HomeMy Public PortalAbout03096 O R D I N A N C E NO. 3096 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer to lease the riverfront rights upon certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to the Great Lakes Carbon Corporation, and to execute a Leasehold Agreement upon the conditions hereinafter set out. WHEREAS, the District owns certain improved real property in St. Louis County incident to its public functions and responsibilities, and WHEREAS, Great Lakes Carbon Corporation had leased said riverfront rights from the previous owner of said property, and continued the lease after the District's acquisition, said lease having expired, and is desirous of executing a new lease based upon the terms and conditions as hereafter generally set forth, and WHEREAS, the District is willing to execute a new lease, and believes the terms to be advantageous and in the public interest to do so. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to the Great Lakes Carbon Corporation, upon the general terms and conditions hereinafter set forth, riverfront rights upon the following described real property: Ord. No. 3096 A certain tract of land on the waterfront of the Mississippi River in U. S. Survey 904, Township 44 North, Range 7 East, St. Louis County, Missouri, conveyed to Lessor and more particularly described in an instrument re- corded in Book 6350, Page 152 of the St. Louis County Records. Section Two. The lease term shall commence on July 1, 1976, and continue for five (5) years to April 30, 1981, at the rental of Six Thousand Five Hundred Dollars ($6,500.00) per year, to be paid in quarterly installments of One Thousand Six Hundred Twenty-five Dollars ($1,625.00) each. Section Three. The riverfront rights as granted by said lease pertain to the mooring of barges in the river adjacent to said above-described property, and the maintenance therein and thereover of the necessary wood pile cluster and concrete deadmen. Section Four. The Executive Director and Secretary- Treasurer are hereby authorized and directed to execute in behalf of the District a Leasehold Agreement giving effect to Sections One, Two, and Three hereof, and embodying such other terms and conditions as approved by the General Counsel. The foregoing Ordinance was adopted July 14, 1976.
