HomeMy Public PortalAbout02199 O R D I N A N C E NO. 2199 REPEALED BY 7644 - 12/28/88 AN ORDINANCE, establishing building lines or floodway reservation lines along and adjacent to the University City Branch of the River des Peres and certain of its tributaries, controlling the use of private lands within such lines, providing for the policing of the lands within such lines, and providing penalties for violations. WHEREAS, a substantial area within the District depends for drainage on the natural watercourses or streams known as the University City Branch of the River des Peres and its tributaries, which run in or through the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In the Board's judgment, building lines or floodway reservation lines along and adjacent to the University City Branch of the River des Peres and its tributaries are required for the public health and convenience, for the adequate drainage of the District, and for the protection of property from the encroachment of flood waters. Section Two. Building lines or floodway reservation lines as described below are hereby established along the centerlines, and adjacent thereto on each side at varying distances, of University City Branch of the River des Peres and its tributaries the Trenton Branch, the Record Center Branch, the South Price Road Branch, the Vinita Park Branch and the Hanley Hills Branch. Main Channel. A strip of land of varying width, the centerline thereof being more particularly described as follows: The centerline of a 75 feet wide strip of land beginning on the centerline of the Chicago, Rock Island and Pacific Railroad right-of-way, 100 feet wide; thence northeastwardly 317 feet to a curve to the right having a radius of 200 feet; thence northeastwardly and eastwardly along said curve 180 feet; thence eastwardly 740 feet plus or minus along a line 36 feet northwardly from and parallel to the south line of U.S. Survey 2966 to a curve to the right having a radius of 200 feet; thence eastwardly along said curve 80.3 feet; thence eastwardly 657 feet plus or minus to a curve to the left having a radius of 200 feet; thence eastwardly along said curve 82 feet; thence eastwardly 128 feet plus or minus to a point, said point being 50 feet perpendicularly northwardly from the northeasternmost corner of Lot 6 in Block A of Arrowhead Park Addition, a subdivision of St. Louis County, Missouri, according to the plat recorded in Plat Book 72, Page 6 of the St. Louis County Records; thence continuing eastwardly 336 feet plus or minus to a curve to the left having a radius of 200 feet; thence eastwardly along said curve 76.8 feet; thence eastwardly 166 feet plus or minus to a curve to the right having a radius of 200 feet; A strip of land of varying width, the centerline thereof being more particularly described as follows: The centerline of a 65 feet wide strip of land beginning at a point on the southeastward prolongation of the northeastern line of Lots 19 through 28 in Block 1 of Hanley Hills 2nd Addition, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 45, Page 8 of the St. Louis County Records, 130 feet southeastwardly from the eastern most corner of said Lot 28; thence southeastwardly 402 feet plus or minus to a point 231 feet plus or minus perpendicularly from the easternmost 17 corner of Lot 39 in Block 1 of said Hanley Hills 2nd Addition; thence continuing southeastwardly 66 feet plus or minus to a curve to the right having a radius of 200 feet; thence southeastwardly and eastwardly along said curve 255.2 feet; thence southwardly 502 feet plus or minus to a point 95 feet perpendicularly from the northeasternmost corner of Lot 24 in Block 5 of Hanley Hills 3rd Addition, a subdivision of St. Louis County, Missouri, according to the plat thereof recorded in Plat Book 46, Page 11 of the St. Louis County Records; thence continuing southwardly 360 feet plus or minus to a curve to the left having a radius of 350 feet; thence southwardly along said curve 256.6 feet; thence southwardly 359 feet plus or minus to the centerline of Raft Drive, 50 feet wide, 224 feet southwestwardly from the intersection of the centerlines of said Raft Drive and Falcon Drive, 50 feet wide; thence continuing southwardly 342 feet plus or minus to a curve to the left having a radius of 200 feet; thence southwardly and southeastwardly along said curve 82 feet; thence southeastwardly 819 feet plus or minus to a curve to the right having a radius of 200 feet; thence southeastwardly along said curve 84.6 feet; thence southeastwardly 300 feet plus or minus to the end of the centerline of a 65 feet wide strip of land and the beginning of the centerline of a 75 feet wide strip of land; thence continuing southeastwardly 109 feet plus or minus to a curve to the left having a radius of 200 feet; thence southeastwardly and eastwardly along said curve 139.6 feet; thence eastwardly 173 feet along a line 15 feet 18 southwardly from and parallel to the northern right-of-way of the St. Louis Belt and Terminal Railroad, 285 feet wide, to a curve to the right having a radius of 100 feet; thence eastwardly and southwardly along said curve 149.2 feet; thence southwardly 36 feet plus or minus to the centerline of said railroad right-of-way 496.0 feet westwardly from the intersection of the centerlines of said railroad right-of-way and Pennsylvania Avenue, 100 feet wide; thence continuing southwardly 277 feet plus or minus to a curve to the left having a radius of 200 feet; thence southwardly along said curve 104.7 feet; thence southwardly 149 feet plus or minus to the centerline of Eltora Avenue, 40 feet wide, 364 feet westwardly from the intersection of the centerlines of said Eltora Avenue and said Pennsylvania Avenue; thence continuing southwardly 84 feet plus or minus to a curve to the left having a radius of 200 feet; thence southwardly and southeastwardly along said curve 97.7 feet; thence southeastwardly 108 feet plus or minus to a curve to the right having a radius of 100 feet; thence southeastwardly and southwardly along said curve 118.7 feet; thence southwardly 60 feet plus or minus to the centerline of Page Avenue, 100 feet wide, 128 feet northwestwardly from the intersection of the centerlines of said Page Avenue and said Pennsylvania Avenue, said point also being the end of the centerline of a 75 feet wide strip of land and the beginning of the centerline of a 55 feet wide strip of land; thence continuing southwardly 117 feet to a curve to the left having a radius of 100 feet; thence southwardly and southeastwardly along 19 said curve 134.4 feet; thence southeastwardly 53 feet plus or minus to the centerline of Pennsylvania Avenue, 60 feet wide, 197.7 feet southwardly from the intersection of the centerlines of said Pennsylvania and said Page Avenue, said point also being the end of the centerline of a 55 feet wide strip of land and the beginning of a 75 feet wide strip of land; thence continuing southeastwardly 240 feet plus or minus to a curve to the right having a radius of 100 feet; thence southeastwardly and southwardly along said curve 121.7 feet; thence southwardly 397 feet plus or minus to a curve to the left having a radius of 175 feet; thence southwardly and southeastwardly along said curve 142 feet; thence southeastwardly 171 feet plus or minus to the centerline of Griefield Avenue, 50 feet wide, 30 feet plus or minus northwardly from the intersection of the centerlines of said Griefield Avenue and Ardee Way, 50 feet wide; thence continuing southeastwardly 378 feet plus or minus to the end of the Hanley Hills Branch. Section Three. Such building lines are the limits of floodway reservations. No buildings or part of a building or appurtenance thereof or any structure shall be set up or erected within such reservations. Section Four. Except by permission of the Board pursuant to ordinance, no fill shall be made within such reservations which may diminish the area of flow or otherwise obstruct in any way the free flow of flood waters in such reservations nor without such permission shall any dams, walls, or other watertight or 20 practically watertight structures be constructed or placed within such reservations. Section Five. District maintenance and supervisory personnel and other authorized agents of the Board shall have the right to enter upon the lands hereby reserved and to clean, police, and otherwise maintain the channel and banks of the streams or watercourses described herein, so that the natural and healthful flow of the stream may be maintained at all times. Section Six. It shall be unlawful for any person to deposit, dump, or otherwise dispose of, within the building lines hereby established, any sewage, garbage, rubbish, industrial wastes, loose material, oils, or other soluble or insoluble solid or liquid matter, which may pollute the streams or subsequently be washed away or carried downstream or which may leave unhealthful or unsightly traces either in the bed of the stream or on the banks thereof. The Executive Director may by written order require any person who shall have violated any of the provisions of this section to remove any or all material such person may have deposited or otherwise disposed of within such lines. In case of the failure of the owner of any land within such lines to remove any such material upon such order, the Executive Director shall order such material removed at the expense of such owner and, if the owner shall fail to pay the cost of such work, the District may file a lien for the amount thereof against the property with the 21 Recorder of Deeds of either the City of St. Louis or of St. Louis County, as the case may be. Section Seven. Any person violating any provision of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined not less than One Hundred Dollars ($100.00) nor more than One Thousand Dollars ($1,000.00) or be imprisoned in the city workhouse or the county jail, as the case may be, not less than ten (10) days nor more than One Hundred Eighty (180) days, or by both such fine and imprisonment for each violation. Each day in which any such violation shall continue shall be deemed a separate offense. The foregoing Ordinance was adopted August 11, 1971.
