AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, FOR CERTAIN PROPERTY KNOWN AS PRAIRIE WEST
TRAIL, TIFFIN, JOHNSON COUNTY, IOWA, AND AS LEGALLY
DESCRIBED HEREIN.
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:
Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, concerning property locally
described as Prairie West Trail, Tiffin, Johnson County, Iowa, attached
hereto and-incorporated herein.
Section 2. Amendment. The following legally described
property (2.94 acres):
Commencing at the Northeast Corner of Auditor's Parcel 2003144, in accordance with the Plat
thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson County Recorder's
Office; Thence S00°26'34"W, along the East Line of said Auditor's Parcel 2003144, a distance of
122.65 feet,to the Point of Beginning; Thence continuing S00°26'34"W, along said East Line,
209.74 feet; Thence N89°33'26"W, 1054.30 feet; Thence N00°26'34"E, 118:02 feet; Thence
S89°33'26"E, 914.80 feet; Thence Northeasterly, 177.05 feet, along a 150.00 foot radius curve,
concave Northwesterly, whose 166.95 foot chord bears N57°06'57"E, to the Point of Beginning.
Said Rezoning Parcel contains 2.94 Acres, and is subject to easements and restrictions of record.
shall be changed from zoning classification C-2B to C-10, Commercial
District - Restricted Office, and'further, that the official zoning map-of
the City be amended to reflect the change described herein.
Section 3. Amendment. The following legally described

the Plat thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson
County Recorder's Office; Thence S00°26'34"W, along the East Line of said Auditor's
Parcel 2003144,a distance of 332.40 feet, to the Point of Beginning; Thence continuing
S00°26'34"W, along said East Line, 151.98 feet; Thence N89°33'26"W, 157.01 feet;
Thence N16°12'52"W, 158.64'feet; Thence S89°33'26"E, 202.48 feet, to the Point of
Beginning. Said Rezoning Parcel contains 0.63 Acre, and is subject to easements and,
restrictions of record.
shall be changed from zoning classification R-1C to C-10, Commercial
District - Restricted Office, and further, that,the official zoning map of
the City be amended to reflect the change described herein.

- District — Medium-Density Two-Family, and further, that the official
zoning map of the City be amended to, reflect the change described
herein.
Section 7. Amendment. The following legally described
-property (1.40 acres):
Beginning at the Southeast'Corner of Auditor's Parcel 2003144, in accordance with,the
Plat thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson County
Recorder's Office; Thence S88°05'13"W, along the South Line of said Auditor's Parcel
2003144, a distance of 140.11 feet, Thence N00°26'34"E, 439.73 feet; Thence
S89°33'26"E, 139.99 feet, to a Point'on the East Line of said Auditor's Parcel 2003144;.
Thence S00°26'34"W, along said East Line, 433.97 feet to the Point of Beginning. Said
Rezoning Parcel contains 1.40 Acres, and is subject to easements and restrictions of
record.
shall be changed from zoning classification R-2 to R-12, .Residential
District - Multi-Family 12-Plex, and further, that the official zoning map
of the City be amended to reflect the change described herein.
Section 8. Amendment. The following legally described
property (2.08 acres):
Beginning at the Southwest Corner of Auditor's Parcel 2003144, in accordance with`the
Plat thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson County
Recorder's Office; Thence N00°13'17"E, along the West Line of said Auditor's Parcel
2003144, a distance of 487.81 feet, Thence S89°33'26"E, 187.89 feet', Thence
S00°20'11"W, 480.12 feet; to a Point on the South Line of said Auditor's Parcel 2003144;
Thence S88°05'13"W, along said'South Line, 187.05 feet to the Point of Beginning. Said
Rezoning Parcel contains 2.08 Acres, and is subject to easements and restrictions of
record.
shall be changed from zoning classification C-2B to R-12, Residential
District - Multi-Family 12-Plex, and further, that the official zoning map
of the City be amended to reflect the change described herein.
Section 9. Amendment. The following legally described
property (0.27 acre):
Commencing at the Southwest Corner of Auditor's Parcel 2003144, in accordance with
the Plat thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson
County Recorder's Office; Thence N00°13'17"E, along the West'Line of said Auditor's
Parcel 2003144, a distance of 487.81 feet, Thence S89°33'26"E, 187.89 feet, to the Point
of Beginning; Thence N00°20'11"E, 169.88 feet; Thence S89°33"26"E, 68.42 feet;
Thence S00°26'34"W, 169.88 feet; Thence N89°33'26"W, 68.11 feet, to the Point of

Section 10. Amendment. The following legally described

Commencing at the Southwest Corner of Auditor's Parcel 2003144, in accordance with
the Plat thereof Recorded in Plat Book 46, at Page 305 of the Records of the Johnson
County Recorder's Office; Thence N00°13'17"E, along the West Line of said Auditor's
'Parcel 2003144, a distance.of 487.81 feet, Thence S89°33'26"E, 187.89 feet; Thence
N00°20'11"E, 169.88 feet, to the Point of Beginning; Thence continuing N00°20'11"E,
780.11 feet; Thence S89°33"26"E, 69.87 feet; Thence S00°26'34"W, 780.11 feet; Thence
N89°33'26"W, 68.42 feet, to the Point of Beginning. Said Rezoning Parcel contains 1.24
Acres, and is subject to easements and restrictions of record.
shall be changed from zoning classification R-2 to C-2B, Commercial
District - Community Business, and further, that the official zoning map
of the City be amended to reflect the change described herein.
Section 11. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed.
Section 12. Severability. If any section, provision, or part of this
ordinance 'shall be adjudged to be invalid or unconstitutional, such
adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part thereof not adjudged invalid or
unconstitutional.
Section 13. Effective Date. This ordinance shall be in effect after e
its final passage, approval, and posting as provided by law.
On,the 22nd day of May 2013, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Phillips introduced Ordinance No. 2013-330, and
moved that it be given its first reading. The motion was seconded by
Councilperson Upton.
Ayes: Phillips, Upton, Bartels, Ryan, Kahler
Nays:, none.
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2013-330,was
read the first time, discussed, and"placed on record.

S89°33'26"E, 157.01 feet,to the Point of Beginning. Said Rezoning Parcel contains 1.61

Point of Beginning; Thence continuing N89°33'26"W, 914.31 feet; Thence N00°26'34"E,
169.88 feet; Thence S89°33'26"E, 914.31 feet; Thence S00°26'34"W, 169.88 feet to the
Point of Beginning. Said Rezoning Parcel contains 3.57 Acres, and is subject to
easements and restrictions of record.

On the 12th day of June 2013, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-330, and
moved that it be given its second reading. The motion was seconded by
Councilperson Upton.
Ayes: Phillips, Upton, Bartels, Ryan, Kahler
Nays: None
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and Ordinance No. 2013-330, was
read the second time and discussed and placed on record.
On the 26th day of June 2013, at a regular meeting of the Tiffin City Council,
Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-330, and
moved that it be given its third and last reading. The motion was seconded by
Councilperson Bartels.
Ayes: Kahler, Ryan, Bartels, Upton,Phillips
Nays: none
Five members of the Council being present and having voted "Aye", Mayor
Steve Berner declared the motion carried, and the ordinance was passed and
adopted.
Whereupon the Mayor declared that Ordinance No. 2013-330 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the
Council on the 26th day of June 2013 and approved by the Mayor on the 10th
day of July 2013.
