HomeMy Public PortalAbout02716 O R D I N A N C E NO. 2716 AN ORDINANCE authorizing the Executive Director and the Secretary-Treasurer of The Metropolitan St. Louis Sewer District to purchase from Spanish Lake Service, Inc., a Missouri corporation, the owner thereof, all of the sanitary sewer system and treatment facilities, including all treatment plants, pump stations, mains, trunks, sub-trunks, laterals, manholes and appurtenances, together with all real property and easements owned by Spanish Lake Service, Inc., within its certificated area in St. Louis County, Missouri, and prescribing the terms of said purchase. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Executive Director and the Secretary-Treasurer of the District are authorized to purchase from Spanish Lake Service, Inc., a Missouri corporation, the owner thereof, at a price not to exceed Four Hundred Seventy-five Thousand Dollars ($475,000.00), all of the sanitary sewer system and treatment facilities, including all treatment plants, pump stations, mains, trunks, sub-trunks, laterals, manholes and appurtenances, together with all real property and easements owned by Spanish Lake Service, Inc., within its certificated area in St. Louis County, Missouri, and more fully described as follows: Beginning at the intersection of The Metropolitan St. Louis Sewer District boundary with the prolongation Southwardly of the last line of Maple Court Subdivision; thence Westwardly along the North line of Lots 9 thru 24 of Greenway Acres to the Northwest corner of said Lot 9; thence Southwardly along the Western line of Lot 9 to its intersection with a lot line; thence Westwardly along said lot line and its prolongation Westwardly to its intersection with the centerline of Larimore Road, said lot line being 310.5 feet Northwardly along the Eastern line of Larimore Road from the North line of Prigge Road; thence Northwardly along the centerline of Larimore Road to the intersection of the prolongation Eastwardly of the North line of Larimore Hills; thence Westwardly along the prolongation Eastwardly of the North line of Larimore Hills and along the North line of Larimore Hills to its intersection with the East line of the Chicago, Burlington and Quincy Railroad right-of-way; thence Northwardly along the East line of the Chicago, Burlington and Quincy Railroad right-of-way to its intersection with the South line of Trampe Avenue; thence Westwardly along the South line of Trampe Avenue to the Northwest corner of Lot 2 of Dale Ridge; thence Northwestwardly across Trampe Lane to the intersection of the North line of Trampe with a line 250.01 feet East of and measured at right angles to and parallel to the East line of Lot "B" of Leanora Subdivision; thence Northwardly along last mentioned line to its intersection with the prolongation Eastwardly of the North line of Lot "A" of Leanora Subdivision; thence Westwardly along the North line of said Lot "A" and its prolongation Eastwardly to the West line of said Lot "B"; thence Northwardly along the West line of Lot "B," 826 feet, more or less, to a point in the Northwest line of U.S. Survey 155, said point being 1198.83 feet from the North line of Trampe Lane as measured along the Northwest line of U.S. Survey 155; thence Northwestwardly along a straight line through Lake Village Plat No. 2 to the most southern corner of Lot owned by the Spanish Lake Community Volunteer Fire Organization; thence Northwestwardly along the Southern line of said Lot, 181.90 feet to a point in the east line of Bellefontaine Road; thence Northwardly along the East line of Bellefontaine Road 75 feet, more or less, to its intersection with the prolongation Eastwardly of a line parallel to and 200 feet North of and measured at right angles to the North line of Parker Road; thence Westwardly along a line parallel to and 200 feet North of and measured at right angles to the North line of Parker Road; thence Westwardly along a line parallel to and 200 feet North of and measured at right angles to the North line of Parker Road to a point in the centerline of U.S. Highway 67; thence Northwardly along the centerline of U.S. Highway 67 to a point, said point being 1525 feet North of the centerline of Norma Lane as measured along the centerline of U.S. Highway 67; thence Northeastwardly along a line having a deflection angle of 11 degrees 19 minutes to the right, 1325 feet to a point; thence Northwardly along a line having a deflection angle of 9 degrees 39 minutes to the right, 1250 feet, more or less, to a point in the Southwest line of the Chicago, Burlington and Quincy Railroad right-of- way; thence Northeastwardly along a line having a deflection angle of 17 degrees 29 minutes to the left, 820 feet to a point; thence Northeastwardly along a line having a deflection angle of 42 degrees 00 minutes to the right, 750 feet to a point; thence Northeastwardly along a line having a deflection angle of 36 degrees 19 minutes to the left, 850 feet to a point; thence Northeastwardly along a line having a deflection angle of 14 degrees 34 minutes 30 seconds to the right, 4425 feet, more or less, to a point in the approximate centerline of the Missouri River; thence Southeastwardly along the approximate centerline of the Missouri River to its intersection with the prolongation Northwardly of the centerline of Spanish Pond Road; thence Southwardly along the prolongation Northwardly of the centerline of Spanish Pond Road and along the centerline of Spanish Pond Road to an angle point; thence continuing Southwardly along the centerline of Spanish Pond Road and along the West line of U.S. Survey 329 to the Southwest corner of U.S. Survey 329; thence Eastwardly along the South line of U.S. Survey 329 to a point in the centerline of Columbia Bottoms Road; thence Southwardly along the centerline of Columbia Bottoms road to the point of beginning. Section Two. Upon the execution and delivery to the Executive Director and the Secretary-Treasurer of The Metropolitan St. Louis Sewer District, by Spanish Lake Service, Inc., a Missouri corporation, of proper documents in proper form, being free from liens and encumbrances, conveying title to all of the 5 sanitary sewer system and treatment facilities, including all treatment plants, pump stations, mains, trunks, sub-trunks, laterals, manholes and appurtenances, together with all real property and easements owned by Spanish Lake Service, Inc., within its certificated area in St. Louis County, Missouri, to The Metropolitan St. Louis Sewer District, the Executive Director and the Secretary-Treasurer shall be and are hereby authorized and directed to pay to Spanish Lake Service, Inc., a Missouri corporation, the owner thereof, for said sanitary sewer system and treatment facilities the total sum of Four Hundred Seventy-five Thousand Dollars ($475,000.00), payable as follows: One Hundred Forty-two Thousand Five Hundred Dollars ($142,500.00) payable by December 31, 1974, Sixty-six Thousand Five Hundred Dollars ($66,500.00) payable by December 31, 1975, Sixty-six Thousand Five Hundred Dollars ($66,500.00) payable by December 31, 1976, Sixty-six Thousand Five Hundred Dollars ($66,500.00) payable by December 31, 1977, Sixty-six Thousand Five Hundred Dollars ($66,500.00) payable by December 31, 1978, and a final payment of Sixty-six Thousand Five Hundred Dollars ($66,500.00) payable by December 31, 1979. 6 The foregoing Ordinance was adopted December 11, 1974.
