HomeMy Public PortalAbout02990 O R D I N A N C E NO. 2990 AN ORDINANCE authorizing and directing the Executive Director and Secretary-Treasurer to grant to the State Highway Commission of Missouri a temporary easement across portions of easements of The Metropolitan St. Louis Sewer District for the purpose of highway improvements on State Highway Route 66 in the vicinity of State Highway Route 66 and the River des Peres Drainage Works. WHEREAS, the granting of said easement will not interfere with the sewer service provided therein, and WHEREAS, the State Highway Commission of Missouri has agreed to reimburse the District for any changes to District facilities in said easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State Highway Commission of Missouri a temporary easement for the purpose of highway improvements to State Highway Route 66 in the vicinity of State Highway Route 66 and the River des Peres Drainage Works across portions of easements owned by the District in the City of St. Louis, Missouri, such easements being described as follows: Tract #1: Beginning at a point in the Eastern right-of-way line of the River des Peres Drainage Works, said point being 46.98 feet radial distance Northwest of Station 13+95.32 on the hereinafter described centerline of Route 66; thence North 34 degrees 18 minutes 20 seconds West along said Eastern right-of-way line a distance of 8.04 feet to a point; thence South 57 degrees 23 minutes 51 seconds West a distance of 43.25 feet to a point; thence North 67 degrees 52 minutes 08 seconds East a distance of 44.23 feet to the point of beginning. Tract #2: Beginning at a point 50 feet perpendicular distance Southeast of Station 13+40 on the hereinafter described centerline of Route 66; thence North 50 degrees 16 minutes 40 seconds East a distance of 48.00 feet to a point in the Eastern right-of-way line of the River des Peres Drainage Works; thence South 34 degrees 18 minutes 20 seconds East along said Eastern right-of-way line a distance of 35.30 feet to a point; thence South 88 degrees 28 minutes 19 seconds West a distance of 56.84 feet to the point of beginning. Tract #3: Beginning at a point in the Western right-of-way line of the River des Peres Drainage Works, said point being 60 feet perpendicular distance Northwest of Station 11+27.22 on the hereinafter described centerline of Route 66; thence North 34 degrees 18 minutes 20 seconds West along said Western right-of-way line a distance of 15.07 feet to a point; thence North 50 degrees 16 minutes 40 seconds East a distance of 6.36 feet to a point; thence South 39 degrees 43 minutes 20 seconds East a distance of 15 feet to a point; thence South 50 degrees 16 minutes 40 seconds West a distance of 7.78 feet to the point of beginning. Upon completion of the improvement of Route 66, the easement rights in the above three tracts shall cease and be no longer in effect. Tract #4: An area fifty (50) feet in width as measured parallel to the north line of the described permanent easement and an area fifty (50) feet in width as measured parallel to the south line of the described permanent easement. The centerline of Route 66 is described as follows: Beginning at Station 17+04.25 on the centerline of Route 66, said Station being distant 40.00 feet North 30 degrees 25 minutes 20 seconds West of a concrete monument located at the most Western corner of City Block 6271; thence South 59 degrees 31 minutes 40 seconds West along said centerline a distance of 108.02 feet to P.T. and Equation Station 15+96.32 ahead equals Station 15+96.41 back; thence Southwesterly along said centerline and on the arc of a curve to the left, having a radius of 1432.40 feet a distance of 231.25 feet to P.C. Station 13+65.16; thence South 50 degrees 16 minutes 40 seconds West a distance of 310.50 feet to centerline Station 10+54.66; thence South 48 degrees 28 minutes West along said centerline a distance of 154.66 feet to centerline Station 9+00, being the point of ending. 3 Section Two. The Executive Director and Secretary-Treasurer are hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted January 28, 1976.
