AN ORDINANCE, establishing building lines or floodway
reservation lines along and adjacent to Two Mile Creek and its
tributaries, controlling the use of private lands within such
lines, providing for the policing of the lands within such lines,
and providing penalties for violations.
WHEREAS, a substantial area within the District depends
for drainage on the natural watercourses or streams known as Two
Mile Creek and its tributaries, which run in or through the
District,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In the Board's judgment, building lines or
floodway reservation lines along and adjacent to Two Mile Creek and
its tributaries are required for the public health and convenience,
for the adequate drainage of the District, and for the protection
of property from the encroachment of flood waters.
Section Two. Building lines or floodway reservation
lines as described below are hereby established along the
centerlines, and adjacent thereto on each side at varying
distances, of Two Mile Creek and its tributaries, the Crystal Lake
Branch, the Des Peres Branch and the South Lindbergh Branch.
Main Channel - A strip of land of varying width, the centerline
thereof being more particularly described as follows:
The centerline of a 140 feet wide strip of land described as
beginning at a point South 71 degrees 20 minutes 15 seconds, East
399.40 feet from the southeast corner of Lot 7 of Overbrook
Estates, a subdivision of St. Louis County, Missouri, according to
the plat thereof, recorded in Plat Book 27, Page 36 of the St.
Louis County Records; thence westwardly 431.25 feet along a curve
to the left having a radius of 1432.50 feet; thence North 85
degrees 01 minutes 18 seconds, 579.50 feet along a line 30 feet
south of and parallel to the northern line of Lots 8, 9, 10 and 11
of said Overbrook Estates to a curve to the right having a radius
of 1432.50 feet; thence westwardly along said curve 325.00 feet to
a curve to the left having a radius of 1432.50 feet; thence
westwardly along said curve 375.29 feet to a point of tangency,
said point being South 07 degrees 50 minutes 24 seconds, West
271.85 feet from the southwest corner of the Carrie Washford Tract,
a subdivision of St. Louis County, Missouri, according to the plat
thereof, recorded in Plat Book 56, Page 78 of the St. Louis County
Records; thence North 87 degrees 07 minutes 56 seconds, West
1760.00 to a point, said point being South 02 degrees 43 minutes 00
seconds, East 390.00 feet from the southwest corner of Lot 9 of the
subdivision of the John P. Litzinger Estate, a subdivision of St.
Louis County, Missouri, according to the plat thereof recorded in
Plat Book 5, Pages 47 and 49 of the St. Louis County Records;
thence continuing North 87 degrees 07 minutes 56 seconds, West
1417.51 feet to a curve to the right having a radius of 1432.50
feet; thence westwardly along said curve 557.78 feet to a point of

tangency; thence North 64 degrees 49 minutes 15 seconds, West
146.01 feet to a curve to the left having a radius of 1432.50 feet;
thence westwardly along said curve 985.73 feet to a point of
tangency; thence South 75 degrees 45 minutes 00 seconds, West 95.33
feet to a curve to the left having a radius of 1432.50 feet; thence
westwardly and southwardly along said curve 1147.68 feet to a point
of tangency; thence South 29 degrees 50 minutes 34 seconds, West
1448.77 feet to a curve to the right having a radius of 1432.50
feet, said point being North 12 degrees 34 minutes 20 seconds, East
613.39 feet from the center of the northeast, one fourth of Section
25, Township 45 North, Range 5 East; thence southwardly and
westwardly along said curve 1551.15 feet to a point of tangency;
thence North 88 degrees 06 minutes 41 seconds, West 287.02 feet to
the beginning of the centerline of the South Lindbergh Branch,
herein described, said point also being the end of the centerline
of a 140 feet wide strip of land and the beginning of a 110 feet
wide strip of land and also being South 06 degrees 38 minutes 00
seconds, West 111.47 feet, from the intersection of the west line
of Lindbergh Boulevard, 100 feet wide, and the south line of the
northeast quarter of the southwest quarter of Section 25, Township
45 North, Range 5 East; thence continuing North 88 degrees 06
minutes 41 seconds West 197.88 feet to a curve to the left having a
radius of 955.00 feet; thence westwardly along said curve 543.75
feet to a point of tangency; thence South 59 degrees 15 minutes 57
seconds, West 292.97 feet to a curve to the right having a radius

point of tangency; thence North 61 degrees 44 minutes 03 seconds,
West 813.13 feet to a curve to the right having a radius of 716.25
feet, said point being South 85 degrees 26 minutes 04 seconds, West

Manor, a subdivision of St. Louis County, Missouri, according to

end of the centerline of a 110 feet wide strip of land and the
beginning of the centerline of a 105 feet wide strip of land;
thence continuing westwardly and northwardly along said curve
339.78 feet to a point of tangency; thence North 30 degrees 14
minutes 03 seconds, West 104.31 feet to a curve to the left having
a radius of 716.25 feet; thence northwardly and westwardly along
said curve 557.43 feet to a point of tangency; thence North 74
degrees 49 minutes 31 seconds, West 153.76 feet to a curve to the
left having a radius of 716.25 feet; thence westwardly along said
curve 528.41 feet to a point of tangency, said point being the end
of the centerline of a 105 feet wide strip of land and the
beginning of the centerline of a 100 feet wide strip of land;

a curve to the left having a radius of 1432.50 feet; thence
westwardly along said curve 299.02 feet to a point of tangency;

a curve to the right having a radius of 477.50 feet, said point
being the beginning of the centerline of the Des Peres Branch,
herein described, and also the end of the centerline of a 100 feet
wide strip of land and the beginning of the centerline of a 80 feet
wide strip of land; thence westwardly along said curve 301.94 feet
to a point of tangency, said point being the end of the centerline
of a 80 feet wide strip of land and the beginning of the centerline
of a 75 feet wide strip of land; thence North 62 degrees 05 minutes

radius of 200 feet, said point being the end of the centerline of a

centerline of a 80 feet wide strip of land and the beginning of the
centerline of a 65 feet wide strip of land, said point also being
the beginning of the centerline of the Crystal Lake Branch, herein
described; thence continuing South 89 degrees 51 minutes 56
seconds, 1161.87 feet to the eastern line of Bopp Road 282.00 feet
northwardly from the intersection of said eastern line and the
centerline of Andre Drive; thence continuing South 89 degrees 51
minutes 56 seconds, West 98.37 feet to a curve to the right having
a radius of 318.33 feet; thence westwardly along said curve 111.12
feet to a curve to the left having a radius of 318.33 feet; thence
westwardly along said curve 147.61 feet to a point of tangency;
thence North 83 degrees 34 minutes 00 seconds, West 319 feet to the
end of the centerline of the Main Channel.
Crystal Lake Branch - A strip of land of varying width, the
centerline thereof being more particularly described as follows:
The centerline of a 65 feet wide strip of land described as
beginning at a point on the centerline of the Main Channel, herein

described; thence westwardly and northwardly 256.55 feet along a
curve to the right having a radius of 213.53 feet, said point being
the end of the centerline of a 65 feet wide strip of land and the
beginning of the centerline of a 60 feet wide strip of land; thence
North 21 degrees 17 minutes 17 seconds, West 511.24 feet to a curve
to the right having a radius of 7,246.6 feet; thence northwardly
along said curve 1,351.51 feet to the end of the Crystal Lake
Branch.
Des Peres Branch - A strip of land of varying width, the centerline
thereof being more particularly described as follows:
The centerline of a 80 feet wide strip of land described as
beginning at a point on the centerline of the Main Channel, herein
described; thence South 81 degrees 40 minutes 27 seconds, West
436.06 feet to a curve to the left having a radius of 318.33 feet;
thence westwardly and southwardly along said curve 367.97 feet to a
point of tangency; thence South 15 degrees 26 minutes 40 seconds,
West 282.91 feet to a curve to the right having a radius of 2,865.0
feet; thence southwardly along said curve 236.64 feet to point of
tangency; thence South 20 degrees 10 minutes 37 seconds, West
339.30 feet to a curve to the left having a radius of 955.0 feet;
thence southwardly along said curve 164.12 feet to the end of the
centerline of a 80 feet wide strip of land and the beginning of a
70 feet wide strip of land; thence continuing southwardly along
said curve 49.12 feet to a point of tangency; thence South 07
degrees 22 minutes 10 seconds, West 188.17 feet to a curve to the

right having a radius of 2,865.0 feet; thence southwardly along
said curve 439.44 feet to a point of tangency; thence South 16
degrees 09 minutes 40 seconds, West 377.30 feet to a curve to the
left having a radius of 318.33 feet; thence southwardly along said
curve 187.61 feet to a point of tangency, said point being the end
of the centerline of a 70 feet wide strip of land and the beginning

degrees 36 minutes 24 seconds, East 615.72 feet along the eastern
line of Harwood Road, 30 feet wide, to an angle point in said Road,
distant 38.19 feet southwardly from the northwestern corner of
Harwood Hills Plat 7, a subdivision of St. Louis County, Missouri,
according to the plat thereof recorded in Plat Book 88, Page 44 of
the St. Louis County Records; thence South 19 degrees 31 minutes 40
seconds, East 432.19 feet to the end of the Des Peres Branch.
South Lindbergh Branch - A strip of land of varying width, the
centerline thereof being more particularly described as follows:
The centerline of a 70 feet wide strip of land described as
beginning on the centerline of the Main Channel, herein described;
thence South 44 degrees 47 minutes 11 seconds, West 248.12 feet to
a curve to the left having a radius of 477.50 feet; thence
southwardly along said curve 307.78 feet to a point of tangency;
thence South 07 degrees 51 minutes 12 seconds, West 25.15 feet to a
curve to the right having a radius of 477.50 feet; thence
southwardly along said curve 212.70 feet to a point of tangency,
said point being the end of the centerline of a 70 feet wide strip

of land and the beginning of the centerline of a 65 feet wide strip
of land; thence South 33 degrees 22 minutes 40 seconds, West 628.77
feet to a curve to the left having a radius of 716.25 feet; thence
southwardly along said curve 200.18 feet to the end of the
centerline of a 65 feet wide strip of land and the beginning of the
centerline of a 60 feet wide strip of land; thence continuing
southwardly along said curve 335.32 feet to a point of tangency;
thence South 09 degrees 27 minutes 44 seconds, East 471.47 feet to
a curve to the right having a radius of 716.25 feet; thence
southwardly along said curve 536.62 feet to a point of tangency;
thence South 33 degrees 28 minutes 01 seconds, West 217.05 feet to
the end of the centerline of the South Lindbergh Branch.
Section Three. Such building lines are the limits of
floodway reservations. No buildings or part of a building or
appurtenance thereof or any structure shall be set up or erected
within such reservations.
Section Four. Except by permission of the Board pursuant
to ordinance, no fill shall be made within such reservations which
may diminish the area of flow or otherwise obstruct in any way the
free flow of flood waters in such reservations nor without such
permission shall any dams, walls, or other watertight or
practically watertight structures be constructed or placed within
such reservations.
Section Five. District maintenance and supervisory
personnel and other authorized agents of the Board shall have the

right to enter upon the lands hereby reserved and to clean, police
and otherwise maintain the channel and banks of the streams or
watercourses described herein, so that the natural and healthful
flow of the stream may be maintained at all times.
Section Six. It shall be unlawful for any person to
deposit, dump, or otherwise dispose of, within the building lines
hereby established, any sewage, garbage, rubbish, industrial
wastes, loose material, oils, or other soluble or insoluble solid
or liquid matter, which may pollute the stream or subsequently be
washed away or carried downstream or which may leave unhealthful or
unsightly traces either in the bed of the stream or on the banks
thereof.
The Executive Director may by written order require any
person who shall have violated any of the provisions of this
section to remove any or all material such person may have
deposited or otherwise disposed of within such lines. In case of
the failure of the owner of any land within such lines to remove
any such material upon such order, the Executive Director shall
order such material removed at the expense of such owner and, if
the owner shall fail to pay the cost of such work, the District may
file a lien for the amount thereof against the property with the
Recorder of Deeds of either the City of St. Louis or of St. Louis
County, as the case may be.
Section Seven. Any person violating any provision of this
Ordinance shall be deemed guilty of a misdemeanor and upon

conviction thereof shall be fined not less that One Hundred Dollars
($100.00) nor more than One Thousand Dollars ($1,000.00) or be
imprisoned in the city workhouse or the county jail, as the case
may be, not less than ten (10) days nor more than One Hundred
Eighty (180) days, or by both such fine and imprisonment for each
violation. Each day in which any such violation shall continue
shall be deemed a separate offense.
