HomeMy Public PortalAbout03213 O R D I N A N C E NO. 3213 AN ORDINANCE, authorizing and directing the Executive Director and Secretary-Treasurer to grant to the State Highway Commission of Missouri an easement across a portion of an easement of The Metropolitan St. Louis Sewer District for the purpose of highway improvements on State Highway Route 725 between Route I-270 and Wood Avenue. WHEREAS, the granting of said easement will not interfere with the sewer service provided therein, and NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby grant to the State Highway Commission of Missouri an easement for the purpose of highway improvements to State Highway Route 725 between Route I-270 and Wood Avenue across a portion of an easement owned by the District in St. Louis County, Missouri, such easement being described as follows: Parcel No. 1: Commencing at a stone in the East and West centerline of Fractional Section 3, Township 46 North, Range 6 East, said stone being also in the North and South centerline of said Fractional Section 3; thence Southerly along said North and South centerline a distance of 1014.25 feet to Station 716+00 on the centerline of the Norfolk and Western Railroad; thence North 73 degrees 39 minutes 06 seconds West along said railroad centerline, a distance of 3085.03 feet to Station 746+85.03 which equals Station 157+95.23 on the baseline of the Northbound lane of Route 725; thence continuing North 73 degrees 39 minutes 06 seconds West along said railroad centerline a distance of 44.25 feet to the point of beginning; thence North 4 degrees 08 minutes 30 seconds West a distance of 259.94 feet to a point; thence South 73 degrees 39 minutes 06 seconds East a distance of 131.18 feet to a point; thence South 4 degrees 08 minutes 30 seconds East a distance of 320.26 feet to a point; thence North 73 degrees 39 minutes 06 seconds West a distance of 131.18 feet to a 2 point; thence North 4 degrees 08 minutes 30 seconds West a distance of 60.32 feet to the point of beginning. Parcel No. 2: Commencing at a stone in the East and West centerline of Fractional Section 3, Township 46 North, Range 6 East, said stone being also in the North and South centerline of said Fractional Section 3; thence Southerly along said North and South centerline a distance of 1014.25 feet to Station 716+00 on the centerline of the Norfolk and Western Railroad; thence North 73 degrees 39 minutes 06 seconds West along said Railroad centerline a distance of 3319.15 feet to Station 749+19.15 which equals Station 157+36.08 on the baseline of the Southbound lane of Route 725; thence continuing North 73 degrees 39 minutes 06 seconds West along said railroad centerline a distance of 78.76 feet to the point of beginning; thence North 2 degrees 06 minutes 56 seconds East a distance of 251.20 feet to a point; thence South 73 degrees 39 minutes 06 seconds East a distance of 110.00 feet to a point; thence South 2 degrees 06 minutes 56 seconds West a distance of 309.50 feet to a point; thence North 73 degrees 39 minutes 06 seconds West a distance of 110.00 feet to a point; thence North 2 degrees 06 minutes 56 seconds East a distance of 58.30 feet to the point of beginning. Parcel No. 3: A parcel of land in Wickham Park as recorded in Plat Book 39, Page 5, described as beginning at an iron pipe in the Northeast corner of Wickham Park; thence Westerly along the North line of Wickham Park to an iron pipe in the West line of a Private Road (30 feet wide); thence Southerly along said West street line to an iron pipe in the South line of Wickham Park; thence Easterly along said South subdivision line to the East line of said subdivision; said East subdivision line being the West line of Graham Road; thence Northerly along said East subdivision line to the point of beginning. Parcel No. 4: A parcel of land in Lots 3, 4 and 5 of Berkeley Acres as set out in Plat Book 17, Page 74 of the St. Louis County Records described as beginning at the point of intersection of the South line of Airport Road with the West line of Berkeley Avenue; thence Westerly along the South line of Airport Road a distance of 273.5 feet to a point; thence Southerly at right angles a distance of 20 feet to a point; thence Easterly and parallel to said South line of Airport Road for a distance of 65 feet to a point; thence Southeasterly Co a point in the East line of the West 65 feet of said Lot 4, said point being 30 feet perpendicular distance South of the South line of Airport Road; thence Southeasterly to a point in the South line of the North 160 feet of Lot 4 of Berkeley Acres, said point being 123.5 feet West of said West line of Berkeley Avenue; thence Southeasterly to a point in the South line of said Lot 3; said point being 25 feet West of the West line of Berkeley Avenue; thence Easterly 3 along said South lot line to said West street line; thence Northerly along said West street line to the point of beginning. Parcel No. 5: A parcel of land in Block 1 of Kathmar as set out by plat recorded in Plat Book 12, Page 16 and in Berkeley Acres as set out by plat recorded in Plat Book 17, Page 74 of the St. Louis County Records described a-beginning at the point of intersection of the existing South line of Airport Road with the West line of Dowling Avenue (40 feet wide); thence Westerly along said South lane of Airport Road to a point in the East line of Berkeley Avenue (40 feet wide); thence Southerly along said East lane of Berkeley Avenue to a point 50 feet North of the Southwest corner of Lot 20 of Berkeley Acres; thence Easterly and parallel with the South line of said Lot 20 to a point in the West line of Lot 10 of Block 1 of Kathmar; thence Northerly along the West line of Lot 10 to the South line of Lot 11 of Block 1 of Kathmar; thence Easterly along said South lot line to a point in the West line of Dowling Avenue; thence Northerly along said West street line to the point of beginning. Parcel No. 6: A parcel of land in Doddles Dale Plat Three as shown by plat recorded in Plat Book 86, Page 22 of the St. Louis County Records, lying on the Southwest side of and adjoining the Northeast line of said subdivision, having a uniform width of 15 feet and extending Southeasterly from the Northwest line of Lot 42 of Doddles Dale Plat Three to the South line of Doddles Dale Plat Three. Parcel No. 7: A parcel of land in U. S. Survey 101 and in U. S. Survey 656, Township 46 North, Range 6 East, St. Louis County, Missouri, described as being bounded on the North, Northeast and South by the North, Northeast and South property lines of a tract of land now or formerly owned by the City of St. Louis, Missouri as set out by deeds recorded in Book 5555, Page 489, Book 5691, Page 576, Book 6286, Page 87, and Book 6286, Page 93 of the St. Louis County Records; and on the Southwest by a line commencing at a point in the most Southeast property corner of said City of St. Louis tract; thence North 7 degrees, 49 minutes East along the East property line of said City tract a distance of 844.60 feet to a point; thence North 63 degrees 39 minutes East a distance of 113.35 feet to a point; thence North 25 degrees 52 minutes East a distance of 137.78 feet to the point of beginning; thence continuing North 25 degrees 52 minutes East a distance of 90 feet to a point; thence Northwesterly after turning an angle of 26 degrees, 53 minutes 42 seconds to the left a distance of 170.59 feet to a point; thence Northwesterly after turning an angle of 20 degrees 11 minutes 49 seconds moreso to the left a 4 distance of 630 feet to a point; thence Northerly after turning an angle of 14 degrees 48 minutes 41 seconds to the right a distance of 426.90 feet to a point; thence Northwesterly after turning an angle of 41 degrees 42 minutes 08 seconds to the left to a point in the North property line of said City tract. Parcel No. 8: A parcel of land in Lots 10 and 11 of Block 5 of West Ramona Park First Addition as shown by plat recorded in Plat Book 25, Page 35 of the St. Louis County Records, in Glencoe Avenue as vacated by Ordinance No. 1340 of the City of Berkeley and in U. S. Survey 656, Township 46 North, Range 6 East, described as beginning at a point in the Southeast corner of said Lot 10 and extending Northwesterly to the Northwest corner of said Lot 11; thence Northwesterly to the point of intersection of the existing Northeast Right-of-Way line of I-70 with the West line of a tract of land conveyed to Union Electric Company by deeds recorded in Book 404, Page 28 and Book 405, Page 129; thence Southeasterly along said Northeast Right-of-Way line of I-70 to the Southwest corner of said Lot 10; thence Easterly along the South line of said Lot 10 to the point of beginning. Parcel No. 9: A parcel of land in U. S. Survey 49, Township 46 North, Range 6 East, St. Louis County, Missouri, described as beginning at a point in the South line of a tract of land conveyed to Karjoy Development Corporation, et al by deeds recorded in Book 5872, Page 50, Book 6291, Page 1969 and Book 6291, Page 1991 of the St. Louis County Records, said point also being 389.66 feet West of the Southeast corner of said Karjoy Development tract; thence Easterly along the South property line of said tract a distance of 389.66 feet to said Southeast property corner, said point also being in the West line of Union Electric Right-of-way; thence Northerly along said Union Electric right-of-way a distance of 310.38 feet to a point; thence Northwesterly to a point in the West line of a tract of land now or formerly owned by Donald E. Roth as set out by deed recorded in Book 6534, Page 1196, said point being 385 feet North of the Southwest corner of said Roth tract; thence Southerly along said West property line to said Southwest property corner; thence Southeasterly to the point of beginning. Parcel No. 10: A parcel of land in Section 22, Township 46 North, Range 6 East, St. Louis County, Missouri, described as being bounded on the Southwest by the existing Northeast right-of-way line of Natural Bridge Road, on the Southeast by the Northwest line of Springdale Avenue, and on the North by the South line of a Roadway 30 feet wide. Parcel No. 11: A parcel of land in Outer Belt Terrace as set out in Plat Book 21, Page 17 and in Block 9 of Ramona Heights as set out in Plat Book 4, Page 15 of the St. Louis County Records, 5 described as beginning at the point of intersection of the Southwest right-of-way line of Natural Bridge Road with the East line of Endicott Avenue (40 feet wide); thence Southerly along said East line of Endicott Avenue to the North line of Wood Avenue (40 feet wide); thence Easterly along said North line of Wood Avenue to the center of Maline Creek; thence Southerly along said creek to a line 10 feet South of and parallel to the South line of Lot 9 of Block 9 of Ramona Heights; thence Easterly and parallel to said South lot line to a point 25 feet west of the west line of a tract of land conveyed to Union Electric Company by deed recorded in Book 317, Page 241; thence northerly and parallel with said Union Electric tract a distance of 20 feet to a point; thence easterly and parallel with said south line of Lot 9 of Block 9 of Ramona Heights a distance of 25 feet to said west line of Union Electric; thence Northerly along said West property line to the North line of Lot 10 of Block 9 of Ramona Heights; thence Easterly along said North lot line a distance of 115 feet to a point; thence Northeasterly to a point in the West line of Maline Avenue (50 feet wide), said point being 18.67 feet South of the Northeast corner of Lot 11 of Block 9 of Ramona Heights; thence Northerly along said West line of Maline Avenue for a distance of 303.67 feet to a point; thence Northwesterly to a point in the West line of said Union Electric tract, said point being 155 feet South of said Southwest line of Natural Bridge Road as measured along said West property line; thence Northerly along said West property line a distance of 120 feet to a point; thence Easterly at right angles to a point in said Southwest line of Natural Bridge Road; thence Northwesterly along said Southwest right-of-way line to the point of beginning. Section Two. The Executive Director and Secretary- Treasurer are hereby authorized and directed to execute in behalf of the District an instrument giving effect to Section One hereof. 6 The foregoing Ordinance was adopted March 30, 1977.
