AN ORDINANCE, authorizing the Executive Director and
the Secretary-Treasurer of The Metropolitan St. Louis Sewer
District to purchase from the owner thereof a 1.14 acre tract of
land in U.S. Survey 1012, Township 47 North, Range 7 East in St.
Louis County, Missouri, to be used as a site of the Coldwater
Creek Downstream Pump Station No. 2, prescribing terms, and
containing an emergency clause.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and the
Secretary-Treasurer of the District are authorized to purchase
from the owner thereof, the following 1.14 acre tract of land in
U.S. Survey 1012, Township 47 North, Range 7 East in St. Louis
County, Missouri to be used as a site for the Coldwater Creek
Downstream Pump Station No. 2 at a price not to exceed Four
Thousand Dollars and No cents ($4,000.00), said property to be
free of all encumbrances, said property described as follows:
A tract of land in U.S. Survey 1012, Township 47 North, Range
7 East and described as follows:
Beginning at an iron rod at the intersection of East line of
U.S. Highway #67 (Mark Twain Blvd.) (100 feet wide) with the
East line of U.S. Survey 1012; thence along East line of U.S.
Survey 1012, North 3 degrees 02 minutes West a distance of
586.60 feet to an old stone set in Survey line; thence
leaving said Survey line and running South 56 degrees 02
minutes West 250.82 feet to a point; thence South 32 degrees
03 minutes East 159.60 feet to an old iron pipe set at
intersection with the centerline New Jamestown Road (60 feet
wide) with said Last course; thence along said centerline of
New Jamestown Road; the following courses and distance, South
52 degrees 40 minutes East 75.80 feet to an old stone, South
30 degrees 31 minutes East 126.47 feet to an old iron pipe,
South 9 degrees 20 minutes East 133.49 feet to an old iron
pipe, set in the East line of U.S. Highway No. 67; thence
along said East line of said Highway 25 feet to beginning and
containing 1.181 acres according to Survey executed by
Elbring Surveying Company on April 22, 1946;
EXCEPTING THEREFROM, That part condemned by the State of
Missouri for highway purposes, under Cause #259737 of the
Circuit Court of the County of St. Louis.
Section Two. Upon the execution and delivery to them
by the said owner of a Quit Claim Deed in proper form, being free
from liens and encumbrances, conveying title to the said land to
The Metropolitan St. Louis Sewer District, the Executive Director
and the Secretary-Treasurer shall be and are hereby authorized and
directed to pay to said owner, for the said land, the total sum of
Four Thousand Dollars and No cents ($4,000.00).
Section Three. An emergency exists within the meaning
of the Plan, since the realty is needed for the protection of the
public health and the purchase must be arranged for without delay.
Accordingly, this Ordinance shall take effect immediately upon
its enactment.
