AN ORDINANCE TO AMEND THE TIFFIN ZONING ORDINANCE TO ADD
DEFINITIONS FOR ACCESSORY YARDS, TO CHANGE THE TYPES OF
ACCESSORY USES AND STRUCTURES PERMITTED, AND TO MODIFY THE
MINIMUM YARD REQUIREMENTS FOR PRIVATE GARAGES.
BE IT ENACTED by the City Council of the City of Tiffin, Iowa:
Section I. Purpose: The purpose of this ordinance is to amend several sections of the Tiffin
Zoning Ordinance in order to more accurately reflect the correct yard requirements for accessory
uses and structures.
Section II. Amendment: Subsection 1.05(B) of Section 1 of the Tiffin Zoning Ordinance is
hereby amended to include the following boldfaced definitions (non-boldfaced definitions are
included below only to indicate the location of the new definitions):
Yard is an open space between a building and the adjoining lot lines unoccupied and unobstructed by any portion of a
structure. In measuring a yard to determine the width of a side yard, the depth of a front yard, or the depth of the rear yard,
use the minimum horizontal distance between the lot lines and the main building line.
Yard, Accessory: An accessory yard is an open space between an accessory building and the adjoining lot lines
unoccupied and unobstructed by any portion of a structure. In measuring a yard to determine the width of a side-
accessory yard, the depth of a front-accessory yard, or the depth of the rear-accessory yard, use the minimum
horizontal distance between the lot lines and the accessory building line.
Yard, Front: A front yard extends across the front of a lot and is measured by the minimum horizontal distance between the
street or place line and the main building other than uncovered steps. On corner lots, the front yard is parallel to the street
upon which the lot has its least dimension, except where owner elects tb front his building on a street parallel to the lot line
having the greater dimension.
Yard, Front-Accessory: A front-accessory yard extends across the front of a lot and is measured by the minimum
horizontal distance between the street or place line and the accessory building other than uncovered steps. On
corner lots,the front-accessory yard is parallel to the'street upon which the lot has its least dimension, except where
owner elects to front his building on a street parallel to the lot line having the greater dimension.
Yard, Rear: A rear yard extends across the rear of a lot and is the required minimum horizontal distance between the rear lot
line and the rear of the main building,line other than uncovered steps. In all lots,the rear yard is in the rear of the front yard.
Yard, Rear-Accessory: A rear-accessory yard extends across the rear of a lot and is the required minimum horizontal
distance between the rear lot line and the rear of the accessory building line other than uncovered steps. In all lots
with accessory buildings,the rear-accessory yard is in the rear of the front-accessory yard.
Yard, Side: A yard between the main building line and the side line of the lot, and extending from the required front yard to the
required rear yard, and being the minimum horizontal distance between a side lot line and the side of the main building line or
any projections of uncovered steps.
Yard, Side-Accessory: An accessory yard between the accessory building line and the side line of the lot, and
extending from the required front-accessory yard to the required rear-accessory yard, and being the minimum
horizontal distance between a side lot line and the side of the accessory building line or any projections of
uncovered steps.
Section III. Amendment: Subsection R-1A, R-1B, R-1C.03 of Section 3 of the Tiffin
Zoning Ordinance is replaced with the following:

.03 ACCESSORY USES AND STRUCTURES PERMITTED
The following uses and structures,accessory to a principal permitted use or a special exception use,are permitted
subject to the provisions of Section 9.05:
1. Private garages, only when an attached garage does not exist.
2. Private swimming pools
3. Private greenhouses not operated for commercial purposes
4. Garden sheds
5. Accessory uses or structures according to the provisions of Section 9.05
6. Temporary uses or structures used in conjunction with construction work;
provided however,the buildings comply with the provisions of Section 9.21.
Section IV. Amendment: Tables R1A, R1B, and R1C of Section 3 of the Tiffin Zoning
Ordinance are hereby replaced with the following:

Section V. Amendment: Subsection 9.05 of Section 9 of the Tiffin Zoning Ordinance is
hereby replaced with the following:
9.05 "ACCESSORY BUILDINGS AND STRUCTURES
No accessory building or structure shall be erected more than 120 days prior to the time of completion of the
construction or establishment of the principal structure or use where it is accessory. Accessory buildings and
structures are limited to fifteen (15) feet in height and must be at least five feet from any main building or property
line. No accessory building or structure may be erected in any yard other than rear yard and it must occupy less than
thirty percent(30%)of the required rear yard, except for private garage,which may occupy up to 60%of the required
rear yard. Private garages must meet minimum principal structure front, side, and rear yard requirements. Only one
accessory building is permitted per residence in residential districts.
Section VI. Repealer. All ordinances or parts of ordinance in conflict with the provisions of
this Ordinance are hereby repealed.
Section VII. Severability Clause. If any section, provision or part of this ordinance shall be
adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance
as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
Section VIII. When Effective. This ordinance shall be in effect after its final passage,
approval, and posting as provided by law.
On the 26th day of June 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2013-333, and moved that it be given its first
reading. The motion was seconded by Councilperson Kahler.
Ayes: Kahler, Ryan, Bartels, Phillips
Nays: Upton
Four members of the Council being present and hiving voted "Aye", Mayor Steve Berner declared
the motion carried, and Ordinance No. 2013-333, was read the first time, discussed, and placed on
record.
On the 10th day of July 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Ryan introduced Ordinance No. 2013-333, and moved that it be given its second
reading. The motion was seconded by Councilperson Kahler.

Nays: None.

Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared
the motion carried, and Ordinance No. 2013-333, was read the second time and discussed and
placed on record.
On the 24th day of July 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Kahler introduced Ordinance No. 2013-333, and moved that it be given its third
, and last reading. The motion was seconded by Councilperson Ryan.
Ayes: Kahler, Ryan, Bartels, Upton, Phillips
Nays: None
Five members of the Council being present and having voted "Aye", Mayor Steve Berner declared
the motion carried, and the ordinance was passed and adopted.
Whereupon the Mayor declared that Ordinance No. 2013-333 be adopted and signified his
approval of same by fixing his signature thereto. Passed by the Council on the 24th day of July 2013
and approved by the Mayor on the 25th day of July 2013.
