HomeMy Public PortalAbout02383 O R D I N A N C E NO. 2383 AN ORDINANCE authorizing and directing the Executive Director to amend an Underground Gas Storage Easement Deed dated March 31, 1959 and recorded in Book 4061, Page 571, in the Office of the Recorder of Deeds St. Louis County, Missouri. WHEREAS, The Metropolitan St. Louis Sewer District owns the following described land in St. Louis County, Missouri: A tract of land in U.S. Survey 210, Township 47 North Range 7 East, and described as: Beginning at an iron pipe set in the West line of said Survey 210, distant South 4 degrees 39 minutes East 1528.19 feet from its intersection with the South line of Missouri Highway 140; thence South 88 degrees 31 minutes East 668.66 feet to an iron pipe; thence South 8 degrees 03 minutes East 1014.00 feet to a point in the centerline of Coldwater Creek Drainage Ditch 100 feet wide; thence along the centerline of said Ditch, North 88 degrees 31 minutes West 581.65 feet to a point; thence along the centerline of the Old Coldwater Creek the following courses and distances, North 22 degrees 34 minutes East 167.70 feet, North 66 degrees 30 minutes West 163.28 feet and North 35 degrees 24-1 2 minutes West 155.21 feet to a point in the West line of said Survey 210; thence along the West line of said Survey 210, North 4 degrees 39 minutes West 661.97 feet to the point of beginning, containing 15.048 acres, according to a survey executed by Pitzman's Company of Surveyors and Engineers on the 16th day of May 1962. Including all right, title and interest of Landowners in and under Coldwater Creek Drainage Ditch and in and under roadways, public and private, as established and used. ;and WHEREAS, in an Underground Gas Storage Easement Deed dated March 31, 1959 and recorded in Book 4061, Page 571, in the Office of the Recorder of Deeds, St. Louis County, Missouri, The Metropolitan St. Louis Sewer District granted to the Laclede Gas Company the exclusive right, privilege and easement to utilize for the underground storage of natural gas or manufactured gas, or any combination or mixture thereof, or other gases or vapors, any and all geological strata and formations 1000 feet or more below the above described land; and WHEREAS, The Metropolitan St. Louis Sewer District and the Laclede Gas Company have agreed to amend said Underground Gas Storage Easement Deed to include the use of the Trenton limestone and its cap rock, the Maquoketa shale, for the underground storage of gas, and further that the right of use granted with respect to said land shall extend to any and all strata and formations thereof underlying said land below the top of the Maquoketa formation. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Underground Gas Storage Easement Deed dated March 31, 1959 and recorded in Book 4061, Page 571, in the Office of the Recorder of Deeds, St. Louis County, Missouri, granted to the Laclede Gas Company from The Metropolitan St. Louis Sewer District, is hereby amended to include the use of the Trenton limestone and its cap rock, the Maquoketa shale, for the underground storage of gas, and further that the right of use granted with respect to said land shall extend to any and all strata and formations thereof underlying said land below the top of the Maquoketa formation. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted February 15, 1973.
