AN ORDINANCE, vacating portions of two sewer easements,
together with an unused sewer in one of them, in the City of
Richmond Heights, St. Louis County, Missouri.
WHEREAS, The Metropolitan St. Louis Sewer District
holds title to a certain sewer easement granted to the City of
Richmond Heights by deed recorded July 7, 1942 in Book 1855, Page
440 of the St. Louis County Records and the owner of the subject
property has requested this District to vacate a portion of the
subject easement together with the unused sewer situated therein
and this District has no further need of them, and
WHEREAS, a sewer easement was granted for the use and
benefit of the owners of certain tracts of land by deed recorded
in Book 5192, Page 274 of the St. Louis County Records and the
owner of the subject property has requested this District to
vacate any right, title or interest that it may have in a portion
of the subject easement and this District has no need of such
portion,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. Hereby vacated are the sewer easement
and the unused sewer therein in the following described easement:
The sewer easement ten (10) feet wide granted by deed
recorded in Book 1855, Page 440 of the Records of St. Louis
County, Missouri, in land situated in Lot 15 of Horner's Addition
to Fenton Heights, a subdivision of St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 1, Page 57 of
the St. Louis County Records, excepting from such vacation that
portion of subject easement coincident with the sewer easement
granted to The Metropolitan St. Louis Sewer District by deed
recorded in Book 6382, Page 1033 of the St. Louis County Records.
Section Two. Hereby vacated is any right, title or
interest the District may have in the following described
easement:
The sewer easement designated as Easement No. 3 in deed
recorded in Book 5192, Page 274 of the Records of St. Louis
County, Missouri, in land situated in Lots 14 and 15 of Horner's
Addition to Benton Heights, a subdivision of St. Louis County,
Missouri, according to the plat thereof recorded in Plat Book 1,
Page 57 of the St. Louis County Records, excepting from such
vacation the north ten (10) feet of said sewer easement.
