AN ORDINANCE authorizing and directing the Executive
Director to grant to Laclede Gas Company an easement for a high
pressure propane line and appurtenances across certain property of
the District in St. Louis County, Missouri, and to execute an
instrument giving effect thereto upon the conditions hereinafter
set out.
WHEREAS, Laclede Gas Company wishes to relocate a high
pressure propane line and appurtenances across certain property of
this District to permit the District to construct a line serving
the south portion of its boundary and carrying the sewage to the
Lemay Treatment Plant, and the District is desirous of such
construction;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
does hereby grant to the Laclede Gas Company the right to
construct, reconstruct, repair and maintain a high pressure
propane line and appurtenances, across property owned by the
District in St. Louis County, Missouri, such property and easement
being described as follows: An easement ten (10) feet wide lying in property of The Metropolitan St. Louis Sewer District in Part of U 5 Survey 904, Township 44 North, Range 7 East, and partly in Carondelet Commons, also being part of Allen's Subdivision in the Chouquette Tract as described in General Warranty Deed and as recorded in Book 6305, Page 1288 of the St. Louis County Records, the southern, western and northern lines of said easement are described as follows:
Beginning at a point in the centerline of vacated Van Buren Street at its intersection with the northern line of now, or formerly, Columbian Carbon Company; thence, North 37 degrees 51 minutes 30 seconds West 70 feet to a point in the said northern line of Columbian Carbon tract; thence, North 21 degrees 21 minutes East on a line 65 feet West of and parallel to the centerline of vacated Van Buren Street to a point; thence 90 feet, more or less, northeastwardly to a point of termination in the centerline of said vacated Van Buren Street. All as shown on the attached plat.
Section Two. Upon the removal of such gas lines and
appurtenances, or upon termination of such service, the said
easement shall cease and determine.
Section Three. The Executive Director is hereby authorized
and directed to execute in behalf of the District an instrument
giving effect to Sections One and Two hereof.
