Members present: Mayor, Wayne Neddermeyer; Councilmembers, Thomas Crosby, Nancy Laurent, William Reiser, Arthur Theis; Clerk, Donna Roehl; Planning and Zoning Administrator, Jeanne Mabusth; Attorney, Richard Schieffer ; Weed In- spector, Ray Hoosier 1. Thomas Crosby asked that Item 2, Page 147, be changed to refl ect that Mr. Bergerson indicated no desire, on their part, to sell services to Medina Morningside residents but Would consider selling the system to Medina. Item 9, Page 148, change to indicate that an election would take place prior to effectiveness. Motion by Arthur Theis, sec©nded by Nancy Laurent to accept minutes as corrected. Motion carried 1. DONALD MOSBARGER Mrs. Mosbarger appeared to request a lot line variance to allow them to build a 26' x 30' barn on Lot 3 of A11ens Maple Crest Plat. Barn would be located 50 ft. from the west and south property lines. She presented signatures of 3 neighboring property owners not object- ing to the structure. Motion by Nancy Laurent, seconded by Arthur Theis to grant a 450' lot line variance to Donald Mosbarger to allow building of a barn on Lot 3 of Allens Maple Crest Plat, because of limited space; reason being the way the property runs and presentation of signed stdement of neighbors not objecting; and contingent upon written approval of Ross Thorfinsons and Wayne Allen and and filing of approval letter with drawing. Motion carried unanimously 2. ROY RICHARDSON Mr. Richardson appeared to request a front and rear yard setback variance to allow him to build a house on Lot 6 and the westerly 40 ft. of Lot 7, Block 28, Independence Beach. The front yard setback to be 35 ft. and the rear yard setback to be 33 ft. Motion by Thomas Crosby, seconded by William Reiser to grant a variance of Lot 6, and the Westerly 40 ft. of Lot 7, Block 28, Independence Beach to allow a 35 ft. front yard setback and a 33 ft. rear yard setback because of hardship involved with building on small platted lots in the Independence Beach area. Motion carried unanimously 3. RORF;RT SEARLES Mr. Searles appeared to discuss his involvement with the State Legislature and to report on the various committees he is serving on: Tax, Local and Urban Affairs and Labor Management. He is also working on water safety legislation regarding work being taken care of by boat license fees and not ad valorum taxes. Discussion of distribution or road aid funds. Mr. Searles stated the need for municipalities and individuals to become involved in suggesting ways in which smaller communities could re- ceive larger amounts of funds to maintain roads. Discussion of Metro Council representatives. Mr. Searles gave his opinion as to how they should be chosen. 4. WEED INSPECTING Mr. Don Anderson, Hennepin Co. Weed Inspector, explained his work with Ray Hoosier, Medina's Inspector and his meeting with Ron Duran, regarding mowing along the cities roads. He explained the Park weed control program and his work with 44 municipality inspectors. Ron Duran explained that he had told Mr. Hoosier the weeds would be cut when a new employee was hired and that man had begun mowing July 18th. He also stated that he should be informed early in the season as to what and when weeds should be cut. Discussion of Medina's weed control program. Donna Roehl felt that the inspector should cover all of Medina and not just the fields that ce.n be seen from the roads. Ray Hoosier stated that such a program would cost much more money than the $500 allocated in the budget. Thomas Crosby stated that communication is needed between the city and county and that under current regulations there is inequity in the program. Arthur Theis stated that Mr. Hoosier should work out a program and present it at the time the budget is prepared. 1 5 2 5. WILFRED CAVANAUGH, TOWER DRIVE Mr. Cavanaugh appeared to discuss changing the requirement for Tower Dr, from a 40 ft. wide road to a road 24 - 30 ft. wide. He explained the street widths in the Minneapolis Indust- rial park are not that wide and that he could provide on -street parkin even at 36 ft.wide. Engineer, Lyle Swanson, recommended that road should be 34 — 36 ft. wide with on -street parking permitted. He also noted that whatever is required here will set a precedent for for other industrial parks in Medina. Motion by Thomas Crosbgf seconded by Nancy Laurent to authorize modification, as per eng- ineers recommendation, prior agreement with Bill Cavanaugh to permit a 34 ft.,_7 ton Tower Dr., with the condition that it be constructed in the 1977 season. Motion carried unanimously 6. TAMARACK DRIVE Discussion of bringing Tamarack Dr., north of Medina Rd., up to city standards. Nancy Laurent stated that it would cost approximately $4000 for the project. Engineer, Lyle Swanson, stated that 4" of ground asphalt could be used now and wait to see how it holds up. Motion by Nancy Laurent, seconded by Arthur Theis, to place 4" of gr ound asphalt on Tamarack. Dr. beginning at center line of Medina Rd. and continuing to the intersection of the Berth- iaume division, entrance road. Motion carried unanimously 7. TAX FORFEIT LOTS Discussion of list of parcels that are now tax forfeit end the need to pass a resolution releasing them for public sale. Richard Schieffer discussed city owned property and the forms necessary to relcaim. Wayne Neddermeyer instructed the attorney to file the necessary forms. Discussion of the Medina Morninside lot being the lot designated as the lot the city had wanted to acquire to extend the Medina Morninsid.e park. Donna Roehl will contact Hennepin County Property management for information regarding HUD's posistion on acquiring tax forfeit lots. Motion by Thomas Crosby, seconded by Arthur Theis to approve Resolution 77-29 regarding release of tax forfeit lots. Voting No: Crosby, Theis, Laurent, Reiser, 1Neddermeyer Motion not carried 8. PLANTSCAPE Motion by Nancy Laurent, seconded by William Reiser to release the cashier's check of Plantscepe as per Engineers recommendation. Motion carried unanimously 9. LONG LAKE FORD TRACTOR Motion by Nancy Laurent, seconded by Arthur Theis to release the certified check of Long Lake Ford tractor regarding purchase of backhoe. Motion carried unanimously 10. HRA GRANT FUNDS Donna Roehl explained that Medina had Council regarding HRA authority. The included in a request for funds. Motion by Thomas Crosby, seconded by funding request from HRA. Motion carried unanimously previously entered into agreement with Metropolitan resolution before the council deals with Medina being Arthur Theis to approve Resolution 77-30 regarding 11. PLANNING COMMISSION MEMBER Motion by Thomas Crosby, seconded by William Reiser to appoint William Bracken to the Medina Planning Commission to fill the unexpired term of George Wyse ( March 1980) Motion carried unanimously 12. ELM CREEK CONSERVATION COMMISSION Jeanne Mabusth stated that she would continue to attend meetings of the Elm Creek Commission until Medina appoints a representative. 153 13. BILLS Motion by Thomas Crosby, seconded by Nancy Laurent to pay the bills; Payroll # 4571-4576, in the amount of $2026.22. Motion carried unanimously 14. S.J. GROVES Discussion of the Planning Commission recommendation regarding lease of the city owned prop- erty on Co. Rd. 24 and Hunter Dr. to the S.J. Groves Farm. i°lembers discussed the possibility that a rental fee would be less than it would cost to have the lease prepared. Wayne Neddermeyer felt that they should find an equal piece of property and trade with the city. Council agreed to pursue this matter further and instructed Jeanne Mabusth to contact the farm manager. 15. UTILITY DEPARTMENT Ron Duran explained that a new chlorinator boosther pump will be needed at a cost of .200 - 8250. He also stated that water customers should be notified as to schedule for flushing hydrants. Council agreed notices should be sent. 16. TAX PETITIONS Motion by Wayne Ned ermeyer, seconded by Thomas Crosby to ask that Hennepin Co. defend the tax petitions as they have previously done. Motion carried unanimously 17. MEDINA MORNINSIDE HYDRANTS Arthur Theis reported that the fire hydrants at Medina Morninside need servicing and painting. Wayne Neddermeyer stated that he should have the work completed. 18. MEDINA MORNINSIDE SEWER Lyle Swanson stated that McCombs -Knutson had sent a proposal to Wayne Anderson regarding the cost of a study for Medina Morninside and the Vo Tech School. Donna Roehl reported that Wayne Anderson would attend a meeting and explain the cost alter- natives and the conferences he has had with the Vo Tech representatives.
