AN ORDINANCE, declaring the necessity for the
acquisition of an easement within certain existing property within
The Metropolitan St. Louis Sewer District, for the purpose of
permitting construction of sewers therein to serve the needs of
residents of the area and authorizing the acquisition of such
easement by purchase or by the institution of condemnation.
WHEREAS, there exists within The Metropolitan St. Louis
Sewer District an area of Overland, Missouri, containing the
project known as Seneca-Goodale of The Metropolitan St. Louis
Sewer District wherein there live and work numerous people; and
WHEREAS, storm sewage gathered from such area will have
no alternative means of disposition to crossing said property and
will constitute a menace to public health and welfare of the
general public and the residents of The Metropolitan St. Louis
Sewer District; and
WHEREAS, it is the purpose and design of The
Metropolitan St. Louis Sewer District to protect the public health
by constructing storm sewers over and across said area in order to
relieve and alleviate these conditions;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES
OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT:
Section One. In order to protect the public health and
relieve insanitary and dangerous conditions, it is necessary to
appropriate and acquire by the exercise of eminent domain or
otherwise an easement for the use of a sewer line as hereinafter

set forth, together with a temporary easement adjacent to the
right-of-way as obtained for working room during the construction
period, and the right of ingress and egress over the premises
sought to be condemned for access to such easement, said permanent
and temporary easement being more particularly described as
follows:
A permanent easement in a tract of land in Lot 8, Block 3 of
OVERLAND VIEW recorded in Plat Book 27, page 3 of the
St. Louis County Recorder's office and being more
particularly described as follows: Commencing at the
southwest corner of said Lot 8; thence along the west
line of said Lot 8, north 8o 48' east a distance of
15.99' to the point of beginning of the easement herein
described; thence continuing along said west line,
north 8o 48' east a distance of 43.03' to a point;
thence leaving said west line, north 22o 14' 19" east a
distance of 2.57' to the point of curvature of a curve
to the right having a radius of 55' thence along said
curve a distance of 44.16' to the point of tangency;
thence north 68o 14' 19" east a distance of 21.97' to a
point; thence north 8o 48' east a distance of 14.71' to
a point; thence south 81o 12' east a distance of 5' to a
point in the east line of said Lot 8, distance
therealong south 8o 48' west, 13' from the northeast

corner of said Lot 8, thence along said east line,
south 8o 48' west a distance of 23.38' to a point;
thence leaving said east line, south 68o 14' 19" west a
distance of 21.87' to the point of curvature of a curve
to the left having a radius of 45'; thence along said
curve a distance of 36.13' to the point of tangency;
thence south 22o 14' 19" west a distance of 44.43' to
the point of beginning..
A temporary easement during original construction of sewer
facilities, after which all rights of the condemnor shall
cease, which temporary easement is described as a tract of
land in Lot 8, Block 3 of OVERLAND VIEW recorded in Plat Book
27, Page 3 of the St. Louis County Recorder's office and
being more particularly described as follows: Commencing at
the southwest corner of said Lot 8; thence along the west
line of said Lot 8, north 8o 48' east a distance of 59.02' to
the point of beginning of the temporary construction easement
herein described; thence continuing along said west line,
north 8o 48' east a distance of 75.98' to the northwest
corner of said Lot 8; thence along the north line of said Lot
8, south 81o 12' east a distance of 50' to the northeast
corner of said Lot 8; thence along the east line of said Lot
8, south 8o 48' west a distance of 13.00' to a point, thence
leaving said east line, north 81o 12' west a distance of
5.00'; thence south 8o 48' west a distance of 14.71'; thence

south 68o 14' 19" west a distance of 21.97' to the point of
curvature of a curve to the left having a radius of 55';
thence along said curve a distance of 44.16' to the point of
tangency; thence south 22o 14' 19" west a distance of 2.57'
to the point of beginning.
Section Two. Counsel for The Metropolitan St. Louis
Sewer District be and is hereby authorized to institute and
prosecute an action in condemnation pursuant to the provisions of
the Plan of The Metropolitan St. Louis Sewer District and the laws
of the State of Missouri, for the appropriation of private
property as hereinbefore set out.
