HomeMy Public PortalAbout02511 O R D I N A N C E NO. 2511 AN ORDINANCE, declaring the necessity for the acquisition of easements within certain existing property within The Metropolitan St. Louis Sewer District, for the purpose of permitting construction of sewers therein to serve the needs of residents of the area and authorizing the acquisition of such easements by purchase or by the institution of condemnation proceedings. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of St. Louis County, Missouri, such project area known as Meacham Park Storm Sewer (S-751) wherein there live and work numerous people; and WHEREAS, stormwater sewage gathered from such area has and will have no alternative means of disposition to crossing said property and does and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing storm sewers over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and relieve insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise, easements for the use of a sewer line as hereinafter set forth, together with temporary easements adjacent to the right-of-way as obtained for working room during the construction period, and the right of ingress and egress over the premises sought to be condemned for access to such easements, said permanent and temporary easements being more particularly described as follows: A permanent easement 10 feet wide over property now or formerly of Maria Emma Gloor and Adolph Gloor, Jr., which easement is more particularly described as: A strip of land 10 feet wide by 25 feet long traversing Lot 29 in Block 9 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as being the south 10 feet of the north 35 feet of said Lot 29. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: Strips of land 15 feet in width on each side of, and immediately adjacent to, the hereinabove described 10 feet wide permanent easement, and further described as being the south 15 feet of the north 50 feet and the south 15 feet of the north 25 feet of said Lot 29. A permanent easement 10 feet wide over property now or formerly of Mac and Frankie McAllister, which easement is more 3 particularly described as: A strip of land 10 feet wide by 50 feet long traversing Lots 30 and 31 in Block 9 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and being described as the south 10 feet of the north 35 feet of said Lots 30 and 31. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: (1) A strip of land 15 feet in width on the north side of, and immediately adjacent to the hereinabove described 10 feet wide permanent easement and further described as being the south 15 feet of the north 25 feet of said Lots 30 and 31. (2) Strips of land 15 feet and 20 feet wide on the south side of, and immediately adjacent to, the hereinabove described 10 feet wide permanent easement, and further described as the south 15 feet of the north 50 feet of said Lot 30 and the south 20 feet of the north 55 feet of said Lot 31. A permanent easement over property now or formerly of Catherine Crawford, which easement is more particularly described as: A triangular parcel of land in the southwest corner of Lot 20 4 in Block 18 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as: Beginning at the southwest corner of said Lot 20; thence north 20.62 feet along the west line of said lot; thence southeast in a straight line 21.25 feet to a point in the south line of said Lot 20 distant 5.15 feet east there along from its southwest corner; and thence 5.15 feet west along the south line of said Lot 20 to the beginning. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The west 10 feet of said Lot 20; EXCEPTING THEREFROM the triangular-shaped permanent easement hereinabove described. A permanent easement over property now or formerly of Thomas Snow, which easement is more particularly described as: A triangular parcel of land in the southwest corner of Lot 34 in Block 18 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as: Beginning at the southwest corner of said Lot 34; thence north 20 feet along the west line of said Lot 34; thence southeast in a 5 straight line 22.36 feet to a point in the north line of Chicago St., 40 feet wide, distant 10.00 feet east of the point of beginning; and thence west along said street line, 10.00 feet to the beginning. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The southwest half of said Lot 34, bounded on the south and west by the south and west lines, respectively, of said lot and on the northeast by a straight line between the northwest and southeast corners of said Lot 34; EXCEPTING THEREFROM the triangular-shaped permanent easement hereinabove described. Permanent easements 6 feet and 10 feet wide over property now or formerly of Delia Dinsmore, which easements are more particularly described as: (1) A strip of land 6 feet wide by 50 feet long across Lots 28 and 29 in Block 19 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as being the south 6 feet of said Lots 28 and 29. (2) A strip of land 10 feet wide traversing Lots 29 and 28 in Block 18 of said Meacham Park, the centerline of which 10 feet wide permanent easement is described as: 6 Beginning in the west line of said Lot 29 distant south 34.31 feet along said west line from the northwest corner of said lot; thence southeast 36.57 feet along a line deflecting 20Ε 33 minutes eastwardly from the west line of said Lot 29, to a point of curve; thence southeasterly along a curve to the left, having a radius of 50.00 feet, to its terminus in the north line of the 6 feet wide permanent easement described in (1), above; said 10 feet wide easement being bounded on the northwest by the west line of said Lot 29 and on the southeast by the north line of the 6 feet wide permanent easement described in (1), above. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: All of Lots 28 and 29 in Block 19 of said Meacham Park, EXCEPTING THEREFROM those parts thereof embraced within the permanent easements described in (1) and (2), hereinabove. A permanent easement 10 feet wide over property now or formerly of Carrie Copeland, which easement is more particularly described as follows: A strip of land 10 feet wide traversing Lot 44 in Block 20 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, 7 Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the west line of said Lot 44 distant 10 feet south of its northwest corner; thence northeastwardly on a curve, with a radius of 75 feet to the left, 14.16 feet to its terminus in the north line of said Lot 44 distant 10 feet east of its northwest corner; said 10 feet wide permanent easement being bounded on the southwest and northeast by the west and north lines, respectively, of said Lot 44. A temporary easement, during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The north 38 feet of Lot 44 in Block 20 of said Meacham Park, EXCEPTING THEREFROM that part thereof embraced within the 10 feet wide permanent easement described hereinabove. A permanent easement 9 feet wide over property now or formerly of William Scheller, which easement is more particularly described as follows: A strip of land 9 feet wide by 100 feet long traversing Lots 38-41, inclusive, in Block 30 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and being 8 described as the south 9 feet of said Lots 38-41, inclusive. A temporary easement, during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The north 31 feet of the south 40 feet of said Lots 38-41, inclusive. A permanent easement 10 feet wide over property now or formerly of Sarah Campbell, which easement is more particularly described as: A strip of land 10 feet wide by a centerline length of 94.34 feet, traversing Lots 7-9, inclusive, in Block 38 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning at the northeast corner of said Lot 7; thence southeastwardly in a straight line 94.34 feet to its terminus in the east line of said Lot 9 distant 20 feet north therealong from the southeast corner of said Lot 9; said 10 feet wide easement being bounded on the northwest by the south line of Alsobrook Street, 40 feet wide, and on the southeast by the east line of said Lot 9. Temporary easements during original construction of sewer 9 facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: All of the north 20 feet of said Lot 7 and all of said Lots 8 and 9; EXCEPTING THEREFROM said Lots 7, 8 and 9 those parts thereof embraced within the 10 feet wide permanent easement described hereinabove. A permanent easement 10 feet wide over property now or formerly of Robert Rul, which easement is more particularly described as: A strip of land 10 feet wide by a centerline length of 94.34 feet, traversing Lots 33 and 34 in Block 38 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning at the southeast corner of said Lot 33; thence northwestwardly in a straight line 94.34 feet to its terminus in the west line of said Lot 34 distant 20 feet south therealong from the northwest corner of said Lot 34; said 10 feet wide easement being bounded on the southeast by the north line of Electric Street, 40 feet wide, and by the east line of said Lot 33, and on the northwest by the west line of said Lot 34. Louis, which easement is more particularly described as: A strip of land 10 feet wide by a centerline length of 23.58 feet traversing Lot 35 in Block 38 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the east line of said Lot 35 distant 20 feet south therealong from the northeast corner of said Lot 35; thence northwestwardly in a straight line 23.58 feet to its terminus in the north line of said Lot 35 distant 11 12.50 feet east therealong from the northwest corner of Lot 35; said 10 feet wide easement being bounded on the southeast and northwest by the east and north lines, respectively, of said Lot 35. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The north 40 feet of said Lot 35; EXCEPTING THEREFROM that part thereof embraced within the 10 feet wide permanent easement hereinabove described. A permanent easement 10 feet wide over property now or formerly of Sanford Ming, which easement is more particularly described as follows: A strip of land 10 feet wide by a centerline length of 35.85 feet traversing Lots 29 and 30 in Block 5 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the north line of Electric Street, 40 feet wide, distant 25.40 feet eastwardly therealong from the southwest corner of said Lot 30; thence northwestwardly on a curve with a radius of 50 feet to the right, 35.85 feet to its terminus in the west line of said Lot 30, distant north 24.21 feet therealong 12 from the southwest corner of said Lot 30; said 10 feet wide easement being bounded on the southeast by the north line of Electric Street, 40 feet wide, and on the northwest by the west line of said Lot 30. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: Beginning at the intersection of the north line of Electric Street, 40 feet wide, with the west line of Shelby Street, 40 feet wide; thence west 50 feet along the north line of said Electric Street to the southwest corner of said Lot 30; thence north 40 feet along the west line of Lot 30; and thence southeastwardly in a straight line 64.03 feet to the beginning; EXCEPTING THEREFROM that part thereof embraced within the 10 feet wide permanent easement hereinabove described. A permanent easement over property now or formerly of Hernandes Schuler, which easement is more particularly described as: A strip of land 10 feet wide by 50 feet long, traversing Lots 38 and 39 in Block 9 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as being the south 10 feet of the north 35 feet of said Lots 38 and 39. 13 Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: The north 50 feet of said Lots 38 and 39; EXCEPTING THEREFROM that part thereof embraced within the 10 feet wide permanent easement hereinabove described. A permanent easement 10 feet wide over property now or formerly of Marie Krumm, et al., which easement is more particularly described as follows: A strip of land 10 feet wide by a centerline length of 50.35 feet traversing Lots 44 and 45 in Block 9 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the east line of said Lot 44 distant 30 feet southwardly therealong from the northeast corner of said Lot 44; thence west 32.78 feet, parallel to the north line of Lot 44, to a point of curve; thence westwardly on a curve, with a radius of 50 feet to the left, 17.57 feet to its terminus in the west line of said Lot 45, distant south 33.06 feet therealong from the northwest corner of said Lot 45; said 10 feet wide easement being bounded on the east and west by the east line of said Lot 44 and the west line of said Lot 45, 14 respectively. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall 17 cease, which temporary easement is described as: A strip of land 10 feet in width, adjoining on the east the hereinabove described 5 feet wide permanent easement, and further described as being the east 10 feet of the west 20 feet of said Lot 30. A temporary easement during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easement is described as: The north 25 feet of said Lot 26; EXCEPTING THEREFROM the triangular-shaped permanent easement hereinabove described. 19 A permanent easement over property now or formerly of Hernandes Schuler, which easement is more particularly described as: A strip of land of irregular shape traversing Lots 29-35, inclusive, in Block 30 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, and described as: Beginning in the east line of said Lot 29, distant south therealong 4.78 feet from the northeast corner of said Lot 29; thence south 24.11 feet along the east line of Lot 29; thence southwest along a straight line, deflecting 56Ε 03 minutes westwardly from the last described course, 108.50 feet to an intersection with a line parallel with, and 10 feet east of the west line of said Lot 32; thence south along said parallel line, 10.52 feet to the south line of Lot 32, being the north line of Memphis Street, 40 feet wide; thence west along said street line, 85.00 feet to the southwest corner of said Lot 35; thence north 9.00 feet along the west line of Lot 35; thence east, parallel with Memphis Street, 19.45 feet to a point of curve; thence easterly 53.33 feet along a curve to the left, with a radius of 90.00 feet, to a point of tangency; thence northeast 126.91 feet in a straight line, parallel to the heretofore described course of length 108.50 feet, to the 20 beginning. A permanent easement 5.00 feet wide over property now or formerly of John E. A permanent easement 10 feet wide over property now or formerly of Stafac, Inc., which easement is more particularly described as: A strip of land 10 feet wide by a centerline length of 18.52 feet traversing Lot 8 in Block 9 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the north line of Handy Street, 40 feet wide, distant 14.59 feet west therealong from the southeast corner of said Lot 8; thence northeast in a straight line, 18.52 feet to its terminus in the east line of said Lot 8 distant 11.40 feet north therealong from the southeast corner of said Lot 8; said 10 feet wide easement being bounded on the southwest by the north line of said 23 Handy Street and on the northeast by the east line of said Lot 8. Temporary easements, during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: The east 30.00 feet of said Lot 8; EXCEPTING THEREFROM that part thereof embraced within the 10 feet wide permanent easement hereinabove described. A permanent easement over property now or formerly of Walter and Mary Margaret Kramer, which easement is more particularly described as: A strip of land 10 feet wide by a centerline length of 103.08 feet traversing Lot 35 in Block 18 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the north line of Chicago Street, 40 feet wide, at the southeast corner of said Lot 35; thence diagonally northwest across Lot 35 to its terminus at the northwest corner of said Lot 35; said 10 feet wide easement being bounded on the southeast by the south and east lines of said Lot 35 and on the northwest by the north and west lines of said Lot 35. Temporary easements during original construction of sewer 24 facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: All of said Lot 35; EXCEPTING THEREFROM that part there of embraced within the 10 feet wide permanent easement hereinabove described. A permanent easement over property now or formerly of Marc S. Kramer, which easement is more particularly described as follows: A strip of land 10 feet wide by a centerline length of 23.58 feet traversing Lot 10 in Block 38 of Meacham Park, a subdivision in St. Louis County, Missouri, as per plat thereof recorded in Plat Book 3, Page 33, St. Louis County, Missouri, Recorder's office, the centerline of which 10 feet wide strip is described as: Beginning in the south line of said Lot 10 distant 12.50 feet east therealong from the southwest corner of said Lot 10; thence northwest in a straight line 23.58 feet to a point in the west line of said Lot 10 distant 20 feet north therealong from the southwest corner of said Lot 10; said 10 feet wide easement being bounded on the southeast and the northwest by the south and west lines, respectively, of said Lot 10. Temporary easements during original construction of sewer facilities, after which all rights of the condemnor shall cease, which temporary easements are described as: The south 30 feet of said Lot 10; EXCEPTING THEREFROM that 25 part thereof embraced within the 10 feet wide permanent easement hereinabove described. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to acquire by purchase, if possible, subject to approval of the Board of Trustees, or to institute and prosecute an action in condemnation, as authorized by law, if necessary, to appropriate and acquire the aforesaid private property. Section Three. The immediate construction of sewers being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted January 9, 1974.
