HomeMy Public PortalAbout03191 O R D I N A N C E NO. 3191 AN ORDINANCE authorizing and directing the Executive Director and Secretary-Treasurer to grant to the State Highway Commission of Missouri an easement across portions of easements of The Metropolitan St. Louis Sewer District for the purpose of highway improvements on State Highway Route 61 in the vicinity of Route I-55. WHEREAS, the granting of said easement will not interfere with the sewer service provided therein, and WHEREAS, the State Highway Commission of Missouri has agreed to reimburse the District for any changes to District facilities in said easement, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State Highway Commission of Missouri an easement for the purpose of highway improvements to State Highway Route 61 in the vicinity of Route I-55 across portions of easements owned by the District in St. Louis County, Missouri, such easements being described as follows: Parcel No. 1: Those portions of District's easements described in instruments recorded in Book 6513, Page 1292 and in Book 6691, Page 1414, of the St. Louis County Records and situated on a tract of land in the southeast quarter of Section 28, Township 44 North, Range 6 East in St. Louis County, Missouri and also a part of Lot 3 of Carson Pontiac Subdivision as recorded in Plat Book 159, Page 3, of the St. Louis County Records and described as beginning at a point in the north line of a tract of land now or formerly owned by Donald Yahl and wife as recorded in Book 3891, Page 181, of the St. Louis County Records said point being 45 feet radial distance west of the hereinafter described centerline of Route 61; thence southerly and parallel with said 2 centerline to a point in the north line of the property owned by Noel Bianco Oldsmobile, Inc. as recorded in Book 6738, Page 2007; thence southerly to a point 47 feet radial distance west of P. C. Station 963+92.84; thence southerly to a point 54 feet radial distance west of centerline station 965+00; thence southeasterly to a point in the existing west right-of-way line of Route 61 opposite centerline Station 966+40; thence northerly along said west right-of-way line to a point in the north line of said tract of land now or formerly owned by said Donald Yahl; thence westerly along said north property line to the point of beginning. Parcel No. 2: That portion of District's easement described in instrument recorded in Book 6709, Page 1283, of the St. Louis County Records and situated on a parcel of land located in Lot 3 of Carson Pontiac, Inc. Subdivision as set out by the plat thereof recorded in Plat Book 159 Page 3 of the St. Louis County Records and described as follows: Bounded on the east and south by the east and south lines of Lot 3, said east lot line being also the west line of Von Talge Road and said south lot line also being the existing north line of East Concord Road; and on the northwest by a line beginning at a point in said east lot line, said point being 32 feet radial distance north of Station 1+75 on the hereinafter described centerline of Relocated East Concord Road; thence southwesterly to a point in said south lot line, said point being opposite P. T. Station 3+12.53. The centerlines of Route 61 and Relocated East Concord Road are described as follows: Beginning at Station 961+30.18 on the centerline of Route 61, said Station being distant 62.60 feet north 82 degrees 56 minutes 07 seconds west of an iron pipe at the northwest corner of a tract of land now or formerly owned by Scientific Associates, Inc. as set out by deed recorded in Book 5700, Page 574, of the St. Louis County Records; thence south 7 degrees, 03 minutes, 53 seconds west a distance of 262.66 feet to P. C. Station 963+92.84; thence southeasterly along said centerline and on the arc of a curve to the left, having a radius of 954.93 feet a distance of 533.45 feet to Station 969+26.29 on the centerline of Route 61 which equals Station 0+00 on the centerline of Relocated East Concord Road, and the tangent to curve at said Station 969+26.29 bears south 24 degrees, 56 minutes 32 seconds east; thence south 65 degrees, 03 minutes, 28 seconds west along said centerline of Relocated East Concord Road to P. C. Station 0+36.09 thence southwesterly along said centerline on the 3 arc of a curve to the left having a radius of 572.96 feet, a distance of 321.89 feet to P. T. Station 3+57.89. Beginning again at Station 961+30.18 on the centerline of Route 61, thence north 7 degrees 03 minutes 53 seconds east, a distance of 496.03 feet to P. T. Station 956+34.15; thence northwesterly on the arc of a curve to the left, having a radius of 956.82 feet, a distance of 234.15 feet to Station 954+00 being the point of ending. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. The foregoing Ordinance was adopted February 9, 1977.
