AN ORDINANCE, authorizing the Executive Director and
the Secretary-Treasurer of The Metropolitan St. Louis Sewer
District to purchase from the owner thereof certain real property
in St. Louis County, Missouri, to be used to facilitate the
operation of the Coldwater Creek Sewage Treatment Plant, and
provide for the possible future expansion of said plant,
prescribing terms, and containing an emergency clause.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and the
Secretary-Treasurer of the District are hereby authorized to
purchase from the owner thereof, the following real property in
St. Louis County, Missouri, to be used to facilitate the operation
of the Coldwater Creek Sewage Treatment Plant, and provide for the
possible future expansion of said plant, at a price not to exceed
Ten Thousand Dollars ($10,000.00), said property to be free of all
encumbrances, said property described as follows:
A tract of land situated in U.S. Survey 104, T47N, R7E,
St. Louis County, Mo., containing approximately 9.67 acres, and
described as beginning in the East line of said U.S. Survey 104,
distant 332.33' North of the Southeast corner of said U.S. Survey,
being at the Northeast corner of a 5.16 acre tract formerly of
Edward Hebrock; thence S.82Ε 41'W., 366' to the centerline of
Coldwater Creek; thence upstream on said centerline, following the
meanders of said creek, to the West line of a 27.20 acre tract
described in deed recorded in Bk. 531, Pg. 208 of the City (former
County) of St. Louis, Mo., Recorder's Office; thence North along
said West line to the Southwest corner of a 7 acre tract conveyed
to Carl Fricke by deed recorded in Bk. 534, Pg. 129, said City
Recorder's office; thence East and parallel to the North line of
said 27.20 acre tract, 438.10' to the Southeast corner of said 7
acre tract; thence North along the East line of said 7 acre tract
to a point exactly 396.00' South of the North line of the original
27.20 acre tract; thence East and parallel to the North line of
said tract, 330'∀ to the East line of said U.S. Survey 104;
thence South along said Survey line, 815.10'∀ to the beginning,
containing 11.04 acres∀; EXCEPTING THEREFROM the 1.37 acres ∀
conveyed to The Metropolitan St. Louis Sewer District by deed
recorded in Bk. 4860, Pg. 398, St. Louis County Recorder's office.
Section Two. Upon the execution and delivery to them
by said owner of a Warranty Deed in proper form, being free from
liens and encumbrances, conveying title to the said land to The
Metropolitan St. Louis Sewer District, the Executive Director and
the Secretary-Treasurer shall be and are hereby authorized and
directed to pay to said owner, for the said land, the total sum of
Ten Thousand Dollars ($10,000.00).
Section Three. An emergency exists within the meaning
of the Plan, in order that advantage might be taken of favorable
financial conditions of acquisition, thus necessitating purchase
without delay. Accordingly, this Ordinance shall take effect
immediately upon its enactment.
The foregoing Ordinance was adopted October 18, 1972.
