HomeMy Public PortalAbout02943 O R D I N A N C E NO. 2943 AN ORDINANCE declaring the necessity for the acquisition of a parcel of land within The Metropolitan St. Louis Sewer District, for the purpose of stormwater improvements thereupon to serve the need of residents of the area and authorizing the acquisition of such land by purchase or by the institution of condemnation proceedings, with an emergency clause. WHEREAS, there exists within The Metropolitan St. Louis Sewer District an area of University City, Missouri, containing Subdistrict No. 366 (University City Branch of River des Peres Stormwater Subdistrict) of The Metropolitan St. Louis Sewer District wherein there live and work numerous people; and WHEREAS, storm sewage gathered from such area will have no alternative means of disposition to crossing said property and will constitute a menace to public health and welfare of the general public and the residents of The Metropolitan St. Louis Sewer District; and WHEREAS, it is the purpose and design of The Metropolitan St. Louis Sewer District to protect the public health by constructing stormwater improvements over and across said area in order to relieve and alleviate these conditions; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. In order to protect the public health and believe insanitary and dangerous conditions, it is necessary to appropriate and acquire by the exercise of eminent domain or otherwise a parcel of land for the use of stormwater improvements as hereinafter set forth, said parcel of land being more particularly described as follows: A parcel of land in Block 3 of EASTOVER, a subdivision in University City, St. Louis County, Mo., as per plat thereof recorded in P.B. 17, Pg. 42, St. Louis County, Mo. Recorder's office, which parcel of land is more particularly described as being the west half of Lot 10 and all of Lots 11 and 12 in said Block 3, EXCEPTING THEREFROM the southern 15' thereof conveyed to the State of Missouri by Cause No. 241272 of the Circuit Court of St. Louis County, Missouri for the widening of Olive Blvd. and which parcel is further described as fronting 115.35' on the north line of Olive Blvd., as so widened, by a depth northwardly of 110' on its east line and 111.20' on its western line, to the south line of a 15' wide alley on which it has a width of 131.65'. Section Two. Counsel for The Metropolitan St. Louis Sewer District be and is hereby authorized to institute and prosecute an action in condemnation pursuant to the provisions of the Plan of The Metropolitan St. Louis Sewer District and the laws of the State of Missouri, for the appropriation of private property as hereinbefore set out. Section Three. The immediate construction of stormwater improvements being necessary in order to protect the public health within the District constitutes an emergency within the meaning of the Plan of The Metropolitan St. Louis Sewer District and this 3 Ordinance shall take effect immediately upon its adoption. The foregoing Ordinance was adopted October 29, 1975.
