HomeMy Public PortalAbout02419 O R D I N A N C E NO. 2419 AN ORDINANCE authorizing and directing the Executive Director to grant to The Procter and Gamble Manufacturing Company (hereinafter called "P & G") an easement across certain property of The Metropolitan St. Louis Sewer District for the purpose of railroad access to land owned by and further granting to P & G the use of railroad tracks laid in accordance with an easement granted to The Metropolitan St. Louis Sewer District by the City of St. Louis, Missouri. WHEREAS, P & G desires an easement over and across certain land owned by The Metropolitan St. Louis Sewer District hereinafter described, and the District has no objection to this easement, and WHEREAS, P & G desires the use of certain railroad tracks laid in accordance with an easement granted to The Metropolitan St. Louis Sewer District by the City of St. Louis, Missouri, and the District and the City of St. Louis, Missouri respectively have no objections to said usage; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to The Procter and Gamble Manufacturing Company an easement for the purpose of railroad access, across property owned by the District in the City of St. Louis, Missouri, such property and easement being described as follows: A parcel of land in Block 2450 of the City of St. Louis, Missouri, being a part of PARCEL "A" of Bissell's Point Water Works Property which was conveyed to The Procter & Gamble Manufacturing Company by deed made by virtue of and pursuant to the authority conferred upon the Mayor and Comptroller of the City of St. Louis under Ordinance Number 52217, approved December 23, 1963, being more particularly described as follows: Commencing at a stone at the intersection of the south line of East Grand Avenue (100 feet wide) and the east line of the Wabash Railroad Company right-of-way; Thence in a southerly direction along the east right-of-way line of the Wabash Railroad Company 329.98 feet to a point of intersection of the easterly right-of-way line of the Wabash Railroad Company with the northeasterly right-of-way line of the Terminal Railroad Association; Thence deflecting to the left 41Ε 21' 09" and with the northeasterly right-of-way line of the Terminal Railroad Association 218.22 feet to an old iron bar; Thence deflecting to the left 8Ε 13' and continuing with the northeasterly right-of-way line of the Terminal Railroad Association 104.45 feet to the true point of beginning; Thence deflecting 90Ε to the left, 5 feet in a northeasterly direction to a point; Thence deflecting 88Ε 09' 04" to the right, 309.57 feet to a point in the southeasterly line of the aforementioned PARCEL "A"; Thence deflecting 89Ε 39' 52" to the right and with said southeasterly line of said PARCEL "A" 15 feet to a point on the northeasterly right-of-way line of the Terminal Railroad Association property; Thence deflecting 92Ε 11' 04" to the right and with the northeasterly right-of-way line of the Terminal Railroad Association in a northwesterly direction 310 feet to the point of beginning; Section Two. The Metropolitan St. Louis Sewer District, with the approval of the City of St. Louis, Missouri, does hereby grant to The Procter and Gamble Manufacturing Company the right to use certain railroad tracks laid in accordance with an easement granted to The Metropolitan St. Louis Sewer District 3 by the City of St. Louis, Missouri, such easement being described as follows: "A strip of land through the southern portion of property belonging to the City of St. Louis, said strip being bounded on the east by property belonging to The Metropolitan St. Louis Sewer District, bounded on the south by the right-of-way of the St. Louis Merchants Bridge Terminal Railroad Company, bounded on the west by the property of Procter & Gamble Company and bounded on the north by a line, said line beginning at a point on the east property line of Procter & Gamble Company, which is the west line of the property of the City of St. Louis, said point being twenty (20') feet north measured along said line from its intersection with the north line of the railroad right-of-way of the St. Louis Merchants Bridge Terminal Railroad Company, then eastwardly and parallel to said north line of the railroad right-of-way, a distance of 270 feet to a point; thence northeastwardly to a point on the east line of property belonging to the City of St. Louis which is the west line of property belonging to The Metropolitan St. Louis Sewer District, said point being 100 feet measured along said property line north from its intersection with the north line of said railroad right-of-way. Said easement consisting of 0.51 acres." Section Three. The Executive Director is hereby authorized and directed to execute in behalf of the District an instrument giving effect to Sections One and Two hereof. 4 The foregoing Ordinance was adopted April 19, 1973.
