FROM: NEW CAPE Iii INC. TO: ATMIYA LIQUORS, INC.
WHEREAS, application has been made to the Mayor and Council of the Borough
of Carteret, Middlesex County, State of New Jersey, by ATMIYA LIQUORS,
INC. for a Person-to-Person Transfer of A.B.C. License ~/1201-32~040'004
from NEW CAPE II, INC., present holder of same, premises located at 835
ROOSEVELT AVENUE, PLAZA 12, Carteret, New Jersey 07008 and said NEW CAPE
II, INC. has consented to assign their rights of said License to the
aforesaid applicant; and
WHEREAS, according to law, the application for transfer was duly adver-
tised in The Homm News & Tribune, a newspaper circulated in the Borough
of Carteret, New Jersey and no objections to said transfer, either ver-
bally or in writing, were filed or made to the Governing Body or to the
Municipal Clerk; and
WHEREAS, the application fora is complete in all respects and the appli-
cant is qualified to be licensed according to all standards established
by Title 33 of the New Jersey Statutes, promulgated thereunder, as well
as pertinent local ordinances and conditions consistent with Title 33; and
WHEREAS, the applicant has disclosed, and the local authority reviewed,
the source of all funds used in the purchase of said license and the
licensed business and all additional financing obtained in connection
with the licensed business.
NOW, THEREFORE, BE IT A~D IT IS HEREBY RESOLVED, by the Mayor and Council
of the Borough of Carteret, Middlesex County, State of New Jersey, that
A.B.C. License #1201-32-040-004, heretofore held by New Cape II, Inc.
to sell alcoholic beverages in conformity with the laws, statutes, rules
and regulations of the State of New Jersey and the resolutions, ordinances,
rules and regulations of the Borough of Carteret relating to and con-
cerning said license and the sale of alcoholic beverages at 835 Roosevelt
Avenue, Plaza 12, Carteret, New Jersey 07008, be and the some is hereby
transferred to the applicant, ATMIYA LIQUORS, INC. and to be held by
them until such license expires, unless sooner revoked.
BE IT~ FURTHER RESOLVED, that the Municipal Clerk is hereby authorized and
directed to execute the endorsen~nt of transfer on behalf of the Mayor
and Council of the Borough of Carteret; and
BE IT FURTHER RESOLVED, that two (2) certified copies of this Resolution
be sent forthwith to the State of New Jersey, Department of Law & Public
Safety, Division of Alcoholic Beverage Control, Licensing Bureau, CN 087,
Trenton, New Jersey 08625~0087,

as a true copy of the original on September 20, 1996
