HomeMy Public PortalAbout02262 O R D I N A N C E NO. 2262 AN ORDINANCE, amending Section Two of Ordinance No. 1864, adopted April 3, 1969, and Section Two of Ordinance No. 2032, adopted May 7, 1970, and Section Two of Ordinance No. 2167, adopted May 20, 1971, and Section Two of Ordinance No. 2242, adopted October 29, 1971, and revising the boundaries of Subdistrict No. 268 (Lin Ferry-Tesson Ferry) of The Metropolitan St. Louis Sewer District. WHEREAS, the Board finds that an additional area can be efficiently served as a part of Subdistrict No. 268 (Lin Ferry- Tesson Ferry) which area included therein is not presently benefitted by improvements in the Subdistrict, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. Section Two of Ordinance No. 1864, adopted April 3, 1969 as amended by Ordinance No. 2032, adopted May 7, 1970, and Ordinance No. 2167, adopted May 20, 1971, and Ordinance No. 2242, adopted October 29, 1971, is hereby amended by adding to Subdistrict No. 268 (Lin Ferry-Tesson Ferry) an area described as: Lot 8 of OCHS ACRES, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 48, Page 11, St. Louis County, Missouri, Recorder's office; Excepting therefrom the southern part thereof conveyed to the State of Missouri for highway purposes by instrument recorded in Book 5293, Page 44, said Recorder's office. Section Two. Section Two of said Ordinance No. 1864 as amended by Ordinance Nos. 2032, 2167 and 2242, and as hereby amended, shall read as follows: "Section Two. The boundaries of Subdistrict No. 268 (Lin Ferry-Tesson Ferry) shall be as follows: Beginning at the intersection of the centerline of Tesson Ferry Road (Highway 21) before relocation, with the centerline of Lindbergh Boulevard; thence southwestwardly along the centerline of said Tesson Ferry Road to its intersection with the northwestern prolongation of the southwest line of property conveyed to Barland Inc., by deed recorded in Book 3626, Page 224, St. Louis County Recorder's office; thence southeastwardly along said prolongation and along the southwestern and southern lines of said Barland Inc., property to the west line of OCHS ACRES, a subdivision as per plat thereof recorded in Plat Book 48, Page 11, said Recorder's office; thence northwardly along the western line of said OCHS ACRES to the northwest corner thereof; thence eastwardly along the north line of said subdivision to the northwest corner of Lot 12 thereof; thence south along the west line of said Lot 12, and its southern prolongation, to the centerline of Arthur Lane; thence easterly along the centerline of Arthur Lane to its intersection with the northern prolongation of the west line of Lot 8 of said OCHS ACRES; thence southwardly along said prolongation, and along the west line of said Lot 8 to the northwestern corner of that part of said Lot 8 conveyed to the State of Missouri for 3 highway purposes by instrument recorded in Book 5293, Page 44, said Recorder's office; thence northeastwardly along the northern line of said property so conveyed to the State of Missouri, to its northeastern corner, being in the east line of said OCHS ACRES; thence northwardly along the east line of said subdivision to the northeastern corner thereof; thence eastwardly along a line parallel with the centerline of Lindbergh Boulevard to the centerline of relocated Tesson Ferry Road, being Missouri State Highway Route FF (21); thence southwestwardly along the centerline of said relocated Tesson Ferry Road to its intersection with the East-West centerline of Section 28, Township 44 north Range 6 East; thence eastwardly along said East-West centerline of Section 28 to the southeast corner of MURPHY PLAZA, a subdivision as per plat thereof recorded in Plat Book 136, Pages 44 and 45, said Recorder's office; thence northwardly along the east line of said MURPHY PLAZA, and its northern prolongation to the centerline of Lindbergh Boulevard; thence southeastwardly along the centerline of said Lindbergh Boulevard to its intersection with the southern prolongation of the western line of property conveyed to Chippewa-Watson Corp., et al., by deed recorded in Book 6382, Page 1238 said Recorder's office; thence northwardly along said prolongation and along the western line of said Chippewa-Watson Corp., et al., property to its intersection with a line parallel with and 300 feet northwardly from, measured at right angles to, the 4 centerline of Lindbergh Boulevard; thence westwardly along said parallel line to the eastern line of property conveyed to Concord Investment Corp. by deed recorded in Book 6220, Page 125 said Recorder's office; thence southwardly and westwardly along the eastern and southern lines, respectively, of said Concord Investment Corp. property, and along the straight western prolongation of the southern line thereof, to the centerline of Lin Ferry Drive; thence northwardly along the centerline of Lin Ferry Drive to the northeastwardly prolongation of the southeastern line of property conveyed to Jess Watts and wife, by deed recorded in Book 5269, Page 519, said Recorder's office; thence southwestwardly, northwestwardly and northeastwardly along said northeastwardly prolongation and said southeastern line, along the southwestern line and along the northwestern line and its northeastwardly prolongation, respectively, of said Watts property, to the centerline of Lin Ferry Drive; thence northwestwardly along the centerline of Lin Ferry Drive to the centerline of Tesson Ferry Road, as relocated; thence northeastwardly along the centerline of said relocated Tesson Ferry Road to its intersection with the northwestern prolongation of the southwest line of property conveyed to Louise Masel, et al., by deed recorded in Book 4501, Page 551, said Recorder's office; thence southeastwardly along said prolongation and along the southwest line of said Masel property to its intersection with a line parallel with and 5 250 feet southeast of, measured at right angles to, the centerline of said Tesson Ferry Road as relocated; thence northeastwardly along said parallel line to the southwest line of Lot 3 in SUNSET VIEW, a subdivision as per plat thereof recorded in Plat Book 58, Page 37, St. Louis County Recorder's office; thence northwestwardly along the southwest lines of Lots 3, 2 and 1 in said SUNSET VIEW, and along the northwestern prolongation of said southwest lines to the centerline of Tesson Ferry Road, as relocated; thence northeastwardly along the centerline of said Tesson Ferry Road to its intersection with the southeastern prolongation of the southwest line of Lot 8 in WALCHSHAUSER subdivision, a subdivision as per plat thereof recorded in Plat Book 54, Page 22, said Recorder's office; thence north 31 degrees 35 minutes west along said prolongation and along the southwest line of said Lot 8, a total distance of 169.18 feet to an angle point in said southwest line of Lot 8; thence along the northern line of property conveyed to Frank T. Huttig and wife, by deed recorded in Book 2944, Page 347, said Recorder's office, south 54 degrees 13 minutes west, 84.28 feet and north 73 degrees 22 minutes west, 84.71 feet to the easternmost corner of Lot 6 in said WALCHSHAUSER SUBDIVISION: thence south 28 degrees 26 minutes west, 60 feet along a southeast line of said Lot 6 to the southernmost corner of said Lot 6; thence southwestwardly across Walchshauser Drive to the easternmost corner of Lot 1 in said WALCHSHAUSER 6 SUBDIVISION; thence southwestwardly along the southeast line of Lots 1 and 2 in said subdivision to the southernmost corner of said Lot 2; thence southwestwardly in a straight line to the easternmost corner of WERNER SUBDIVISION, a subdivision as per plat thereof recorded in Plat Book 64, Page 10, St. Louis County Recorder's office; being in the northwestern line of property conveyed to George Warren Straub and wife, by deed recorded in Book 3697, Page 108, said Recorder's office; thence north 57 degrees 44 minutes west, 224.91 feet along the northeast line of said WERNER SUBDIVISION to the northernmost corner thereof; thence along the northwest line of said subdivision, south 41 degrees 01 minutes west, 303.52 feet; thence north 57 degrees 44 minutes west, parallel with, and 300.00 feet southwestwardly from (measured along the southeast line of Lavinia Road) the southwest line of property conveyed to James C. Madding and wife, by deed recorded in Book 3487, Page 442, St. Louis County Recorder's office, to the centerline of Lavinia Road; thence southwestwardly, southwardly and southeastwardly along the centerline of said Lavinia Road to the centerline of Tesson Ferry Road before relocation; thence southwestwardly along the centerline of Tesson Ferry Road before relocation, across Lindbergh Boulevard, to the point of beginning. Section Three. The Board finds that it is necessary for protection of the public health to begin at once the procedure to construct sewage facilities in the foregoing area. Accordingly, 7 an emergency exists within the meaning of the Plan and this Ordinance shall take effect immediately upon its enactment. The foregoing Ordinance was adopted February 9, 1972.
