HomeMy Public PortalAbout03232 O R D I N A N C E NO. 3232 AN ORDINANCE authorizing and directing the Executive Director to lease certain real property of The Metropolitan St. Louis Sewer District, lying in St. Louis County, Missouri, to Arthur J. DeGrand, Jr., d/b/a PRO AM Driving Range of St. Louis County, Missouri, and to execute a leasehold agreement upon the conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District hereinafter called Lessor, has acquired certain real property in St. Louis County, Missouri, incident to its public functions and responsibilities, said property being for Open Space Purposes, and WHEREAS, Arthur.J. DeGrand, Jr., d/b/a PRO AM Driving Range, hereinafter called Lessee; is desirous of leasing from Lessor a portion of said real property to bc used in conjunction with a Golf Driving Range he presently operates, on terms and conditions as hereafter generally set forth, and WHEREAS, the execution of said lease will not interfere with the Open Space Purposes for which said real property was acquired, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Arthur J. DeGrand, Jr., d/b/a PRO AM Driving Range, upon the general terms and conditions hereinafter set forth, the following described real property: The northwest 150 feet of a tract in Lots 13 and 14 of Carondelet Commons which was acquired by deed recorded in Book 6774, Page 24 of the County records. Said 150 foot parcel being bounded southwest by a line, perpendicular to the northwest line of tract acquired in deed aforesaid, and being 575 feet (measured along said northwest line) southwest of the south line of the Missouri Pacific Railway right-of-way. Section Two. The lease term shall commence on May 1, 1977 and continue for five (5) years to April 30, 1982, at the rental of Seventy-five Dollars ($75.00) per month, or a net yearly rental of Nine Hundred Dollars ($900.00). Section Three. The Executive Director is hereby authorized and directed to execute in behalf of the District a Lease giving effect to Sections One and Two hereof and embodying such general terms and conditions. The foregoing Ordinance was adopted May 11, 1977.
