AN ORDINANCE, authorizing and directing the Executive
Director and the Secretary-Treasurer, to make, execute and
deliver, and to attest, a contract between and among the City of
Berkeley, Missouri (Berkeley), St. Louis County, Missouri (County)
and The Metropolitan St. Louis Sewer District (District),
resolving a dispute concerning the construction on an outfall
storm sewer at certain points near Airport Road in Berkeley,
Missouri.
WHEREAS, a surface water problem exists in certain
areas of Airport Road in Berkeley, Missouri, and
WHEREAS, the County is responsible for the maintenance
of said road, and
WHEREAS, the District has jurisdiction over such
stormwater situations, and
WHEREAS, Berkeley has the authority to expend funds to
remedy said surface water problems,
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director is hereby
authorized to make, execute and deliver for and on behalf of the
District, and the Secretary-Treasurer is hereby authorized to
attest, a certain contract between and among the District, the
County and Berkeley in substantially the form presented therein,
which is attached hereto, whereby it is agreed that in return for
the payments of Ten Thousand Dollars ($10,000.00) from the County,
and Forty Thousand Dollars ($40,000.00) from Berkeley, said money
to be used for the purchase of materials, the District will
undertake construction of a storm sewer to remedy the
aforementioned stormwater problem. The foregoing Ordinance was adopted August 28, 1974.
