AN ORDINANCE authorizing and directing the Executive Director
to grant to the State of Missouri, for the use of the State
Highway Commission of Missouri, the right to cross certain sewer
Rights of Way in the City of St. Louis, Missouri, as hereinafter
described, with a limited access highway, and to execute an
instrument giving effect thereto upon the conditions hereinafter
set out.
WHEREAS, pursuant to the Plan of The Metropolitan St. Louis
Sewer District and by Resolution No. 6 of the District, adopted
July 1, 1954, the District took title for its use and possession
to all public easements for sewer and drainage purposes within its
area, including those in the City of St. Louis; and
WHEREAS, the State Highway Commission of the State of
Missouri wishes to cross certain Rights of Way and sewers of this
District with a highway, now known as Interstate Route 44 in the
City of St. Louis between Smiley Avenue and January Avenue, and
WHEREAS, the State Highway Commission of the State of
Missouri has requested the District grant the right to so use such
Rights of Way, and the District is willing so to do;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF
THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District does
hereby grant to the State of Missouri, for the use of the State
Highway Commission, the right to construct, reconstruct, repair
and maintain a highway across the following described Rights of

Way according to plans approved by District's Engineering
Department and as hereinafter set forth, subject however,to the
following terms and reservations:
The Metropolitan St. Louis Sewer District reserves the right
to the use of such Rights of Way for sewer and drainage purposes,
including the right to construct new sewers and appurtenances
therein and to use, maintain and reconstruct the new and existing
sewers and appurtenances therein, but releases all rights of
access between its adjacent easements and said highway except from
any easement, roadway or other means of access outside such
highway right-of-way.
Those portions of Rights of Way which are involved in this
grant are set forth as follows
Parcel No. 1: A parcel of land in Lot "H" of Buchanan's Subdivision and in Out Lot 95 of the City of St. Louis, Missouri, and described as beginning at a point on the Northwestern line of Ivanhoe Avenue, said point being 671.27 feet Northeast along said Northwestern line from the most Eastern corner of a one (1) acre tract of land conveyed to George E. Thomas and wife by deed recorded in Book 4975, page 124 of the St. Louis City Records; thence Northeast along said Northwestern line of Ivanhoe Avenue produced Northeastwardly a distance of 465 feet to a point on the Southwestern line of a tract of land now or formerly of Fruin-Colnon Contracting Company; thence Northwest along said Southwest line of Fruin=Colnon tract a distance of 75 feet to a point; thence Southwestwardly a distance of 472.70 feet to a point, said point being on a line parallel to and 671.27 feet Northeast of the Northeastern line of said Thomas tract; thence Southeast along said parallel line a distance of 160 feet to the point of beginning. Parcel No. 2: A parcel of land in Out Lot 95 of the City of St. Louis, Missouri, being part of Lot 'IN" of Buchanan's Subdivision and described as beginning at the intersection of the North line of said Lot "H" with the West line of Clifton

Hills Addition; thence Southwardly along the West line of Clifton Hills Addition 483.17 feet to the North line of Clifton Hills; thence Westwardly along the North line of Clifton Hills 723.50 feet to the Northeast corner of Lot #1 of said Clifton Hills; thence Northwestwardly along the Northeast line of said Lot #1 a distance of 55.10 feet to the Southeast line of Ivanhoe Avenue; thence Northeastwardly along the Southeast line of Ivanhoe Avenue 89.04 feet to the Northeastern terminus of said Ivanhoe Avenue; thence Northwestwardly along the Northeastern terminus of Ivanhoe Avenue 50 feet to the Southeast line of property conveyed to the Southwest Realty Company by deed recorded in Book 7286, page 383 of the St. Louis City Records; thence Northeastwardly along the Southeastern line of property conveyed to Southwest Realty Company, as aforesaid, 465 feet more or less, to the Southwest line of property conveyed to Fruin-Colnon Contracting Company by deed recorded in Book 6129, page 368 of the St.Louis City Records; thence Southeastwardly along the Southwest line of property conveyed to Fruin-Colnon Contracting Company, as aforesaid, 100 feet to the most Southerly corner thereof; thence Northeastwardly along the Southeast line of property conveyed to Fruin-Colnon Contracting Company, as aforesaid, 387.69 feet to the North line of said Lot "H" of Buchanan's Subdivision; thence Eastwardly along the North line of said Lot "H" a distance of 55.83 feet to the point of beginning. Parcel No. 3: A parcel of land in part of Lot 28 of Clifton Hills Addition and in Block #6419 of the City of St. Louis, Missouri, and described as beginning at the Northwest corner of said Lot 28 and running thence Easterly along the North line of said Lot 28, a distance of 127.63 feet to the Northeast corner thereof; thence Southerly along the East line of said Lot 28, a distance of 20.98 feet to a point; thence Southwesterly to a point in the South line of said Lot 28, said point being 67 feet West of the Southeast corner thereof as measured along said South line of said Lot 28; thence Westerly along said South line of said Lot 28, a distance of 82.75 feet to the Southwest corner thereof; thence Northerly along the West line of said Lot 28 a distance of 45 feet to the point of beginning. Parcel No .4; A parcel of land being all of Lot 29 of Clifton Hills Addition and in Block #6419 of the City of St. Louis, Missouri, and fronting 33.74 feet on the West line of Tamm Avenue, by a depth of 139.23 feet on the North line and 127.63 feet on the South line to the West line of said lot on which there is a width of 79.84 feet. Parcel No. 5: A parcel of land in City Block #4636-N of the City of St. Louis, Missouri, in Lot 12 of D. W. Grahm's

Subdivision and in a tract of land conveyed to The Metropolitan St. Louis Sewer District by deed recorded in Book 8053, page 32 of the St. Louis City Records and described as beginning at the most Northern corner of said Sewer District Tract and running thence South 8 degrees 30 minutes West along the Eastern line of Hampton Avenue, a distance of 115.85 feet to a point; thence South 78 degrees 56 minutes 04 seconds East, a distance of 223.40 feet to the most Western corner of a tract of land conveyed to the State of Missouri by deed recorded in Book 8357, page 51 of the St. Louis City Records; thence along the South line of said State of Missouri tract South 81 degrees 30 minutes East, 402.50 feet to the most Southern corner of said State of Missouri tract; thence continuing South 81 degrees 30 minutes East to a point in the most Western line of a tract of land conveyed to the City of St. Louis by deed recorded in Book 8787, page 167 of the St. Louis City Records; thence North 12 degrees 10 minutes East along the said West line of the City of St. Louis tract, a distance of 90 feet; thence Northwesterly to a point in the Southeast line of said tract conveyed to the State of Missouri, said point being distant 100 feet Northeast along said Southeast line from the most Southern corner of said tract conveyed to the State of Missouri; thence Northwesterly to an angle point of the North line of said State of Missouri tract; thence North 85 degrees 01 minutes 07 seconds West, 213.13 feet to the most Eastern corner of said Metropolitan Sewer District tract; thence along the Northeast line of said Metropolitan Sewer District tract North 63 degrees 43 minutes 30 seconds West, 207.56 feet to the point of beginning.
Section Two. The State Highway Commission will, if
considered reasonably necessary by District's engineers, protect
the existing sewers and appurtenances at its cost, or, if
necessary to reconstruct, relocate or repair because of such
highway use, such work will be done at the cost of the State
Highway Commission, on those portions of District's facilities
located previously on private right-of-way belonging to the
District and located on highway right-of-way, within the following
limits:

100 0/0 REIMBURSABLE: Location #1: From approximately 170 feet left of centerline station 1446+90 to approximately 320 feet right of centerline Station 1447+80 and crossing the centerline of Interstate 44 at Station 1447+23. Location #2: From approximately 125 feet right of centerline Station 1447+48 to approximately 130 feet right of centerline Station 1449+24 to approximately 210 feet right of centerline Station 1451+27. Location #3: From approximately 35 feet right of centerline Station 3+22, Outer Roadway 11-B to approximately centerline Station 4+72, Outer Roadway 11-B, to approximately 45 feet left of centerline Station 5+32, Outer Roadway 11--B.
Section Three. The Executive Director is hereby authorized
and directed to execute in behalf of the District an instrument
giving effect to Sections One and Two hereof.
The foregoing Ordinance was adopted June 26, 1969
