Present: Mayor, Thomas Anderson; Councilmembers, Thomas Crosby, Wilfred Scherer, Anne Heideman, William Reiser; Clerk -Treasurer, Donna Roehl; Police Chief, Mich- ael Sankey; Public Works Supervisor, James Dillman; Planning and Zoning Administrator, JoEllen Hurr; Attorney, Michael Nash; Engineer, Glen Cook 1. MINUTES OF JULY 5, 1983 Donna Roehl stated that Item 5, Page 234 should be corrected to read, "as noted on original plan,". Motion by Heideman, seconded by Crosby to approve minutes of July 5, 1983, as amended. Motion declared carried 2. PUBLIC WORKS DEPARTMENT Hamel Well # 3 Glen Cook reviewed his letter regarding final payment request from REnner Well Co. for construction of Hamel Well # 3. He recommended that the work be accepted and that $10,413.75 be paid. Motion by Scherer, seconded by Heideman to pay Renner Well Co. $10,413.75 and accept the well, as constructed. Motion declared carried Demeules Road Glen Cook reported that he and Jim Dillman had met with Paul Pearson of McCombs -Knutson and engineers from Schoell-Madsen, representing L.T. Demeules, on the road site to re- view problem areas of the road. He stated that there were two problems; the condition of the base in a particular area and an uneven surface, throughout. He explained that they will have a gravel equivalent section according to Medina's road specifications and that a 3" blacktop overlay will be applied. Discussion of the area that is very wet and whether or not the drain tile throughout the area has some affect on that area. Wilfred Scherer stated that he would review the tiled area with Jim Dillman and nearby residents. 3. WEST HENNEPIN HUMAN SERVICES Anne Heideman recommended the appointment of Joan Larson to the West Hennepin Human Services Board. Motion by Heideman, seconded by Reiser to appoint Ms. Larson, as recommended. Motion declared carried 4. PLANNING AND ZONING DEPARTMENT Woodlake Sanitary Landfill JoEllen Hurr reported that she would be meeting with representatives of Woodlake Landfill on July 20th and that she would like to schedule a meeting of the Task Force so that the Planning Commission could hold a Public Hearing in the near future. Council agreed that the matter should proceed with a Task Force meeting on August 1, 1983. Nunn -Radtke Wm. Nunn stated that the purchaser of the manure,he is to haul will not accept the mater- ial when it is wet so they have not been able to haul because of the continued rain. He stated that they would be getting a drag line with a 5 ft. bucket and that the material would be hauled in semi's. He explained that they would be doing the work according to the city engineer's directions and that test tholes will be dug to determine how much material needs to be hauled. Thomas Crosby stated that written standards are needed and that the engineer should approve the work before the drag line is removed from the property. Wilfred Scherer stated that some deadline should be given, as the matter goes from one meeting to the next. Motion by Crosby, seconded by Heideman to table variance application of Wm. Nunn until the manure problem has been resolved. Motion declared carried 41 Holy Name Church Parking Lot Driveway 2 JoE11en Hurr explained that the Barton-Aschman traffic report contained some inaccuracre and that it does not necessarily lead to the conclusions stated by the Greentree residents. She stated that Father Arnold would like a decision, at this meeting. Thomas Crosby stated that he had spoken to Deane Wenger of Barton-Aschman and that he had personally walked and measured the area. He also believed that the County Commissioners had overruled the county staff posistion as a political matter. Dave Goodrie, representing Greentree West homeowners, stated that Art Lee, Hennepin County Engineer, had not object to the use of Co. Rd. 24 as a driveway location, at the County Commissioners meeting and he referred to the transcript of the proceedings of that meeting. Thomas Anderson stated that he had visited the three churches listed in the letter from Plymouth Mayor, Dave Davenport, and found that all three have exits onto county roads but that none are adjacent to secondary roads. He did not think there was a good example of a similar situation in Plymouth. William Reiser asked how many of the westerly driveways the church wished to use. Father Arnold stated that he wanted both to remain so that school buses could use them. thomas Anderson stated that he had monitored traffic on July 17th, the day of the church festival, and all,but one car, exited onto Co. Rd. 24 from the Brockton Lane driveway. Dave Goodrie stated that the safest access would be Co. Rd. 24, not Brockton Lane, and that a petition of local community residents listed 200 children, many of them using the street in which to play. He explained that another petition had been signed by Medina residents and of the signers, 30% had access directly onto Co. Rd. 24. Thomas Anderson stated that he had been told that some of the Medina residents who had signed the petition did not know all of the facts before they signed and other problems with the petition were noted. Mr. Goodrie stated that residential traffic should not be mixed with this type of traffic and that a legal opinion from the Hennepin County attorney's office stated that Holy Name does have a right to use Co. Rd. 24 and that the Brockton Lane access was selected without a traffic study. Anne Heideman stated that she had a problem allowing children to use city streets as a play area and she asked for an explanation of the model simulation. Mr. Goodrie explained that he could not elaborate on the simulation and that the person who had prepared it could not attend this meeting. Thomas Crosby asked it it would be possible to close the driveway adjacent to the church. Michael Sankey stated that a church being built at 46th and Vicksburg has all traffic exit- ing onto 46th Ave. Harold Waldron, Greentree West resident, stated that cars had been parked on Alvorado Lane on the day of the church festival and that the Plymouth officials were in a very delicate posistion when they were asked to comment on the issue, in that they did not want to tell Medina what to do. Thomas Crosby indicated the following reasons for his favoring Brockton Lane as an entrance: Children generally learn to cope with a traffic situation. He noted that many other dev- elopments have relatively high degrees of traffic in heavily populated areas, such as Fern- dale North and Medina Morningside. He commented on the significant setbacks from the streets in Greentree West. He noted that Greentree West residents had no assurance that the land west of Brockton Lane would always be used for church purposes. Residential uses would be possible in which event the brockton Lane access is preferable. 242 He stated that three professionals had given opinions on the matter: the Medina Police Department; the Hennepin County staff and Barton-Aschman. Only Barton-Aschman was in favor of the Co. Rd. 24 access and Barton-Aschman had commented that they would prefer to see the existing access point immediately west of the church closed for saf- ety reasons. Mr. Crosby indicated that he believed the overruling by the County Comm- issioners of the staff posistion was entirely political in nature and referred to Comm- issioner Robb's comments as an example of the political nature of the decision. He expressed concern over the safety problems with the two existing entrances west of the church, both of which, in his opinion, were more dangerous than the new one proposed for Co. Rd. 24. He indicated his reluctance to approve an additional access point on the' highway where an alternate route, in his opinion, exists. He express concern as to when the speed limit on Co. Rd. 24 would be reduced noting that the possibility of reduction was one of the reasons of support for the Co. Rd. 24 access point mentioned by Barton-Aschman. He summarized his posistion by saying that the issue was one solely of safety and that he believed the Brockton Lane access point to be favored for the reasons noted above. Deane Wenger of Barton-Aschman stated that there are a number of exceptions to the County rule regarding use of county roads, that the site distance on Co. Rd. 24 is good and that Co. Rd. 24 traffic will not grow substantially and that the church should modify the ent- rance near the church. JoEllen Hurr explained that the new Northridge Farms development will use Brockton Lane and Hunter Dr. as accesses with no new driveways onto Co. Rd. 24. Motion by Crosby, seconded by Heideman to reaffirm action taken by the City Council on October 7, 1982 wherein Brockton Lane was approved as the entrance/exit for the new church parking lot. Motion delcared carried by a unanimous vote. Discussion of the fact that the parking lot is planned for 128 cars Arold Weber stated that they may need to enlarge it in the future. Thomas anderson stated that he would want to review the matter if the enlarged and that Holy Name Church may want it reviewed if problems Dave Goodrie asked for certified copies of all materials pertaining asked what the appeal procedure would be. HUNTER FARMS PARK, LANDSCAPING Anne Heideman presented landscaping plan submitted by Dundee Nursery. Council compared plan to that of Midland Nursery, received at July 5th meeting and dis- cussed whether the city should do the planting or have the planting done by the nursery. The following plan/price comparisons were discussed: CITY PLANT Dundee Nursery $ 4238.60 Midland Nursery 4634.96 NURSERY PLANT $ 6855.35 5848.76 Anne Heideman recommended the Dundee Nursery Plan because of the number and type of plantings proposed, using the smaller Honeysuckle plants and not planting the proposed tree by the softball diamond. Motion by Heideman seconded by Crosby to authorize Dundee Nursery to plant as per plan provided with recommendations for adjustments to the plan as suggested. Motion declared carried 6. BILLS Motion by Crosby, seconded by Reiser to pay the bills; Order Checks # 2225-2230 in the amount of $1947.12 and Payroll Checks # 7245-7257 in the amount of $7483.18. PLANNING COMMISSION MEMBER William Reiser stated that he would try to find a resident of the Medina Morningside area interested in servsng as a member of the Planning Commission. 8. UNPAID UTILITY BILL CERTIFICATION Motion by Heideman, seconded by Crosby to adopt Resolution 83-26, certification of an unpaid water bill in the Medina Morningside area for 1984 taxes. Motion declared carried 8. DEMEULES ROAD Thomas Anderson stated that Paul Pearson would be involved in finalizing work to be done on the L.T. Demeules Road. 10. HAMEL SEWER INFILTRATION JoEllen Hurr stated that there is very little chance that Metro WAste Control will assist Medina iwth work on correcting infiltration into the Hamel sewer line which runs adjacent to the proposed sewer interceptor. Thomas Anderson stated that they might include the work in their bid with Medina to pay for the work or Medina could work on the line at the same time as Metro Waste was doing their work. He asked that Bonestroo and Associates prepare a plan for beginning an in- filtration program and Donna Roehl to determine method of securing the Community Develop- ment Block Grant funds that had been allocated for a small portion of the project. .
