AN ORDINANCE TO AMEND THE CITY OF TIFFIN IOWA
SUBDIVISION ORDINANCE NO. 2012-319, TO CHANGE THE TIME
PERIOD UNDER SECTION 3.05 MAINTENANCE BOND REQUIRED.
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend Section 3.05,
City of Tiffin Iowa Subdivision Ordinance No. 2012-319, to change the period for
which the owner and subdivider of the land being platted shall be required to provide
to the City proper maintenance bonds from ten (10) years to three (3) years.
Section II. Amendment: Section 3.05 of the City of Tiffin Iowa Subdivision
Ordinance No. 2012-319 is hereby replaced with the following:
3 . 05 MAINTENANCE BOND REQUIRED
The owner and subdivider of the land being platted
shall be required to provide to the City, proper
maintenance bonds satisfactory to the City, so as to
insure that for a period of three (3) years from, the
date of acceptance of any improvement, the owner and
subdivider shall be responsible to maintain such
improvement in good repair. The City may, at its sole
discretion, accept alternative sureties to maintenance
bonds to insure the workmanship of the improvements
accepted by the City. A performance bond will also be
required per Section 5. 12 .
Section III. Repealer. All ordinances or parts of ordinance in conflict with the
provisions of this Ordinance are hereby repealed.
Section IV. Severability Clause. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not
affect the validity of the ordinance as a whole or any section, provision or part thereof
not adjudged invalid or unconstitutional.
Section V. When Effective. This ordinance shall be in effect after its final
passage, approval, and posting as provided by law.

On the 26th day of June 2013, at a regular meeting of the Tiffin City Council, Tiffin,

Iowa, Councilperson Bartels introduced Ordinance No. 2013-332, and moved that it
be given its first reading. The motion was seconded by Councilperson Ryan.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2013-332, was read the first
time, discussed, and placed on record.
On the 10th day of July 2013, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Upton introduced Ordinance No. 2013-332, and moved that it
be given its second reading. The motion was seconded by Councilperson Bartels.
Ayes: Phillips, Upton, Bartels, Ryan, Kahler
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and Ordinance No. 2013-332,was read the
second time and discussed arid placed on record.
On the 24th day of July 2013, at a regular meeting of the Tiffin City Council, Tiffin,
Iowa, Councilperson Ryan introduced Ordinance No. 2013-332, and moved that it be
given its third and last reading. The motion was seconded by Councilperson Kahler.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve
Berner declared the motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2013-332 be adopted and
signified his approval of same by fixing his signature thereto. Passed by the Council
on the 24th day of July 2013 and approved by the Mayor on the 25th day of July 2013.

The City Council of the City of Tiffin, Iowa, met on`June 26, 2013, at 6:30 p.m. at the
Springmier Library in the CCA Middle School, Tiffiri, Iowa.
The meeting was called to order by the Mayor, and the roll.being called, the following
named Council Members were present and absent:
Present: Royce Phillips,Teggy Upton, Jim Bartels, Mike Ryan, Joann Kahler

Absent: None
'Council Member Ryan`introduced the following resolution and moved its adoption;
seconded by Council Member Kahler. The Mayor put the question upon the adoption of said
resolution, and the roll being called, the following Council Members voted:
Ayes: Bartels, Ryan; Kahler
Nays: Upton, Phillips.
Whereupon, the Mayor declared the resolution duly,adopted, as hereinafter set out.,

RESOLUTION NO. 2013-102
Resolution to fix a date for public hearings on proposal to enter into a General
Obligation City Hall Improvement Loan Agreement and borrow money in an
aggregate principal amount not to exceed$400,000
WHEREAS, the City of Tiffin (the "City"), in the County of Johnson, State of Iowa,
proposes to enter into a General Obligation Loam Agreement (the "Loan Agreement") and
borrow money in a principal amount not to exceed $400,000 pursuant to the provisions of
Section 384.24A of the Code of Iowa for the purpose of paying the cost, to that extent, of
constructing improvements to City Hall, and it is now necessary to fix a date of meeting of the
City Council at which it is proposed to take action to enter into the Loan Agreement and to give
notice thereof as required by such law, including notice of the right to petition for an election on
such proposal;
NOW, THEREFORE, Be It Resolved by the City Council of the City of Tiffin, as
follows:
Section 1. The City Council shall meet on the 26th day of June, 2013, at the
Springmier Library in the CCA Middle School, Tiffin, Iowa, at 6:30 p.m., at which time and
place a hearing will be held and proceedings will be instituted and action taken to enter into the
Loan Agreements.
Section 2. The City Clerk is hereby directed to give notice of the proposed action on
the General Purpose Loan Agreement setting forth the amount and purpose thereof, the time
when and place where the said meeting will be held by publication at least once and not less than
10 nor more than,20 days before the date of said meeting, in a legal newspaper which has a
general circulation in the City. The notice shall be in substantially the following form:

NOTICE OF PROPOSED ACTION TO INSTITUTE PROCEEDINGS TO ENTER INTO
A LOAN AGREEMENT AND BORROW MONEY IN A PRINCIPAL AMOUNT NOT TO
EXCEED $400,000
(GENERAL OBLIGATION)
The City Council of the City of Tiffin, Iowa, will meet on the 26th day of June, 2013, at
the Springmier Library in the CCA Middle School, Tiffin, Iowa, at 6:30 p.m., for the purpose of
instituting proceedings and taking action to.enter into a loan agreement (the "Loan Agreement")
and borrow money in a principal amount not to exceed $400,000 for the purpose of paying the
cost, to that extent, of constructing improvements to City Hall.
The Loan Agreement is proposed to be entered into pursuant to authority contained in
Section 384.24A of the Code of Iowa and will constitute a general obligation of the City.
The maximum rate of interest which may be payable under the Loan Agreement is 7%
per annum.
At any time before the date fixed for taking action to enter into the Loan Agreement, a
petition may be filed with the City Clerk of the City asking that the question of entering into the
Loan Agreement be submitted to the registered voters of the City, pursuant to the provisions of
Section 384.26 of the Code of Iowa. •

Section 3. All resolutions or parts thereof in conflict herewith are hereby repealdd to
the extent of such conflict.
Section 4. This resolution shall be in full force and effect immediately upon its
adoption and approval, as provided by law.
