AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE CITY
OF TIFFIN, IOWA, TO APPROVE A PLANNED AREA DEVELOPMENT
DESIGNATION, WITH UNDERLYING ZONING DISTRICT R-12, FOR
CERTAIN PROPERTY KNOWN AS VILLAGE POINTE PHASE 2, TIFFIN,
JOHNSON COUNTY, IOWA, AND AS LEGALLY DESCRIBED HEREIN
BE IT ENACTED BY THE CITY COUNCIL OF TIFFIN, IOWA:

Section 1. Purpose. The purpose of this ordinance is to amend the
official zoning map of the City of Tiffin, Iowa, concerning property locally
described as Village Pointe Phase 2, Tiffin, Johnson County, Iowa,
attached hereto and incorporated herein. The Planned Area Developrrient
was requested by applicant High,Developmment.
Section 2. Amendment. The following legally described
property:
Parts of Lots 1,and A of Wombacher's Subdivision of the'Northeast Quarter of Section 33,
Township 80 North, Range 7 West of the 5th P.M., in the City of Tiffin, Johnson County, Iowa,
recorded May 16, 1978, in Book'17, Page 69 in the Johnson County Recorder's.office, and part •
of the Northeast Quarter of Section 33, Township 80 North, Range 7 West of the 5th P.M.,_
Johnson County, Iowa, and more particularly described as follows:
Beginning at the Northeast Corner of Auditor's Parce12010083, City of Tiffin, Johnson County,
Iowa, recorded December 20, 2010, as Document ID: 022056990001,in the Johnson County
Recorder's office;
Thence North 89° 23'26" East, 55.27 feet;
Thence North 22° 05'42" East, 389.99 feet to the Southerly Line of Auditor's Parcel 2007004,
recorded June 22, 2012, as Document,ID: 022567770001 in the Johnson County Recorder's
office;
Thence South 86° 29' 06" East, 60.15 Feet along said Southerly Line;
Thence South 41° 11' 07" East, 157.18 Feet,
Thence South 73° 47' 25" East, 154.42 Feet;
Thence South 00° 06' 10" East, 474.93 Feet;
Thence South 88° 27' 04"West, 506.93 Feet to the Easterly Line of said Auditor's Parcel

District and the Developer-executing a Public•°Acce'ss and Fire Apparatus
Easement Agreement, and `such other utility easement agreements the
City may require, and 'subject to Council approval of the re-zoning
application, preliminary.,plat, final plat,.and Developer's Agreement.
_ . -Section 3. Repealer. All ordinances or parts of ordinances in
conflict with the provisions of this Ordinance are hereby repealed. '
Section 4. Severability. ,If any section, provision, or part of this
ordinance shall be'adjudged to be invalid or unconstitutional, ,such
,adjudication shall not affect the validity of the ordinance as a whole, or
any section, provision, or part ,thereof not adjudged invalid or
unconstitutional: , r
Section 5. Effective Date. This ordinance shalrbe in effect after
its final passage, approval, and posting as'provided by law.
On the 18th day of September 2013, at a special meeting of,the Tiffin City
Council, Tiffin, Iowa, Couricilperson Ryan introduced Ordinance No. 2013-
339, and moved that it be given its first reading. The motion was seconded by
Councilperson Bartels. . 3 •

On the 25th day of September 2013, at a regular meeting of the Tiffin City
Council,Tiffin, Iowa,'Councilperson Bartels introduced Ordinance'No. 2013-
339, andmoved that it be given its second reading. The motion was seconded
by Councilperson Kahler.

Council, Tiffin, Iowa, Councilperson Upton introduced Ordinance No 2013-
339, and moved that it be given its third and la-st reading. The motion was

District and the Developer executing a Public Access and Fire Apparatus
Easement Agreement, and such other utility easement agreements the
City may require, and subject to Council approval of the re-zoning
application, preliminary plat, final plat, and Developer's Agreement. •

Steve Berner declared the motion carried, and the ordinance was passed and
adopted.
Whereupon the Mayor declared that Ordinance No. 2013-339 be adopted ands
signified his approval of same by fixing his signature thereto. Passed by the
Council on the 25th day of September 2013 and approved'by the Mayor on the
2nd day of October 2013.
