HomeMy Public PortalAbout02991 O R D I N A N C E NO. 2991 AN ORDINANCE authorizing and directing the Executive Director and Secretary-Treasurer to grant to the State Highway Commission of Missouri an easement across portions of easements of The Metropolitan St. Louis Sewer District for the purpose of highway improvements on Route I-70 in the vicinity of Route I-70 and the Carson Road Interchange. WHEREAS, the granting of said easement will not interfere with the sewer service provided therein, and WHEREAS, the State Highway Commission of Missouri has agreed to reimburse the District for any changes to District facilities in said easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State Highway Commission of Missouri an easement for the purpose of highway improvements to Route I-70 in the vicinity of Route I-70 and the Carson Road Interchange across portions of easements owned by the District in St. Louis County, Missouri, such easements being described as follows: Parcel No. 1: That portion of Company's easement situated in Lot 16 of Joyce Place First Addition as shown by plat recorded in Plat Book 26, Page 22 and in Lot 4 of Watson's Subdivision in the South half of U.S. Survey 3082, Township 46 North, Range 6 East, St. Louis County, Missouri, described as beginning at a point in the Southeast corner of said Lot 16 of Joyce Place First Addition; thence Northerly along the East line of said Lot 16 to the Northeast corner thereof; thence westerly along the North line of Lot 16 to the West line of Joyce Place First Addition; thence Northerly along said Western subdivision line a distance of 7 feet to a point; thence Westerly along a line parallel to the hereinafter described centerline of I-70 and 150 feet radial distance therefrom for a distance of 25 feet to a point; thence Southerly to a point in the Northwest corner of a tract of land conveyed to Forrest Penn, Jr. and wife by Book 3378, Page 311 of the St. Louis County Records; thence Southeasterly to a point in the East line of said Penn tract, said point being 30 feet North of the Southeast corner of said Penn tract as measured along said East line; thence Northwesterly to the point of beginning. The centerline of 1-70 is described as beginning at Station 536+66 on the centerline of I-70 at its intersection with the North line of Lot 2 of the partition of the Estate of Elizabeth Jones, deceased, in said U.S. Survey distance 32.7 feet West of the Northeast corner of said Lot 2, being a point on the arc of a curve to the left having a radius of 1910.08 feet and tangent to a line bearing South 73 degrees 35 minutes East; thence Southeasterly on said curve 419.88 feet to C. S. Station 540+85.88; thence Southeasterly on the arc of a spiral curve to the left having a length of 200 feet and a spiral angle of 2 degrees 00 minutes a distance of 200 feet to S. T. Station 542+85.88; being the point of ending. Parcel No. 2: That portion of Company's easement situated in U. S. Survey 3082, Township 46 North, Range 6 East, St. Louis County, Missouri described as beginning at a point in the Southeast corner of a tract of land conveyed to Ann Nell O'Hearn by deed recorded in Book 1302, Page 51, said point also being in the existing West right-of-way line of Carson Road; thence South 78 degrees 37 minutes West along the South line of said O'Hearn tract a distance of 173.19 feet to a point; thence North 11 degrees 23 minutes West a distance of 12.5 feet to a point in the North line of said O'Hearn tract; thence North 78 degrees 37 minutes East along said North property line a distance of 134.99 feet to a point; thence North 7 degrees 37 minutes East a distance of 15 feet to a point; thence North 78 degrees 37 minutes East to a point in said existing West right-of-way line of Carson Road; thence Southerly along said West right-of-way line to the point of beginning. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. 3 The foregoing Ordinance was adopted January 28, 1976.
