AN ORDINANCE authorizing and directing the Executive
Director to grant to St. Louis County Water Company an easement
for water pipe lines and appurtenances across certain property of
the District in St. Louis County, Missouri, and to execute an
instrument giving effect thereto upon the conditions hereinafter
set out.
WHEREAS, St. Louis County Water Company wishes to cross
certain property now of this District with water lines and
appurtenances, for the purpose of the circulation and distribution
of water,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer District
does hereby grant to the St. Louis County Water Company the right
to construct, reconstruct, repair and maintain water lines, and
appurtenances, across property owned by the District in St. Louis
County, Missouri, such property and easement being described as
follows:
An easement ten (10) feet wide in real property of The
Metropolitan St. Louis Sewer District situated partly in U.
S. Survey 904, Township 44 North, Range 7 East, and partly in
Carondelet Commons, St. Louis County, Missouri, also being
part of Allen's Subdivision in the Chouquette Tract as
recorded in Book 3, Page 60 of the St. Louis County Records,
the title to which property was acquired by deed recorded in
Book 6305, page 1288 of the St. Louis County Records, said
easement strip being the Northwest 10 feet of the Southwest
1555 feet of the above described tract of land and lying
immediately Southeast of and adjacent to Broadway.
Section Two. Upon the removal or abandonment of such
water lines and appurtenances, the said easement shall cease and
determine.
Section Three. The Executive Director is hereby
authorized and directed to execute in behalf of the District an
instrument giving effect to Sections One and Two hereof.
The foregoing Ordinance was adopted September 11, 1969.
