HomeMy Public PortalAboutOrdinances-2013-334 CITY OF TIFFIN ORDINANCE NO. 2013-334 AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF TIFFIN, IOWA, FROM R-1A TO R-1E AND FROM P-1 TO R-1E FOR CERTAIN PROPERTY KNOWN AS HICKORY.KNOLL, TIFFIN, JOHNSON COUNTY, IOWA, AND AS LEGALLY DESCRIBED HEREIN BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA: Section 1. Purpose. The purpose of this ordinance is to amend the official zoning map,of the City of Tiffin, Iowa, concerning property locally described as Hickory Knoll, Tiffin, Johnson County, Iowa, attached hereto and incorporated herein. Section :2. Amendment. The following legally described property (5.0 acres): eiT COMMENCING AT THE NORTHEAST CORNER OF THE NORTHEAST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER OF SECTION 34, TOWNSHIP 80 NORTH, RANGE 7 WEST, OF THE FIFTH PRINCIPAL MERIDIAN, JOHNSON COUNTY, IOWA;, THENCE S01°38'53"E, ALONG THE EAST LINE OF SAID NORTHEAST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER, 461.4 FEET, TO THE POINT OF BEGINNING; THENCE CONTINUING; S01°38'53"E, ALONG SAID EAST LINE, 462.1 FEET, TO THE NORTH LINE OF THE SOUTH 24 RODS OF SAID NORTHEAST ONE-QUARTER OF THE NORTHWEST ONE-QUARTER; THENCE S89°31'26"W, ALONG SAID NORTH LINE, 477.7 FEET; THENCE N00°57'07"W, 462.0 FEET; THENCE N89°31'26"E,,472.1 FEET, TO SAID POINT OF BEGINNING,.CONTAINING 5.0 ACRES, MORE OR LESS, AND SUBJECT TO EASEMENTS AND RESTRICTIONS OF RECORD. shall be changed from zoning classification R-1A to R-1 E, Residential District Estate Family, and further, that the official zoning map of the City be amended to reflect the change described herein. Section 3. Amendment. Section 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this Ordinance are hereby repealed. Section 5. Severability. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section,' provision, or part thereof not adjudged invalid or unconstitutional. Section 6. Effective Date. This ordinance shall be in effect after its final passage, approval, and posting as provided by law. On the 24th day of July 2013,'at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Kahler introduced Ordinance No. 2013-334, and moved that it be given its first reading. The motion was seconded by Councilperson Bartels. Ayes: Kahler, Ryan, Bartels, Upton Nays: Phillips Four members of the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-334, was read the first time, discussed, and placed On record. Ori the 14th day of August 2013, at a regular meeting of the Tiffin City Council, Tiffin, Iowa, Councilperson Ryan introduced Ordinance No. 2013-334, and moved that it be given its second reading. The motion was seconded by Councilperson Kahler. Ayes: Kahler, Ryan, Bartels, Upton Nays: Phillips Four members of the Council being present and having voted'"Aye", Mayor Steve Berner declared the motion carried, and Ordinance No. 2013-334, was read the second time and discussed and"placed on record. The motion was seconded by Councilperson Upton. Ayes: Kahler, Ryan, Bartels, Upton Nays: Phillips Four members of'the Council being present and having voted "Aye", Mayor Steve Berner declared the motion carried, and the ordinance was passed and adopted. Whereupon the Mayor declared that Ordinance No. 2013-334 be adopted and signified his approval of same by fixing his signature thereto. Purpose. The purpose of this ordinance is to amend the official zoning map of;the City of Tiffin, Iowa, concerning property locally described as Hickory Knoll, Tiffin, Johnson County, Iowa, attached hereto and incorporated herein. The Planned Area Development was requested by applicant in order to have certain design standard,and zoning district; variances approved. Applicant has identified the benefits derived from having such variances approved. The variances are attached. Section 2. Amendment. The following legally described property: All that part'of the Southeast Quarter of the Southwest Quarter of Section Twenty-Seven(27) 8_; lying South of the right of way of the Chicago, Rock Island and Pacific Railroad Company; also the Northeast Quarter of the Northwest Quarter of Section Thirty-Four(34) except the south 24 rods thereof; all in Township Eighty(80)North, Range Seven(7) West of the 5th P.M. shall be designated a Planned Area Development.
