HomeMy Public PortalAbout02384 O R D I N A N C E NO. 2384 AN ORDINANCE authorizing and directing the Executive Director to amend a Gas and Oil Storage Lease dated September 1, 1955 and recorded in Book 3484, Page 457, in the Office of the Recorder of Deeds, St. Louis County, Missouri. WHEREAS, The Metropolitan St. Louis Sewer District owns the following described land in St. Louis County, Missouri: A tract of land in United States Survey 210, Township 47 North, Range 7 East, St. Louis County, Missouri, and more particularly described as follows: Beginning at the point of intersection of the Eastern line of property described in deed to Vernon Eugene Ryther and wife, recorded in Book 3652, Page 259 St. Louis County Recorder's Office, with the centerline of Coldwater Creek Drainage Ditch Right of Way, 100 feet wide; thence South 88 degrees 31 minutes East, 823.36 feet along the centerline of said Coldwater Creek Drainage Ditch Right of Way, to a point in the centerline of former Coldwater Creek; thence along the meanders of said former Coldwater Creek the following courses and distances; North 15 degrees 31 minutes East 36.08 feet; North 17 degrees 26 minutes East 89.04 feet; North 73 degrees 03 minutes East 68.90 feet; South 73 degrees 12 minutes East 108.82 feet; South 35 degrees 45 minutes East 97.68 feet and South 35 degrees 35 minutes East 43.34 feet to a point in the centerline of said Coldwater Creek Drainage Ditch Right of Way; thence South 89 degrees 27 minutes East 86.86 feet along said centerline to a point in the Eastern line of property described in deed to August Niehaus and wife, recorded in Book 2888, Page 526 St. Louis County Recorder's Office; thence North 18 degrees 40-1/2 minutes West, 1062.36 feet along the Eastern line of said Niehaus property to a point; thence North 88 degrees 31 minutes West 1000.82 feet to a point in the Eastern line of said Ryther property; thence South 8 degrees 03 minutes East 1014.00 feet along the Eastern line of said Ryther property to the centerline of said Coldwater Creek Drainage Ditch Right of Way, and the point of beginning, and containing 24.592 acres; according to a survey by Pitzman's Company of Surveyors and Engineers, dated May 16, 1962. Including all right, title and interest of Landowners in and under Coldwater Creek Drainage Ditch and in and under roadways, public and private, as established and used. ;and WHEREAS, in a Gas and Oil Storage Lease dated September 1, 1955 and recorded in Book 3484, Page 457, in the Office of the Recorder of Deeds, St. Louis County, Missouri, The Metropolitan St. Louis Sewer District granted to the Osage Gas Company the exclusive right and privilege to introduce oil, natural gas or other gases or vapors into geological strata underlying the above described land at a depth of more than 1000 feet; and WHEREAS, all of the interests of the Osage Gas Company in the aforesaid Gas and Oil Storage Lease were assigned to the Laclede Gas Company by an instrument dated September 7, 1955 and recorded in Book 3484, Page 463, in the Office of the Recorder of Deeds, St. Louis County, Missouri; and WHEREAS, The Metropolitan St. Louis Sewer District and the Laclede Gas Company have agreed to amend said Gas and Oil Storage Lease to include the use of the Trenton limestone and its cap rock, the Maquoketa shale, for the underground storage of gas, and further, that the right of use granted with respect to said land shall extend to any and all strata and formations thereof underlying said land below the top of the Maquoketa formation. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Gas and Oil Storage Lease dated September 1, 1955 and recorded in Book 3484, Page 457, in the Office of the Recorder of Deeds, St. Louis County, Missouri, granted to the Osage Gas Company from The Metropolitan St. Louis Sewer District and assigned to the Laclede Gas Company on September 7, 1955, is hereby amended to include the use of the 3 Trenton limestone and its cap rock, the Maquoketa shale, for the underground storage of gas, and further, that the right of use granted with respect to said land shall extend to any and all strata and formations thereof underlying said land below the top of the Maquoketa formation. Section Two. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted February 15, 1973.
