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to St. Louis County, Missouri, the right to construct, reconstruct, repair and maintain a highway across the 2 following described Rights of Way according to plans approved by District's Engineering Department and as hereinafter set forth, subject however, to the following terms and reservations: The Metropolitan St. Louis Sewer District reserves the right to the use of such Rights of Way for sewer and drainage purposes, including the right to construct new sewers and appurtenances therein and to use, maintain, and reconstruct the new and existing sewers and appurtenances therein, but releases all rights of access between its adjacent easements and said highway except from any easement, roadway, or other means of access outside such highway right-of-way. Those portions of Rights of Way which are involved in this grant are set forth as follows: 3 Parcel #1 An easement ten feet wide in the rear of lots 1, 2, 3, 4, 14, and 15 in Block 1 of the subdivision of Sheridan Hills, recorded in plat book 48, page 46 and 47 of the St. Louis County records. Parcel #2 An easement five feet wi across the Southeastern corner of lot B in the subdivision of Darstmoor as reserved in an instrument recorded in Book 589, Page 466 of the St. Louis County records. Parcel #3 An easement ten feet wide across Inner Belt Expressway, South of Clayton Road in the City of Richmond Heights, as granted by an instrument recorded in Book 1795, Page 514 of the St. Louis County records. Parcel #4 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between the northern line of Clayton Road and a line 100 feet northwardly thereof measured along the center line of the Expressway. Parcel #5 An easement ten feet wide across Inner Expressway at a line approximately 335 feet Northwardly of Brentwood Boulevard, as granted by an instrument recorded in Book 1313, Page 226 of the St. Louis County Records. Parcel #6 An easement ten feet wide across Inner Belt Expressway approximately 1330 feet Northwardly of Brentwood Boulevard as granted by an instrument recorded in Book 1313, Page 226 of the St. Louis County records. Parcel #7 An easement to build and maintain a sewer across a portion of Inner Belt Expressway approximately 785 feet Southwardly of Ladue Road, as granted by an instrument recorded in Book 1434, Page 444, of the St. Louis County records. Parcel #8 That portion of District's rights lying between and connecting parcel numbers 7 and 9. Parcel #9 An easement to build and maintain a sewer across a portion of Inner Belt Expressway, approximately 785 feet Southwardly of Ladue Road along a strip of land ten feet wide, as granted by instrument recorded in Book 1401, Page 632 of the St. Louis County records. Parcel #10 An easement to build and maintain a sewer along and within Inner Belt Expressway in lot 5 of the subdivision of West Clayton, on a strip of land ten feet wide, extending from the Southern line of Ladue Road to the Southeastern corner of said 4 lot 5, as granted by an instrument recorded in Book 1419, Page 638 of the St. Louis County records. Parcel #11 An easement twenty-five feet wide across lots 5 and 6 of the subdivision of West Clayton lying Eastwardly of and contiguous with the Eastern line of the Subdivision of Ladue-Pointer, as granted by an instrument recorded in Book 2403, Page 379 of the St. Louis County records. Parcel #12 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between the southern line of Ladue Road and a line 150 feet southwardly thereof measured along the center line of the Expressway. Parcel #13 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between the northern line of Ladue Road and a line 220 feet northwardly thereof measured along the center line of the Expressway. Parcel #14 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between the northern line of Ladue Road and a line 220 feet northwardly thereof measured along the center line of the Expressway. Parcel #15 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between a line 1,000 feet northwardly of a centerline of Ladue Road and a line 1,300 feet northwardly of the center line of Ladue Road measured along the center line of the Inner Belt Expressway. Parcel #16 An easement to build and maintain a sewer along and within and across a portion of Inner Belt Expressway, on strip of land ten feet wide, located between lines approximately 800 feet and 1030 feet respectively Southwardly of Delmar Boulevard, as granted by an instrument recorded in Book 2123, Page 504 of the St. Louis County records. Parcel #17 An easement to build and maintain a sewer across a portion of Inner Belt Expressway approximately 800 feet Southwardly of Delmar Boulevard, along a strip of land ten feet wide, as granted by an instrument recorded in Book 2133, Page 334 of the St. Louis County Records. Parcel #18 That portion of District's rights situated on a parcel of land described as follows: All that part of the Inner Belt 5 Expressway lying between a line 700 feet northwardly of the center line of Delmar Boulevard and a line 800 feet northwardly of the center line of Delmar Boulevard measured along the center line of Inner Belt Expressway. Parcel #19 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between a line 1,200 feet northwardly of the center line of Delmar Boulevard and a line 1,300 feet northwardly of the center line of Delmar Boulevard measured along the center line of Inner Belt Expressway. Parcel #20 That portion of District's rights situated on a parcel of land described as follows: All that part of Inner Belt Expressway lying between a line 1,550 feet southwardly of the center line of Olive Boulevard and a line 1,600 feet southwardly of the center line of Olive Boulevard measured along the center line of Inner Belt Expressway. Parcel #21 A sewer and drainage easement, ten feet wide, diagonally across a strip of land one hundred and fifty feet wide, within and along Inner Belt Expressway which easement intersects the Eastern line of said strip at a point 275 feet South of Olive Street Road and runs thence Southwestwardly to the western line of said strip, as granted by an instrument recorded in book 1406, page 35 of the St. Louis County records. Parcel #22 A sewer and drainage easement, ten feet wide, diagonally across a strip of land one hundred and fifty feet wide within and along Inner Belt Expressway which easement intersects the Western line of said strip at a point 110 feet South of Olive Street Road, and the eastern line of said strip at a point 275 feet South of Olive Streets Road, as granted by an instrument recorded in book 1406, page 35 of the St. Louis County records. Parcel #23 An easement ten feet wide in lot 20 of Charles Gier Estate extending approximately 30 feet into the Northwestern part of Inner Belt Expressway, as granted by an instrument recorded in book 5669, page 174 of the St. Louis County Records. Parcel #24 That portion of District's rights situated on a parcel of land particularly described as follows: All that part of Inner Belt Expressway lying between 390 feet southwestwardly of the center line of Woodson Road and a line 620 feet southwestwardly of the center line of Woodson Road measured along the center line of the Expressway. Parcel #25 An easement ten feet wide, the center line of which 6 begins 24.00 feet Southwardly of the Southern line of Page Avenue (80.00 feet wide) on a line 500.00 feet Eastwardly of the center line of Harney Road; thence Northeastwardly to the Southern line of Page Avenue, as granted by an instrument recorded in book 2948-306 of the St. Louis County records. Section Two. St. Louis County will, if considered reasonably necessary by District's engineers, protect the existing sewers and appurtenances at its cost, or, if necessary to reconstruct, relocate, or repair because of such highway use, such work will be done at the cost of St. Louis County, on those portions of District's facilities located previously on private right-of-way belonging to the District and located on highway right-of-way, within the following limits: 100% REIMBURSABLE Location #1 - That portion of District's facilities extending from approximately 112 feet right of center line Station 184+17 to approximately 114 feet left of center line Station 184+17. 100% REIMBURSABLE Location #2 - That portion of District's facilities extending from approximate]y 75 feet right of center line Station 209+33 to approximately 90 feet left of center line Station 208+93 to approximately 87 feet left of center line Station 208+75. 100% REIMBURSABLE Location #3 - That portion of District's facilities beginning at the Northern line of Clayton Road approximately 75 feet Eastwardly of the center line of Inner Belt Expressway, measured along the said Northern line of Clayton Road; thence Northwardly a distance of approximately 70 feet; thence Eastwardly a distance of approximately 17 feet to the Eastern line of Inner Belt Expressway. 100% REIMBURSABLE 7 Location #4 - That portion of District's facilities extending from approximately 143 feet left of center line Station 223+62 to approximately 60 feet right of center line Station 223+62. 100% REIMBURSABLE Location_#5 - That portion of District's facilities extending from approximately 123 feet left of center line station 236+55 to approximately 85 feet right of center line Station 236+55. 100% REIMBURSABLE Location #6 - That portion of District's facilities extending from approximately 96 feet left of center line Station 265+42 to approximately 150 feet right of center line Station 265+42. 59% REIMBURSABLE Location #7 - That portion of District's facilities extending from approximately 210 feet left of center line Station 268+85 to approximately 125 feet left of center line Station 270+40 to approximately 140 feet left of center line on the South line of Ladue Road. 92% REIMBURSABLE Location #8 - That portion of District's facilities extending from the center line of Inner Belt Expressway at a point approximately 15 feet South of the Southern line of Ladue Road to approximately 137 feet left of center line Station 272+42 to approximately 360 feet left of center line Station 273+10. 100% REIMBURSABLE Location #9 - That portion of District's facilities extending from approximately 390 feet left of center line Station 273+62 to approximately 375 feet left of center line measured along South line of Ladue Road. 100% REIMBURSABLE Location #10 - That portion of District's facilities extending from approximately 120 feet left of center line Station 275+40 to approximately 60 feet left of center line Station 275+40. 100% REIMBURSABLE Location #11 - That portion of District's facilities extending 8 from approximately 116 feet left of center line Station 275+80 to approximately 62 feet right of center line Station 275+92. 100% REIMBURSABLE Location #12 That portion of District's facilities extending from approximately 65 feet left of center line Station No. 284+52 to approximately 75 feet right of center line Station No. 284+95. 100% REIMBURSABLE Location #13 - That portion of District's facilities extending from approximately 60 feet right of center line Station 290+85 to approximately 60 feet right of center line Station 293+20, thence to approximately 145 feet right of center line Station 293+30. 100% REIMBURSABLE Location #14 - That portion of District's facilities extending from approximately 85 feet right of center line Station 310+36 to approximately 85 feet left of center line Station 310+36. 100% REIMBURSABLE Location #15 - That portion of District's facilities extending from approximately 72 feet left of center line Station 315+15 to approximately 30 feet right of center line Station 315+55. 100% REIMBURSABLE Location #16 - That portion of District's facilities extending from approximately 97 feet left of center line Section 337+54 to approximately 118 feet right of center line Station 338+00. 100% REIMBURSABLE Location #17 - A sewer and drainage easement, ten feet wide, diagonally across a strip of land one hundred and fifty feet wide, within and along Inner Belt Expressway which easement intersects the Eastern line of said strip at a point 275 feet South of Olive Street Road and runs thence Southwestwardly to the Western line of said strip, as granted by an instrument recorded in book 1406, page 35 of the St. Louis County records. 100% REIMBURSABLE Location #18 - A sewer and drainage easement, ten feet wide, diagonally across a strip of land one hundred and fifty feet wide within and along Inner Belt Expressway which easement intersects 9 the Western line of said strip at a point 110 feet South of Olive Street Road, and the eastern line of said strip at a point 275 feet South of Olive Street Road, as granted by an instrument recorded in book 1406, page 35 of the St. Louis County records. 100% REIMBURSABLE Location #19 - That portion of District's facilities extending from approximately 85 feet right of center line Station 376+00 to approximately 113 feet left of center line Station 378+25. 100% REIMBURSABLE Location #20 - That portion of District's facilities extending from approximately 270 feet left of center line Station 404+32 to approximately 245 left of center line on the South line of Page Avenue. Section Three. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Sections One and Two hereof. 10 The foregoing Ordinance was adopted February 6, 1969.
