AN ORDINANCE, authorizing the Executive Director and the
Secretary-Treasurer of The Metropolitan St. Louis Sewer District to purchase
from the owners thereof certain real property in St. Louis County, Missouri,
for the expansion of the Sugar Creek Treatment Plant Facilities, with an
emergency clause.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE
METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. The Executive Director and the Secretary-Treasurer of
the District are hereby authorized to purchase from the owners thereof, the
following real property in St. Louis County, Missouri, for the expansion of the
Sugar Creek Treatment Plant Facilities at a price not to exceed One Hundred
Thirty-Eight Thousand Dollars ($138,000.00), said property to be free of all
encumbrances, said property described as follows:
TRACT I: A tract of land in Sections 3 and 4, T44N, R5E, in St. Louis
County, Missouri, and being more particularly described as follows,
to-wit: Beginning at an iron pipe at the intersection of the
eastern line of Dougherty Ferry Road, 40 feet wide (assumed) and as
now traveled, and the northern line of a 5.00 acre tract conveyed
to The Metropolitan St. Louis Sewer District by deed recorded in
Deed Book 4226, Page 393 of the St. Louis County Records; thence
along the eastern and southern lines of Dougherty Ferry Road the
following courses and distances; N. 13Ε 01' 50" E., 266.80 feet to
a point; N. 12Ε 30' 40" E., 23.61 feet to a point of curve; thence
northeastwardly along an arc of a curve to the right having a
radius of 191.79 feet a distance of 169.21 feet to a point of
tangent; thence N. 630 03' 20" E., 59.14 feet to a point; thence N.
66Ε 59' 35" EΕ., 68.08 feet to a point of curve; thence
northeastwardly along an arc of a curve to the right having a
radius of 476.67 feet a distance of 194.19 feet to a point on the
western line of Dougherty Ferry Road, as widened; thence along the
western and southern lines of Dougherty Ferry Road, as widened, the
following courses and distances; S. 6Ε 18' 10" W., 20.0 feet to a
point; S. 72Ε 22' 50" E., 152.97 feet to a point; S. 77Ε 48' 50"
E., 100.50 feet to a point; S. 81Ε 04' E., 213.80 feet to a point;
S. 6Ε 18' 10" W., 20 feet to a point; N. 89Ε 11' E., 313.91 feet to
a point; thence along the southwestern and western lines of
Highland Avenue, as widened, the following courses and distances;
S. 55Ε 54' 10" E., 168.49 feet to a point and S. 25Ε 23' 20" E.,
233.81 feet to a point on the northern line of a tract of land
conveyed to The Metropolitan St. Louis Sewer District by deed
recorded in Deed Book 4440, Page 409 of the St. Louis County
Records; thence along said northern line N. 88Ε 19' 50" W., 437.0
feet to a point on the eastern line of the 5.00 acre tract conveyed
to The Metropolitan St. Louis Sewer District, as aforesaid; thence
along said eastern line, N. 1Ε 40' 10" E., 54.31 feet to a point;
thence along the northern line and northwestern lines of said 5.00
acre tract the following courses and distances; N. 88Ε 19' 50" W.,
605.36 feet to a point and S. 71Ε 23' W., 458.33 feet to the point
of beginning and containing 9.477 acres according to a survey made
by Rapp & Rapp Surveyors, Inc. during the month of August, 1974.
TRACT 2: A tract of land in Section 3, T44N, R5E, in St.
Louis County, Missouri, and being more particularly described as

follows, to-wit: Beginning at the Northeast corner of Lot 1 of
Shari Acres, a subdivision recorded in Plat Book 51, Page 5 of the
St. Louis County Records; thence running along the north line of
said Shari Acres and its direct prolongation westwardly N. 88Ε 20'
W., 1296.11 feet to a point on the west line of said Section 3;
thence along the west line of said Section 3, N. 1Ε 26' E., 444.24
feet to a point on the south line of a 5 acre tract of land
conveyed to The Metropolitan St. Louis Sewer District by deed
recorded in Deed Book 4226, Page 393 of the St. Louis County
Records; thence along the southern lines of said tract the
following courses and distances; N. 72Ε 28' 10" E., 171.83 feet to
a point; S. 83Ε 29' 30" E., 458.98 feet to a point; S. 64Ε 28' 30"
E., 227.52 feet to a point on the west line of a tract of land
conveyed to The Metropolitan St. Louis Sewer District by deed
recorded in Deed Book 4440, Page 409 of the St. Louis County
Records; thence along the west line of said tract, S. 1Ε 41' 50"
W., 27.89 feet to a point; thence along the southwest line of said
tract, S. 55Ε 07' 30" E., 435.0 feet to a point; thence along the
south line of said tract, S. 89Ε 19' 10" E., 126.0 feet to a point;
thence along the west line of a 10 foot wide strip conveyed to the
County of St. Louis, Missouri by deed recorded in Deed Book 3914,
Page 633 of the St. Louis County Records, S. 1Ε 40' 30" W., 64.0
feet to a point on the north line of a tract of land conveyed to
the County of St. Louis, Missouri, by Deed Book 2848, Page 10 of
St. Louis County Records; thence along said north line, N. 88Ε 20'
W., 20.0 feet to a point; thence along the west line of said tract

so conveyed, S. 1Ε 40' 30" W., 39.60 feet to the point of beginning
and containing 10.930 acres according to a survey by Rapp & Rapp
Surveyors, Inc. made during the month of August, 1974.
Section Two. Upon the execution and delivery to them by said owner
of a Warranty Deed in proper form, being free from liens and encumbrances,
conveying title to the said land to The Metropolitan St. Louis Sewer District,
the Executive Director and the Secretary-Treasurer shall be and are hereby
authorized and directed to pay to said owner, for the said land, the total sum
of One Hundred Thirty-Eight Thousand Dollars ($138,000.00).
Section Three. An emergency exists within the meaning of the
Plan, since the realty to be purchased is needed for the protection of the
public health and the purchase must be arranged for without delay.
Accordingly, this Ordinance shall take effect immediately upon its enactment.
The foregoing Ordinance was adopted October 9, 1974.
