HomeMy Public PortalAbout02003 O R D I N A N C E NO. 2003 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County, Missouri known as Meacham Park Trunk and Lateral Sewer Subdistrict wherein there live and work numerous people; and WHEREAS, sanitary sewage gathered from such area has and will have no alternative means of disposition to crossing said property and does and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing sanitary sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, an easement for the use of a sewer line as hereinafter set forth, together with temporary easements adjacent to the right-of-way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: A permanent easement 10 feet wide over property now or formerly of Kirkwood-Easton Tire Co., Inc., which easement is more particularly described as follows: A strip of land 10 feet wide by 100 feet long in Block 4 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 10 feet wide strip consists of the eastern 5 feet of Lot 15 and the western 5 feet of Lot 15 of said Block 4 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Edward Maxwell, which easement is particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 4 of 3 Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the western 5 feet of Lot 41 of said Block 4 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the east side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Matthew Moses, which easement is more particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 4 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the eastern 5 feet of Lot 42 of said Block 4 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. 4 A permanent easement 10 feet wide over property now or formerly of Frank Spears and Florence Spears, his wife, which easement is more particularly described as follows: A strip of land 10 feet wide by 100 feet long in Block 17 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 10 feet wide strip consists of the eastern 5 feet of Lot 7 and the western 5 feet of Lot 8 of said Block 17 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Aurelia J. Seise, which easement is more particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 17 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the eastern 5 feet of Lot 48 of said Block 17 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall 5 cease, which temporary easement is described as a strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of E. L. Fantroy and Dora Fantroy, his wife, which easement is more particularly described as follows: A strip of land 5 feet wide by 10 feet long in Block 20 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of the eastern 10 feet of Lot 31 of said Block 20 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as the northernmost 25 feet of said Lot 31. A permanent easement 5 feet wide over property now or formerly of Grace Kyle, which easement is more particularly described as follows: A strip of land 5 feet wide by 10 feet long in Block 23 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the eastern 10 feet of the southern 5 feet of Lot 4 of said Block 6 23 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as the southernmost 25 feet of said Lot 4. A permanent easement 5 feet wide over property now or formerly of Catherine Lucas, which easement is more particularly described as follows: A strip of land 5 feet wide by 25 feet long in Block 23 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the southern 5 feet of Lot 12 of said Block 23 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the north side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Oliver D. Moorer and Lizzie Moorer, his wife and Curtis Moorer, which easement is more particularly described as follows: Strips of land 5 feet wide by 100 feet long, and 5 feet wide by 50 feet long in Block 23 of Meacham Park, a subdivision in 7 St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strips consist of the southern 5 feet of Lots 15, 16, 17 and 18, and the northern 5 feet of Lots 33 and 34, respectively, of said Block 23 of Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as the southernmost 25 feet of said Lots 15, 16, 17 and 18, and the northernmost 25 feet of said Lots 33 and 34. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as the northernmost 25 feet of said Lot 29 and all of said Lot 30. A permanent easement 5 feet wide over property now or formerly of 8 Lucy Woods Brown, a Life Est., Rem. to Lincoln Woods, his heirs and assigns, which easement is more particularly described as follows: A strip of land 5 feet wide by 150 feet long in Block 23 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet and the western 5 feet of Lot 31, and the northern 5 feet of Lot 32 of said Block 23 of Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of condemnor shall cease, which temporary easements are described as the northernmost 25 feet of said Lot 32 and all of said Lot 31. A permanent easement 5 feet wide over property now or formerly of Roy E. Pryor and Evelyn A. Pryor, his wife, which easement is more particularly described as follows: A strip of land 5 feet wide by 20 feet long in Block 23 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of the western 15 feet of Lot 44, and the northern 5 feet of the eastern 10 feet of Lot 45 of said Block 23 of Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor will 9 cease, which temporary easements are described as the northernmost 25 feet of the western 15 feet of said Lot 44 and the northernmost 25 feet of said Lot 45. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Laura Moye and Henry Lee Moye, as Joint Tenants, which easement is more particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 24 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the 10 eastern 5 feet of Lot 31 of said Block 24 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Jodie Thompson and Odessa Thompson, his wife, which easement is more particularly described as follows: A strip of land 5 feet wide by 50 feet long in Block 31 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the southern 5 feet of Lots 6 and 7 of said Block 31 of Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on the north side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 10 feet wide over property now or formerly of Tobie Hemphill and Eva Hemphill, his wife, which easement is 11 more particularly described as follows: A strip of land 10 feet wide by 100 feet long in Block 31 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 10 feet wide strip consists of the western 10 feet of Lot 11 of said Block 31 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on the east side of, and immediately adjacent to, the hereinabove described 10 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of George C. Mackay, which easement is more particularly described as follows: A strip of land 5 feet wide by 35 feet long in Block 31 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of the western 10 feet of Lot 38, and the northern 5 feet of Lot 39 of said Block 31 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as the northernmost 25 feet of the western 10 feet of said Lot 38 12 and the northernmost 25 feet of said Lot 39. A permanent easement 5 feet wide over property now or formerly of The Christian Redemption Spiritualist Temples Association, a Corporation, which easement is more particularly described as follows: A strip of land 5 feet wide by 50 feet long in Block 31 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of Lots 42 and 43 of said Block 31 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as the northernmost 25 feet of said Lots 42 and 43. A permanent easement 5 feet wide over property now or formerly of Ephraim Block, which easement is more particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 36 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the western 5 feet of Lot 24 of said Block 36 in Meacham Park. Temporary easement during original construction of sewer 13 facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the east side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Will Evans and Georgia A. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as a strip of land 20 feet in width on the east side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which easements are described as the southernmost 25 16 feet of said Lot 18. A permanent easement 5 feet wide over property now or formerly of Arveler Carpenter, which easement is more particularly described as follows: A strip of land 5 feet wide by 50 feet long in Block 42 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the southern 5 feet of Lots 19 and 20 of said Block 42 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as strips of land 20 feet in width on the north side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. A permanent easement 5 feet wide over property now or formerly of Armita Pondeter, which easement is more particularly described as follows: A strip of land 5 feet wide by 10 feet long in Block 42 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the southern 5 feet of the western 10 feet of Lot 21 of said 17 Block 42 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as the southernmost 25 feet of said Lot 21. A permanent easement 5 feet wide over property now or formerly of Fred Gholston and Viola Gholston, his wife, which easement is more particularly described as follows: A strip of land 5 feet wide by 10 feet long in Block 42 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of the western 5 feet of Lot 24 of said Block 42 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as the northernmost 25 feet of said Lot 24. A permanent easement 5 feet wide over property now or formerly of Mrs. Emma Osterman, which easement is more particularly described as follows: A strip of land 5 feet wide by 150 feet long in Block 42 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County 18 Recorder's Office, which 5 feet wide strip consists of the northern 5 feet of Lot 25, and the northern 5 feet and the western 5 feet of Lot 26 of said Block 42 in Meacham Park. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as the northernmost 25 feet of said Lot 25 and all of said Lot 26. A permanent easement 5 feet wide over property now or formerly of Minnie Reinke, which easement is more particularly described as follows: A strip of land 5 feet wide by 100 feet long in Block 42 of Meacham Park, a subdivision in St. Louis County, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County Recorder's Office, which 5 feet wide strip consists of the eastern 5 feet of Lot 27 of said Block 42 in Meacham Park. Temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as strip of land 20 feet in width on the west side of, and immediately adjacent to, the hereinabove described 5 feet wide permanent easement. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase, if possible, subject to approval of the Board of Trustees, or to institute and prosecute an action in condemnation, as authorized 19 by law, if necessary, to appropriate and acquire the aforesaid private property. The foregoing Ordinance was adopted February 19, 1970.
