HomeMy Public PortalAbout02222 O R D I N A N C E NO. 2222 AN ORDINANCE to extend the boundaries of The Metropolitan St. Louis Sewer District and the Coldwater Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District to include an area of St. Louis County which could be efficiently served by the sewer facilities of the District and the Coldwater Creek Trunk Subdistrict. WHEREAS, a petition to the Board of Trustees of The Metropolitan St. Louis Sewer District has been received from the majority of the owners of the land in said area, who own more than one-half of the area therein, praying for annexation to the District and the Coldwater Creek Trunk Subdistrict of The Metropolitan St. Louis Sewer District; and WHEREAS, this area adjoins The Metropolitan St. Louis Sewer District and the Coldwater Creek Trunk Subdistrict, and the existing sewers of the District and Subdistricts are adequate to handle all of its sanitary sewage, that the interest of sanitation and public health of the District will be promoted by including the area in its territory; and that the sewage flow from the area proposed to be annexed has no available outlet through public sanitary sewers other than those of the District, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. That the Board finds that the sewer facilities of the District can efficiently serve the area described as follows: Beginning in the centerline of Shackelford Road at its intersection with the southeastward prolongation of the northeast line of property conveyed to Francis Duffy by instrument recorded in Book 2314, Page 610 of the St. Louis County Records, which northeast line is also the southwest line of property now or formerly of Bernard H. and Angela Gruenloh, and which point of intersection is in the present boundary of The Metropolitan St. Louis Sewer District, as established by its Ordinance No. 417, adopted June 16, 1960; thence northwestwardly along said southeastward prolongation and along the northeast line of said Duffy property to a point distant 3,594.85 feet northwest therealong from the northwest line of said Shackelford Road; thence southwestwardly along a line parallel with the northwest line of Shackelford Road, 1,139 feet, more or less, to the southwest line of said Duffy property, which is also the northeast line of property conveyed to Frank W. Gittemeier by deed recorded in Book 1772, Page 27, said Records; thence northwestwardly along the northeast line of said Gittemeier property to the northernmost corner thereof; thence northeastwardly in a straight line, 1,093 feet, more or less, to the westernmost corner of property conveyed to Bernard H. Gruenloh and wife by instrument recorded in Book 1376, Page 540 of the St. Louis County Records; thence northwardly along the northwest line of said Gruenloh property, 856 feet, more or less, to the northernmost corner of said Gruenloh property; thence southeastwardly along the northeast line of said Gruenloh property, which line is also the southwest line of property now or formerly of Joseph Desloge by instrument recorded in Book 1599, Page 277 of the St. Louis County Records, 321 feet, more or less, to the southernmost corner of said Desloge property; thence northeastwardly along the southeast line of said Desloge property, 819 feet, more or less, to the easternmost corner of said Desloge property; thence southeastwardly along the northeast line of Subdivision of Joseph L. Hyatt's Estate, as per plat thereof recorded in Plat Book 5, Page 20, St. Louis County Records, to its intersection with the centerline of Shackelford Road, which point of intersection is in the present boundary of The Metropolitan St. Louis Sewer District, as established by its Ordinance No. 1486, adopted May 9, 1966; thence southwestwardly along the centerline of Shackelford Road, being along said existing District boundary line, to the point of beginning. Section Two. That the petitions praying for annexation were signed by the majority of the owners of all of the land in said area who own more than one-half of the land area of the area to be served. Section Three. That the interest of sanitation and 4 public health of the District will be promoted by including the area in its territory. Section Four. That the sewage flow from the area proposed to be annexed has no available outlet through public sanitary sewers other than those of the District. Section Five. The corporate boundaries of The Metropolitan St. Louis Sewer District and the Coldwater Creek Trunk Subdistrict are hereby extended so as to include the above- described area. Section Six. Certified copies of this Ordinance shall be filed in the offices of the Recorder of Deeds of St. Louis County, the Recorder of Deeds of the City of St. Louis and the Secretary of State. 5 The foregoing Ordinance was adopted September 16, 1971.
