AN ORDINANCE to accept the terms and provisions of
Ordinance No. 72-108 of the City of Bridgeton, Missouri, passed
and approved November 15, 1972, which Ordinance grants for a
period of thirty (30) years to The Metropolitan St. Louis Sewer
District, a municipal corporation, its successors and assigns, the
right, permission and authority to construct, reconstruct,
excavate for, place, maintain, operate and use a sanitary sewage
treatment plant and system, together with all plants, trunks,
lines, facilities and all necessary or appropriate appurtenances
and appliances in connection therewith, in, along, across and
under the streets, roads, alleys, sidewalks, squares and other
public places in the City of Bridgeton, for the purpose of
furnishing sanitary sewer service within and through said City,
prescribing the terms and conditions of such grant, and imposing
certain obligations upon the Grantee, its successors and assigns,
successively, in connection therewith.
WHEREAS, prior to January 1, 1973, the District became
the owner of the sanitary sewer system formerly of the Bonfils
Service Corporation, which system largely serves the area of the
City of Bridgeton lying outside the boundaries of the District;
and
WHEREAS, the City of Bridgeton is desirous of having
the sanitary sewer service for its citizens, and the District, in
order to provide that service, wishes certain aid from the City,
which the City has extended by its Ordinance No. 72-108;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Metropolitan St. Louis Sewer
District hereby accepts the privileges and obligations extended by
aforesaid Ordinance No. 72-108 of the City of Bridgeton, passed
and approved November 15, 1972, which privileges include, but are
not limited to, an exclusive franchise to own and operate a
sanitary sewer system in the City and to use its public streets
and places for sewer purposes, in return for which the District
hereby agrees to furnish such sanitary sewer service and to hold
the City of Bridgeton harmless from all liability imposed upon the
City on account of injury or damage to person or property caused
by the District in the course of or in connection with any
construction, reconstruction, excavation, placing, maintenance,
operation or use of any plants, sewer lines or other facilities or
equipment in, along, across or under any of the streets, roads,
alleys, sidewalks, squares or other public places in the City in
the exercise of any of the rights and privileges conferred by said
Ordinance No. 72-108. The foregoing Ordinance was adopted January 10, 1973.
