Home My Public Portal About02457 O R D I N A N C E NO. 2457 AN ORDINANCE vacating a portion of sewer easements in U.S. Survey 2675, Township 45 North, Range 5 East, Frontenac, St. Louis County, Missouri, and authorizing the encroachment of a building over another sewer easement in the same tract of land. WHEREAS, the owner of the subject property has requested this District to vacate portions of the subject easements and the District has no further need for such easements, and WHEREAS, the owner of the subject property has requested this District to permit the encroachment of a building and appurtenances across a sewer easement and examination and survey of such sewer and of said structure shows that it will not damage the existing sewer, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The following described portion of sewer easements are hereby vacated, to wit: 1. The sewer easement, ten (10) feet wide, granted to The Metropolitan St. Louis Sewer District on the 2nd day of June, 1958 by King Bros. Motel, Inc. according to the deed recorded in Book 3936, Page 446 of the St. Louis County Records, excepting therefrom the western fifteen (15) feet thereof. 2. The sewer easement, ten (10) feet wide, granted to The Metropolitan St. Louis Sewer District on the 19th day of February, 1959 by King Bros. Motel, Inc. according to the deed recorded in Book 4053, Page 194 of the St. Louis County Records, excepting therefrom the western fifteen (15) feet and the most northern one-hundred sixty (160) feet thereof. Section Two. The Executive Director is hereby authorized and directed to license the encroachment of a building over the sewer easement granted to The Metropolitan St. Louis Sewer District by deed recorded in Book 3596, Page 308 of the St. Louis County Records, provided the right of the District to use the easement strip is preserved and the District is indemnified against liability, loss or damage from such encroachment. 3 The foregoing Ordinance was adopted July 26, 1973.
