AN ORDINANCE to extend the boundaries of The
Metropolitan St. Louis Sewer District and of the Coldwater Creek
Trunk Subdistrict to include an area of St. Louis County which
could be efficiently served by the sewer facilities of the
District and of the Coldwater Creek Trunk Subdistrict.
WHEREAS, a petition to the Board of Trustees of The
Metropolitan St. Louis Sewer District has been received from the
owner of all the land in said area, praying for annexation to both
the District and the Coldwater Creek Trunk Subdistrict of The
Metropolitan St. Louis Sewer District; and
WHEREAS, this area adjoins The Metropolitan St. Louis
Sewer District and such Coldwater Creek Trunk Subdistrict and the
existing sewers of the District and Subdistrict are adequate to
handle all of its sanitary sewage, that the interests of
sanitation and public health of the District will be promoted by
including the area in its territory; and that the sewage flow from
the area proposed to be annexed has no available outlet through
public sanitary sewers other than those of the District,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. That the Board finds that the sewer
facilities of the District can efficiently serve the area
described as follows:
Beginning at westernmost corner of Flamingo Park Plat
16, a subdivision of St. Louis County, Missouri, according to the
plat thereof recorded in Plat Book 124, Page 20 of the St. Louis
County Records, which corner is also a point on the existing
boundary of The Metropolitan St. Louis Sewer District as extended
by Ordinance 1660, adopted October 2, 1967; thence northeastwardly
along the northwestern boundary of such subdivision, to the
northernmost corner thereof, which subdivision boundary is a part
of such existing Metropolitan St. Louis Sewer District boundary;
thence North 52 degrees 36 minutes West a distance of 2570.62 feet
to a point; thence South 36 degrees 58 minutes West 1007.39 feet
to a point; thence South 53 degrees 02 minutes East 224.24 feet to
a point; thence South 36 degrees 12 minutes West 593.0 feet to a
point, which point is also on the northeastern line of a road 40
feet wide; thence southeastwardly, along such northeastern line of
road, to its intersection with the northeastern line of Charbonier
Road (60 feet wide); thence southeastwardly, along such
northeastern line of Charbonier Road a distance of approximately
400 feet, to the southern corner of property now or formerly of
Lester Adams, according to instrument recorded in Book 5813, Page
238 of the St. Louis County Records; thence North 39 degrees 28
minutes East a distance of 175.02 feet to a point; thence South 58
degrees 32 minutes East 266.63 feet to a point; thence South 53
degrees 03 minutes East 472.73 feet to a point on the southeastern
line of Lot 1, Charbonier Acres, a subdivision of St. Louis
County, Missouri, according to the plat thereof recorded in Plat
Book 43, Page 36 of the St. Louis County Records; thence
northeastwardly along such southeastern lot line to the eastern
corner of such Lot 1; thence southeastwardly along the
northeasterly line of such Charbonier Acres Subdivision a distance
of approximately 1003 feet to the point of beginning.
Section Two. That the petition praying for annexation
was signed by the owner of all the land in said area.
Section Three. That the interests of sanitation and
public health of the District will be promoted by including the
area in its territory.
Section Four. That the sewage flow from the area
proposed to be annexed has no available outlet through public
sanitary sewers other than those of the District.
Section Five. The corporate boundaries of The
Metropolitan St. Louis Sewer District and the Coldwater Creek
Trunk Subdistrict are hereby extended so as to include the above
described area.
Section Six. Certified copies of this Ordinance shall
be filed in the offices of the Recorder of Deeds of St. Louis
County, the Recorder of Deeds of the City of St. Louis, and the
Secretary of State. The foregoing Ordinance was adopted April 23, 1970.
